HomeMy WebLinkAboutOrd 5098 04/04/2000 ORDINANCE NO, 5098 AN ORDINANCE GRANTING A CONDITIONAL USE AND VARIATION FOR PROPERTY COMMONLY KNOWN AS 120 NORTH YATES LANE Passed and approved by the President and Board of Trustees the 4th day of April, 2000 Published in pamphlet form by authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 5th day of April, 2000 VWL 3/24/00 3~30~00 ORDINANCE NO. 5098 AN ORDINANCE GRANTING A CONDITIONAL USE AND VARIATION FOR PROPERTY COMMONLY KNOWN AS 120 NORTH YATES LANE WHEREAS, Lawrence Metzger (hereinafter referred to as "Petitioner") has filed a petition for a Variation with respect to property located at 120 Yates Lane (hereinafter referred to as the "Subject Property") and legally described as follows: Lot 270 in 3~ Addition to Bluett's Fairview Gardens, being a subdivision of part of the E¼ of the SE~ of Section 35, Township 42 North, Range 11 East of the Third Principal Meridian, according to the plat thereof registered in the Office of the Registrar of Titles of Cook County, Illinois on January 19, 1962 as Document No. 2016922 and Certificate of Correction thereof registered on March 14, 1962 as Document No. 2023843 and WHEREAS, the Petitioner seeks a Variation to construct a wood deck in the side interior yard, encroaching three feet (3') into the minimum side yard required in Section 14.902.B.lof the Mount Prospect Village Code; and WHEREAS, a Public Hearing was held on the request for a Variation being the subject of ZBA Case No. 02-00 before the Zoning Board of Appeals of the Village of Mount Prospect on the 24th day of February, 2000, pursuant to proper legal notice having been published in the Mount Prospect Daily Herald on the 9th day of February, 2000; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect; and WHEREAS, the President and Board of Trustees of the Viltage of Mount Prospect have given consideration to the request herein and have determined that the same meets the standards of the Village and that the granting of the proposed Variation would be in the best interest of the Village. age 2/2 120 Yates Lane NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect do hereby grant a Variation, as provided in Section 14.902.B.1 of the Village Code, to allow the construction of a wood deck in the side interior yard, which will encroach three-feet (3') into the minimum side yard required by the Mount Prospect Village Code, as shown on the Site Plan, a copy of which is attached hereto and hereby made a part hereof as Exhibit "A." SECTION THREE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
