JURACEK AND BOARD OF TRUSTEES FROM: VILLAGE MANAGER MICHAEL JANONIS DATE: AUGUST 12, 2014 SUBJECT: CHANGE OF OWNERSHIP FADADAIS 4 INC. D /B /A LOS ARCOS 1707 W. ALGONQUIN ROAD REQUEST FOR A NEW CLASS "F1" LIQUOR LICENSE CHANGE OF OWNERSHIP LANGOSTINO'S 92 INC. D /B /A LANGOSTINO'S 1590 S. BUSSE ROAD REQUEST FOR A NEW CLASS "F3" LIQUOR LICENSE On Friday August 8, 2014 the Village Manager and Administrative Assistant to the Village Manager met with owner Porfirio Gomez and wife Maria Gonzalez regarding his request to assume ownership of the above referenced establishments. The current owner is retiring and the purchase of the business is contingent upon approval of the liquor licenses. Mr. Gomez indicated both restaurants would keep their same classification. The F -1 classification (Los Arcos) allows for the service of all alcoholic liquor service at dining tables only and the Class "F -3" designation ( Langostino's Nayarit) provides for full liquor service both in a restaurant and lounge setting. Mr. Gomez indicated he currently holds liquor licenses in Woodridge at the Los Arcos III restaurant and in Crystal Lake at the Las Cazvelitas restaurant. Both establishments are in good standing with each municipality. Mr. Gomez's extensive restaurant experience also includes managing both the Mount Prospect Los Arcos location since 1992 and the current Mariscos El Veneno restaurant since 2009. With regard to the operation of the establishment, the applicant plans no substantive changes other than upgrading of the menu at Langostino's to include more seafood. Lunch and dinner will continue to be served seven days a week and hours of operation will remain the same at both locations. Mr. Gomez and his wife intend to make this venture their full -time endeavor and will be on site as the management team. The Village Manager discussed at length with Mr. Gomez and Maria the Village's particular sensitivity to the sale of alcohol to minors and over service to clearly intoxicated individuals. The Village Manager also indicated that the applicants were responsible for the actions of all employees and managers. Mr. Janonis covered the Village's Fight Ordinance requirements. They indicated they had read the Village's rules and regulations in this regard and understood all of the Village's requirements. A completed application along with fees and required documents have been submitted. Both Mr. Porfirio and his wife have submitted to fingerprinting and background checks. If the Village Board views this application favorably, an Ordinance creating a new Class "F1" and "F -Y license would need to be adopted with the current licenses being deleted upon completion of the sale. ORDINANCE NO. _____ AN ORDINANCE AMENDING CHAPTER 13 OF THE VILLAGE CODE OF MOUNT PROSPECT BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOISACTING IN THE EXERCISE OF THEIR HOME RULE POWERS: SECTION ONE: That in accordance with Subsection A of Section 13.108 of Chapter 13 of the Village Code of Mount Prospect, as amended, the Corporate Authorities shall determine the number of Liquor Licenses available in each Classification and shall establish a list specifying the number of Liquor increasing the number of Class “F-1”Liquor Licenses authorized. Said list is hereby amended Licenses by One (1) FADADAIS 4 INC. D/B/A LOS ARCOS 1707 W. ALGONQUIN AND increasing the number of Class “F-3” Liquor Licenses by One (1) LANGOSTINO’S 92 INC. D/B/A LANGOSTINO’S 1590 S.
