FINANCIAL MONTHLY FINANCIAL REPORT AND APPROVE BILLS REPORT & Mayor Juracek stated the next item on the agenda, "MONTHLY FINANCIAL REPORT AND APPROVE BILLS APPROVE BILLS" was noted by an asterisk and unless there was a request to remove an item(s), all items further listed in that manner would be considered with one (1) vote as business item "IX. CONSENT AGENDA." MAYOR'S REPORT MAYOR'S REPORT A. Accolades Proclamation: "A Proclamation Acknowledging the Contributions of Lance Besthoff to the Village of Mount Prospect" Mayor Juracek presented the proclamation to Officer Lance Besthoff; his wife Karen, son, Kyle and daughter, Kayla accompanied Officer Besthoff. On behalf of the Village Board and community, Mayor Juracek thanked Officer Besthoff for his nearly 34 years of dedicated service as a police officer. Officer Besthoff thanked the Mayor and Village Board for the proclamation and the opportunity to serve as a member of the Mount Prospect Police Department. He recognized and thanked his family for their support as well as his fellow officers. APPOINTMENTS B. PZ- 17 -14, 1750 West Central Road, Morgan Group, Zoning Text Amendments PZ- 17 -14, 1750 1St reading of AN ORDINANCE AMENDING CHAPTER 14 (ZONING) OF THE VILLAGE CODE WEST CENTRAL OF MOUNT PROSPECT ROAD, AMEND CHAPTER 14 Mayor Juracek presented for a first (1 reading, An Ordinance Amending Chapter 14 (Zoning) (ZONING) OF THE of the Village of Mount Prospect. This ordinance amends Section 14.604, "Land Use Table 2: MOUNT PROSPECT Section 14.224 "Off Street Parking Requirements" and Section 14.2401, "Definitions" of Chapter VILLAGE CODE 14 (Zoning) of the Mount Prospect Village Code. The Planning and Zoning Commission recommended approval by a vote of 7 -0. Community Development Director Bill Cooney provided background information stating the Petitioner intends to renovate the interior of the existing building and add two (2) stories to the center section of the existing building for an 83,998 square foot self- storage facility consisting of 687- units. As the Zoning Code does not specifically address self- storage facilities, the Petitioner is seeking to amend: 1) Section 14.604: Land Use Table 2 — to add Mini - Warehouse as a permitted use in both the 1 -1 and 1 -3 zoning districts 2) Section 14.2224: Off Street Parking Requirements — to add Mini - Warehouse to the industrial section of the table with a parking requirement of 0.14 parking spaces per 1,000 square feet of gross floor area, plus one (1) space per vehicle used in the conduct of the business (office space calculated separately) and 3) Section 14.2401: Definitions — to add Mini - Warehouse with the following definition: a storage or warehousing service within a building for individuals to store personal effects and for businesses to store materials for operation of an industrial or commercial enterprise elsewhere. But in no case may storage spaces in a mini - warehouse facility function as an independent retail, wholesale, business or service use. Spaces may not be used for workshops, hobby shops, manufacturing or similar uses. Human occupancy is limited to that required to transport, arrange and maintain stored materials. 2of6 Mr. Cooney stated the proposed Text Amendment meets the standards contained in the Zoning Code and staff recommend approval. In response to questions from the Village Board, Mr. Cooney provided the following: -If approved, code amendment would apply to mini - storage warehouses at the subject property as well as all 1 -1 and 1 -3 zoning districts. The Village prohibits the operation of a business out of storage units; the Village may not be aware of prohibited activity until notified of violation. -Proposed ordinance only grants approval for zoning of mini - warehouse not building plans. (Mr. Cooney showed the proposed building plans including landscaping.) • Restriction on permitted storage items. • Installation of sprinkler system required. • Self- storage facilities would fall under the amended guidelines. Mr. John Mullen, Morgan Group, Inc., was in attendance to provide additional information and respond to questions from the Village Board. Mr. Mullen stated his research indicated Mount Prospect was in need of additional self- storage facilities. Proposed site is good location and sn opportunity to improve building. In response to questions from the Village Board, Mr. Mullen provided the following: • Structure — engineering evaluation has been conducted. Tremendous amount of work to be done — portion of building will require reinforcement. • Walls will be constructed with various sizes of corrugated steel. • He has worked in property development for forty (40) years Village Board Comments • Important engineering work has already been completed and determined work can be accomplished. - Subject property an orphan building for a long time - appreciate the Petitioner chose Mount Prospect. ■ Supports use of building as an indoor storage facility. Trustee Zadel, seconded by Trustee Polit, moved to waive the rule requiring two (2) readings of an ordinance. Upon roll call: Ayes. VARIATION Mayor Juracek presented for a first (1 reading, An Ordinance Granting Conditional Use for a Final Planned Unit Development, Conditional Use for a Drive - Through Establishment and Variation to the Overall Lot Coverage for the Property Located at 990 -1145 Mount Prospect Plaza, 940 -950 East Rand Road and 1200 -1220 East Central Road. The Planning and Zoning Commission recommended approval by a vote of 7 -0. 3 of 6 Community Development Director Bill Cooney stated the recently purchased Mount Prospect Plaza is the second (2" largest mall in the Village. The Petitioner would like to maximize the dead space in the middle of the parking lot by constructing two (2) new outlot buildings totaling 11,800 square feet. The site plan indicates one (1) of the outlot buildings would include a drive - through; located along Rand Road. The second (2" outlot building would be located to the northeast of the existing Chase Bank. Conditional Use approval is required for a Final Planned Unit Development (PUD) in order to construct the two (2) new outlot buildings and allow a drive - through establishment. In addition, the Subject Property does not conform to the overall lot coverage permitted. The existing lot coverage measures approximately eighty -eight and one -half percent (88.5 %); maximum permitted lot coverage is seventy -five percent (75 %). The proposed improvements include adding landscaping, which would reduce the overall lot coverage to approximately eighty -six percent (86 %). The Petitioner seeks Variation approval to allow an overall lot coverage of eighty -six percent (86 %). Staff recommend approval of the Petitioner's request. Trustee Korn questioned the notification of the Public Hearing to the businesses at the subject property. Mr. Cooney stated notices were sent to properties within two hundred fifty feet (250') of the property; notifications were sent to owners not tenants. Mr. Cooney stated there were signs on the property giving notice of the public hearing. Trustee Korn expressed concern regarding the lack of notification to the tenants; written notification should have been provided to tenants in addition to the owners. In response to questions from the Village Board, Mr. Cooney provided the following: • Parking requirements exceed Village Code requirements. • Wal Mart is not part of the Plaza; Wal Mart has own lot. • Tree islands will be well- defined; curbed off with landscaping. • Village will make sure trees do not obstruct site - lines. • Majority of landscaping is in the back of the building. • Walgreen's data center — lease agreement. • 86% lot coverage — significant improvement. Mr. Laurence Freidman, attorney for the Petitioner Mr. Ross Gallentine, Petitioner — Ramco- Gershenson Properties and Mr. Fred Zantello, Vice President — Ramco- Gershenson Properties were in attendance to provide additional information and respond to questions from the Village Board. In response to Trustee Korn's concern regarding lack of notification to the tenants, Mr. Freidman stated the Petitioner complied with public notice requirements. Focus was to first (1 obtain Village approval for Conditional Uses and Variation. If approved, tenants will be notified prior to construction. Village Board Comments /Concerns • Tenants concerned with proposed drive - through in parking lot area. • Drive lane in front of Panda Express is problematic. • Ingress /egress to mall from Rand /Central /Mount Prospect Roads interchange is a significant problem. • Building additional space while existing buildings are vacant. • Sign area — maintenance concern; recommends use of stucco versus EIFS. • Walgreen's (data center) — lease agreement. • Pleased with additional landscaping. Tenants concerned with p roposed drive -thro ugh un r id le of parkin lot ara n Trustee Hoefert stated most people do not park in the middle of the lot — outlot buildings will intensify usage of strip mall. Drive - through — competitive marketing. Drive lane in front of Panda Express is problematic and out -lane to Rand is a si nificant problem. 4 of 6 Mr. Cooney stated the Community Development Department is seeking grant money for an engineering study of the Rand /Central /Mount Prospect Roads interchange; include study of ingress /egress to mall at this location. (The petitioner has not conducted traffic studies.) Trustee Polit and Trustee Zadel recommended the mall entrance be restriped to improve traffic flow to and from the mall. Trustee Matuszak stated ingress /egress at mall entrance is only part of the problem; supports efforts to study interchange. Mayor Juracek encouraged the petitioner to take a flexible approach with traffic pattern design within mall area. Referencing Randhurst Village, Mayor Juracek stated since its original design staff have continued to work with Randhurst Village to improve the traffic pattern. Building additional space while existing buildings are vacant. Mr. Santello stated they are confident the buildings will be filled. He stated the Dollar Store will soon open. Sign area — maintenance concern; recommend use of stucco versus EIFS. Trustee Rogers stated EIFS does not hold; strongly recommends the use of stucco, Petitioner stated EIFS was code compliant but he would look into using stucco. Walgreen's (data center) — lease agreement Mr. Santello, indicated the Petitioner is seeking to negotiate a long -term contract with Walgreen's. Public Comments Residents addressing the Village Board and their collective comments Ms. Holly Listopad 107 North Westgate Road Mr. Nile Little 3 North Westgate Road Resident Corner of Thayer and Westgate Comments /Concerns • Submitted list of concerns from residents in Westgate neighborhood. • Number of residents not notified of public hearing. • Increased pedestrian, truck and vehicle traffic, accessing the mall from Westgate Road. Disruptive to neighborhood. • Westgate residential street; truck traffic restricted. • Installation of diesel generators at Walgreen's. Generators and evaporators source of excessive noise. • Overall increase of noise and light pollution in neighborhood. • Trucks idling in rear of mall. ■ Likes additional landscaping but would like more; additional landscaping may mitigate noise issue. Village Board Comments • Noise and traffic issues need to be addressed. • Police enforcement of truck restrictions. • Refer traffic issues to Transportation Safety Commission; review and recommendations. • Refer noise issues to Environmental Health; noise assessment/code enforcement. • Petitioner needs to be sensitive to residential area. • Need to resolve truck issue before landscaping installed. • Walmart has loading docks on both east and west side of building; Walmart could put no entry on Westgate on bill of lading. • Possible considerations — barricade rear driveway or designate road as one way to reduce traffic onto Westgate Road. 5of6 ■ Need commitment from Petitioner — owners will participants in resolving noise and traffic issues. Mr. Freidman stated the petitioner will be a participant but does not support taking piece meal measures. Will work with staff in developing reasonable solutions to road, traffic and noise issues. Mayor Juracek thanked the residents for bringing their concerns to the Village Board and assured them the Village will take appropriate steps to address their concerns. Mayor Juracek also thanked the Petitioner for willingness to look at alternatives to resolve the neighborhood concerns. Trustee Zadel, seconded by Trustee Matuszak, moved to waive the rule requiring two (2) readings of an ordinance. Trustee Zadel, seconded by Trustee Polit, moved for approval of Ordinance No. 6148: "AN ORDINANCE GRANTING CONDITIONAL USE FOR A FINAL PLANNED UNIT DEVELOPMENT, CONDITIONAL USE FOR A DRIVE - THROUGH ESTABLISHMENT AND VARIATION TO THE OVERALL LOT COVERAGE FOR THE PROPERTY LOCATED AT 990 - ORD 6148 1145 MOUNT PROSPECT PLAZA, 940 -950 EAST RAND ROAD AND 1200 -1220 EAST CENTRAL ROAD" Upon roll call: Ayes: Hoefert, Korn, Matuszak, Polit, Zadel, Nays: Rogers Motion carried. MANAGER'S REPORT MANAGER'S A. Motion to approve waiver of bid and the purchase of 2014 Dodge Pursuit AWD through the REPORT suburban purchasing cooperative agreement with the Northwest Municipal Conference in an amount not to exceed $26,400. Status Village Manager Janonis announced the following community events;. • Concert on the Green — Seredipity July 18 6:00 — 8 pm • Midsummer Block Party, Busse Avenue and Emerson Street July 25 and 26th OTHER BUSINESS OTHER BUSINESS In response to Trustee Hoefert's question regarding regulations for storage pods on residential property, Mr. Cooney stated the Village Code limits placement to two (2) weeks. Properties in violation of the Village Code should be submitted to Environmental Health Division for staff follow -up.
