COMMITTEE OF THE WHOLE MINUTES
December 10, 2013
I. CALL TO ORDER — ROLL CALL
The meeting was called to order at 7:06 p.m. in the Village Board Room of the
Village Hall, 50 South Emerson Street, by Mayor Arlene Juracek. Trustees
present included Paul Hoefert, John Korn, John Matuszak, Steven Polit, Richard
Rogers and Michael Zadel. Staff present included Village Manager Michael
Janonis, Assistant Village Manager David Strahl, Deputy Police Chief John
Wagner, Commander Mark McGuffin, Sergeant Timothy Griffith, and
Commander Mike Eterno.
II. APPROVAL OF COMMITTEE OF THE WHOLE MINUTES FOR NOVEMBER
26, 2013
Motion made by Trustee Korn second by Trustee Rogers to approve the minutes
of November 26, 2013. Trustee Zadel requested that his name be removed to be
marked as absent. Minutes were approved with the change.
III. CITIZENS TO BE HEARD

IV. VICIOUS ANIMALS
Deputy Police Chief Wagner is requesting Village Board approval to amend the
vicious animals definition in the ordinance and to allow a process to put an
animal that had previously been declared vicious on a probationary period. He
said the changes in section 20.402 set the procedures for which the animal is to
be taken off the vicious animal list established by the Chief. The Police Chief still
retains authority as to whether an animal would be removed but this process
would allow a mechanism for such an animal to be removed from the list.
Currently there is no process to remove an animal from the vicious list after being
rehabilitated and this would allow such a process. He stated there will be a
review of the circumstances that the dog on the list would begin with and
depending on the change in circumstances as to whether it would be removed
from the list. He stated there would be no repeat offenders that would be
removed off the list a second time.
There was a general discussion of the Village Board members as to clearly
defining the twenty -five hours of successful training and how the process would
work for a neighbor who would not be in favor of removing the animal from the
list through the petition process.

General consensus from the Village Board was to support the staff
recommendations for the establishment of a process to remove an animal from
the vicious animal list.
V. ILLINOIS LEGISLATIVE UPDATES
• Concealed Carry Act: Sgt. Tim Griffith provided an overview of the
legislation and stated there have been no administrative rules written yet
regarding the regulations, however; he did state that there is a process in
place in which to get a permit. The local Police may review the request for
a permit and provide objection to the permit request electronically for a
resident within a community. He also provided an outline of the prohibited
locations where concealed carry is not allowed. He stated that it is highly
recommended the required signage be in place even in the prohibited
locations. He stated a person with a concealed carry must declare the
firearm on his person to a Police officer if so requested.
He stated the Crime Prevention Division has been educating Village
businesses, the library, and school districts as to the best way to address
this law. He stated the Police Department has put together a protocol to
hold guns for persons transported by ambulance and clarified that firearms
must be left in a locked trunk when an individual is to enter a prohibited
location.
• Medical Marijuana: Sgt. Griffith stated the Police department expects
administrative rules of some type during the summer. State law allows for
22 cultivation centers and 60 dispensaries throughout the state. Based on
the rulemaking process and complexity many of these regulations will
probably not be done until late 2014. He stated the Village may enact
zoning ordinances to regulate dispensaries. He stated the typical dosage
is 2.5 ounces every 14 days and it must be grown and obtained within
Illinois. Enforcement remains the same and there are limits on where you
can smoke.
• Temporary visitors licenses: Sgt. Griffith stated the purpose of these
licenses are for driving privileges only and not for identification. To obtain
such a license an individual must provide the required documentation
which is outlined in the regulations. They must also have valid insurance
and the license is only valid for three years.
• Electronic Cigarettes: Sgt. Griffith stated the regulation regarding the
sale to minors is still in place with electronics cigarettes. There would be a
need to change the ordinance to prohibit possession of electronic
cigarettes by minors. He stated there would be a need for some additional

legal direction as to banning the use of these cigarettes in a similar
manner as regular cigarettes. He stated ordinance modifications should
mirror tobacco product sale regulations.
Consensus of the Village Board was to consider an ordinance that would
regulate the sale of electronic cigarettes to minors just as sales
regulations exist for tobacco products.
VI. MANAGER'S REPORT
Village Manager Janonis reminded everyone that the next Coffee with Council
session is December 14 from 9:00 a.m. to 11:00 a.m. in the Community Center of
the Village Hall.
VII. ANY OTHER BUSINESS
Trustee Hoefert wanted to thank the Police Department for the information
presented this evening.
Mayor Juracek announced that Randhurst is sponsoring a fundraiser for
Philippine typhoon relief this weekend.
VIII. ADJOURNMENT
