VWL 3/15/00 ORDINANCE NO. 5097 AN ORDINANCE GRANTING A CONDITIONAL USE AND VARIATION FOR PROPERTY COMMONLY KNOWN AS 1712 MARTHA LANE WHEREAS, Marion Klatka (hereinafter referred to as "Petitioner") has filed a petition for a Variation with respect to property located at 1712 Martha Lane (hereinafter referred to as the "Subject Property") and legally described as follows: Lot 29 in Colonial Heights First Addition, being a Subdivision of part of Lots 5,6, and 7 in Owner's Subdivision, being a subdivision of the Southeast Quarter (except the West half of the Southwest Quarter thereof) of Section 10, Township 41 North, Range 11 East of the Third Principal Meridian, according to the plat of said Colonial Heights First Addition registered in the Office of the Registrar of Titles of Cook County, Illinois on May 16, 1961 as Document Number 1977989, in Cook County Illinois; and WHEREAS, the Petitioner seeks a Variation to construct a two-car garage, twenty four feet by twenty-eight feet (24'x28'), which exceeds the maximum size limit allowed by the Mount Prospect Village Code; and WHEREAS, a Public Hearing was held on the request for a Variation being the subject of ZBA Case No. 35-99 before the Zoning Board of Appeals of the Village of Mount Prospect on the 27th day of January, 2000, pursuant to proper legal notice having been published in the Mount Prospect Daily Herald on the 10~ day of January, 2000; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have given consideration to the request herein and have determined that the same meets the standards of the Village and that the granting of the proposed Variation would be in the best interest of the Village. age 2/2 1712 Martha Lane NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TVVO: The President and Board of Trustees of the Village of Mount Prospect do hereby grant a Variation, as provided in Section 14.203.C of the Village Code, to allow the construction of a two-car garage which exceeds the maximum size limit allowed by the Village Code, as shown on the Site Plan, a copy of which is attached hereto and hereby made a part hereof as Exhibit '%." SECTION THREE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
