IV. MUNICIPAL TELECOMMUNICATIONS INFRASTRUCTURE MAINTENANCE
FEE ORDINANCE
In its last session, the illinois General Assembly passed, and Governor Edgar
signed, House Bill 1147, which will bring about a major change in the traditional
methods used by municipalities to control the use of public streets and other rights-
of-way by telecommunications companies. Effective January 1, 1998, House Bill
1147 substantially eliminates the ability of municipalities to require
telecommunications retailers (wired/wireless) to enter into Franchise or License
Agreements and to pay negotiated fees for the use of public streets and rights-of-
way. Rather, the Act has three stated purposes:
Abolish municipal Franchise Fees with respect to telecommunications
retailers.
Create a uniform system for the collection and distribution of fees associated
with the privilege of the use of the public right-of-way for telecommunications'
activity.
Provide municipalities a comprehensive method of compensation for
telecommunications' activity including the recovery of reasonable costs of
regulating the use of the public rights-of-way for telecommunications' activity.
In order to recover our costs associated with regulating the telecommunications
retailers' use of public streets and rights-of-way, the Village may impose a
"MunicipaI TeIecommunications infrastructure Maintenance Fee (MTIMF)' at a rate
of up to 1% of gross revenues of the telecommunications retailer(s), in order to be
in a position to begin collecting this fee on January 1, 1998, a 90 day notice to
telecommunications providers is required. It is imperative that the Village Board
undertake consideration of this item at its October 7 Board meeting.
The illinois Municipal League, the Northwest Municipal Conference and the DuPage
Mayors and Managers Conference have all been working with industry
representatives to develop a Model MTIMF Ordinance. The information contained
in your meeting package provides an overview of the legislation along with a copy
of the Model Ordinance and other related documents.

Village Attorney Everette Hill will be in attendance at Tuesday evening's meetin9
along with appropriate staff to facilitate discussion and answer questions. Mr. Hill
is currently working with the Villages of Northfield and Lincolnshire to adopt MTIMF
Ordinances in those respective communities.
