A RESOLUTION AUTHORIZING EXECUTION OF A JOINT
AGREEMENT BETWEEN THE VILLAGE OF MOUNT PROSPECT
AND THE ILLINOIS DEPARTMENT OF TRANSPORTION
RELATIVE TO THE SIGNALIZATION IMPROVEMENT
AT OAKTON STREET AND ELMHURST ROAD
WHEREAS, the corporate authorities of the Village of Mount
Prospect have determined that it would in the best interest of
the Village to participate with the State of Illinois Department
of Transportation to improve the traffic signals at Oakton Street
and Elmhurst Road in the Village of Mount Prospect; and
WHEREAS, in order to proceed with the proposed improvement it has
been determined by the Mayor and Board of Trustees that the best
interest of the residents of the Village would be served by
entering into an Agreement with the Illinois Department of
Transportation relative to sharing in the cost of said
improvement.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the Mayor and Board of Trustees of the
Village of Mount prospect do hereby express their desire to
participate in their cost of the improving the traffic signals at
Oakton Street and Elmhurst Road within the corporate boundaries
of the Village as more fully set forth on the Agreement attached
hereto and hereby made a part hereof as Exhibit "A".
SECTION TWO: That this Resolution shall be in full force and
effect from and after its passage and approval in the manner
provided by law.

This AGREEMENT entered into by and between the State of Illinois,
acting by and through its Department of Transportation hereinafter
called the State, and the Village of Mount Prospect, of
the State of Illinois, here~nafter called the LA.

Whereas, the State, in order to facilitate the free flow of
traffic and insure safety to the motoring public, is desirous of
making the improvements described in Exhibit A attached hereto and
made a part hereof and further identified as follows; and

Whereas, the LA is desirous of said improvements in that same
will be of immediate benefit to the LA residents and permanent
in nature;
Now, Therefore, in consideration of the mutual covenants
contained herein, the parties hereto agree as follows:
Article I
The State Agrees:
1. To make the surveys, obtain all n~cessary right-of-way,
(if required), prepare plans and specifications, receive
bids and award the contract, furnish engineering
inspection during construction and cause the
improvement to be built in accordance with the plans,
specifications and contract.
2. To pay all right of way (if applicable), construction and
engineering costs, including the cost of any Railroad
adjustments, subject to reimbursement by the LA as
hereinafter stipulated. The State will negotiate with the
Railroad(s) for any required adjustments.
3. Upon final field inspection of the improvement and so long
as the route is used as a State Highway, to maintain or
cause to be maintained, the median, the through traffic
lanes, left and right turn lanes and the curb and gutter
or stabilized shoulders and ditches adjacent to those
lanes and lane line and median line markings.

~ Q) The LA Agrees:
I~/~ 1. To pass a resolution appropriating sufficient funds to pay
---- its share of the cost of this improvement a copy of which is
attached hereto as Exhibit B and made a part hereof and will
pass a supplemental resolution if the original amount
appropriated is insufficient to cover their final costs.
2. To adopt and put into effect, prior to the State advertising
for the work to be performed hereunder, an ordinance
requiring parking within the designated parking lanes be
parallel to the curbs and prohibited at all other locations
within the limits of the improvement, a copy of <which is
attached hereto and will in the future, prohibit parking at
such locations on or immediately adjacent to the improvement
as may be determined necessary by the State from traffic
capacity studies.
3. To adopt and put into effect prior to the State advertising
for the work to be performed hereunder an appropriate
ordinance prohibiting the discharge of sanitary sewage and
industrial waste into any storm sewer or drainage facility
constructed as a part of this improvement, æ.copy of which
is attached hereto. <,
4. To adopt and put into effect prior to the State advertising
for the work to be performed hereunder an appropriate
ordinance relative to the disposition of encroachments and
prohibiting in the future any new encroachments within the
limits of the improvement, a copy of which is attached
hereto. The disposition of encroachments will be
cooperatively determined with LA and State representatives.
5. To provide prior to the State advertising for the work to be
performed hereunder approval of the plans and specifications
as prepared, by resolution or letter.
6. To prohibit driveway entrance openings to be made in the
curb, as constructed, without the written consent of the
State.
7. To exercise its franchise right to cause private utilities
to be relocated at no expense to the State.
8. To cause LA owned utilities located on right of way acquired
by the State or installed within the limits of a roadway
after the said roadway was taken over for maintenance by the
State, to be relocated andlor adjusted at no expense to the
State.
9. To reimburse the State for its share of construction,
engineering andlor right-of-way costs as determined in
Exhibit C attached hereto and made a part hereof and in the
manner described in Exhibit B.
10. Upon final field inspection of the improvement to maintain
'or cause to be maintained (within the LA limits) those
portions of the improvement which are not maintained by the
State including:

C. Storm Sewers and Appurtenances
(1) Applicable when storm sewer system constructed for
State highway drainage only:
to perform those functions necessary to keep
the sewer in a serviceable condition including
cleaning sewer lines, inlets, manholes and
catch basins along with the repair or
replacement of inlet, manhole and catch basins'
frames, grates or lids plus structural failures
to a maximum length of 12 feet between adjacent
manholes. The maintenance, repair and lor
reconstruction of storm sewers constructed as
part of this improvement beyond the
aforedescribed responsibilities shall be that
of the State.
(2) Applicable when storm sewer system constructed as
a joint LA and State use facility:
to perform those functions necessary to keep
the sewer in a serviceable condition including
cleaning sewer lanes, inlets, manholes and
catch basins along with the repair or
replacement of inlet, manholes and catch
basins' frames, grates or lids plus structural
failures to a maximum length of l2 feet between
adjacent manholes. The LA and State shall
share the cost of maintenance, except as
aforedescribed, repair andlor reconstruction of
the joint use sewer(s) to the same
proportioning as the sewers initial
construction costs were proportioned.
Sidewalks, parkways, crosswalk and stopline markings
and LA owned utilities including the appurtenances
thereto.
ll. To assume the jurisdiction of that portion of highway
described in the Jurisdiction Transfer Document attached
.II} hereto as Exhibit E and made a part hereof.

B. be proportioned between the parties hereto in accordance
with Exhibit D attached hereto and made a part hereof.
2. This Agreement and the covenants contained herein shall be
null and void in the event a contract covering the
construction work contemplated herein is not awarded within
three years subsequent to execution of the Agreement.
3. This Agreement shall be binding upon and to the benefit of
the parties hereto their successors and assigns.

PROJECT DESCRIPTION
(ILLINOIS ROUTE 83 AT OAKTON STREET)
A.
Illinois Route 83 at Oakton Street:
Improving intersection capacity by increasing left turn lane storage on all
approaches and also increasing right turn lane storage on the south approach.
The existing cross section will be maintained, providing Illinois Route 83
with two l2' through traffic-lanes in each direction separated by a l2' and
variable width left turn lane and exclusive l2' right turn lane and providing
Oakton Street with two l2' through traffic lanes in each direction separated
by a 12' left turn lane; modernization of existing traffic sigAal system
including relocation of existing "OPTICOM" equipment, and by performing all
other work necessary to complete the improvement in accordance with the
approved plans and specifications.

EXHIBIT B
WHEREAS, the Village of Mount Prospect has entered into an agreement
with the State of Illinois for the improvement of Illinois Route 83 known
as State Section: 3025N-87 , Village Section:c98-ooc99-ão-7'"4 and
WHEREAS, in compliance with the aforementioned agreement, it is
necessary for the Village to appropriate Funds to pay its share of the
cost of said improvement.
NOW, THEREFORE, BE IT RESOLVED, that there is hereby appropriated the
sun of $ 2873. co DOLLARS ($ 2.87~ <'0 ) or so much thereof as may
be necessary, from any money now or hereafter allotted to the Village to
pay its share of.the cost of this improvement as provided in the
agreement; and
BE IT FURTHER RESOLVED, that upon award of the contract for this
improvement, the Village will pay to the Department of Transportation of
the State of Illinois, in a lunp sun from any funds allotted to the',
Village, an amount equal to 95% of its obligation incurred under this
Agreement, and will pay to the said Department the remainder of its
obligation (including any non-participating costs for FA projects) in a
lump sum, upon completion of the project based upon .final costs.

Exhibit D
Supplement to Article III. Item #1, Subsection A
Article III, Item 11, Subsection A is supplemented by the following language:
"The State agrees to make arrangements with the local power company
to furnish the electrical energy for the operation of thé traffic
signals. The Village agrees to pay this cost as billed by the local
power company and as indicated on the master agreement.
The State retains the right to control the sequence and timing of the
traffic signals."

PLAN APPROVAL
WHEREAS, in order to facilitate the improvement of Illinois Route 83
known as Illinois Route 83, State Section 3025N-87, the Village of Mount
Prospect hereby approves the plans and specifications for the proposed
construction.
