RE:
Use of Wells for Potable Water
The Village currently has regulations which forbid private parties from drilling new wells for
potable water. Those regulations grandfather the use of existing wells. However, if a private property
owner's well fails, that well must be abandoned and the user must connect to the Village system. Our
current regulations pem1it the Village to continue to operate its public wells and to dig new ones if we
deem it necessary to do so.
The Illinois EP A has published a model ordinance and has informed us that our regulations do
not conform to their model in the following two respects:
1.
Our ordinance would permit a user of a private ,veIl to dig a new well while the old one is
still operating and at such time as the old well fails, the owner could theoretically switch
to the new one and avoid connecting to the municipal system; and
2,
Our current regulations allow the Village to dig new wells without consulting the EP A as
to whether any contamination problems exist in the area of the new well.
This disparity has caused th~ EP A to place Mount Prospect into a category of municipalities
where private parties making improvements to land are held to a higher standard of remediation than
those which adhere to the IEP A model.

This issue has come to our attention because of the redevelopment taking place at Randhurst. I
have spoke at length with Glen and Sean with respect to this matter and we have created a new
ordinance that is based on the IEP A model. We believe that the proposed ordinance retains the
objectives of our current regulations and will not adversely affect the Village, but should clear up the
problems with the IEP A and allow the Randhurst redevelopers to receive the more favorable treatment
from the IEP A.
One note of caution. It is the desire of the IEP A that if the Village reserves to itself the right to
dig public usage wells in the future, \ve should immediately enter into an agreement with them to track
remediated sites within Mount Prospect. We'd rather not undertake the ongoing responsibility of
tracking those sites. Therefore, the ordinance has been written so that we don't have to do any tracking
unless we actually dig a new well. It is our hope that the IEP A will accept this version. If they don't,
we may be back with an amendment that requires that we keep a record of the remediated sites. The
Randhurst redeveloper's attorneys have requested that we act on this as expeditiously as possible.

ORDINANCE
AN ORDINANCE AMENDING SECTION 9.413 "USE OF \VELLS"
PROHIBITING THE USE OF GROUND'VATER AS A POTABLE WATER
SUPPLY BY THE INSTALLATION OR USE OF POTABLE 'VATER SUPPLY
WELLS OR BY ANY OTHER METHOD
'VHEREAS, certain properties in the Village of Mount Prospect, Illinois have
been used over a period of time for commercial/industrial purposes; and
'VHEREAS, because of said use, concentrations of certain chemical constituents
in the groundwater beneath the Village may exceed Class I groundwater quality standards
for potable resource groundwater as set forth in 35 Illinois Administrative Code 620 or
Tier 1 residential remediation objectives as set forth in 35 Illinois Administrative Code
742; and
WHEREAS, the Village desires to limit potential threats to human health from
groundwater contamination while facilitating the redevelopment and productive use of
properties that are the source of said chemical constituents;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND
BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK
COUNTY, ILLINOIS:
SECTION 1: Section 9.413, Use of Wells, shall be deleted in its entirety and a
new Section 9.413 entitled "Use Of Groundwater As A Potable Water Supply Prohibited"
shall be inserted in place thereof and shall be and read as follows:

Use of groundwater as a potable water supply prohibited.
A.
Definitions.
"Person" is any individual, partnership, co-partnership, firm,
company, limited liability company, corporation, association, joint

stock company, trust, political subdivision, or any other legal
entity, or their legal representatives, agents or assigns.
"Potable water" is any water used for human or domestic
consumption, including, but not limited to, water used for drinking,
bathing, swimming, washing dishes, or preparing foods.
B.
New Wells Prohibited.
The use or attempted use of groundwater as a potable water supply
by the installation or drilling of wells or by any other method is
prohibited. The foregoing shall not apply to uses or methods in
existence before May 21, 1985 or to any use of wells by the
Village of Mount Prospect. If an existing private well becomes
unusable or inoperable for any reason, the users of that well shall
immediately be required to connect to the Village water main.

Memorandum of Understanding.
Prior to the installation of a new public potable water supply by the
Village, the Village President shall enter into a Memorandum of
Understanding with the Illinois Environmental Protection Agency
("Illinois EP A") as required under Illinois Administrative Code
Title 35, Section 742.1015.. Pursuant to such Memorandum of
Understanding, the Village will assume responsibility for tracking
remediated sites, notifying the Illinois EP A of changes to this
ordinance, and taking certain precautions when selecting a location
for a public potable water supply well.
D.
Unimproved Property.
Any unimproved property within the Village shall, at the time it is
improved, be connected to a V illage water main in accordance
with Section 15.502D.
E.
Annexation Required.
Any parcel and/or building located outside the Village shall be
required to annex to the Village prior to connection onto the
Village water supply in accordance with Section 15.30Sc.
Penalties.
Any person found in violation of this Section shall be subject to a
fine as set forth in Section 9.103 of this Chapter.

SECTION 2: All ordinances or parts of ordinances in conflict with this
ordinance are hereby repealed insofar as they are in conflict with this ordinance.
SECTION 3: If any provision of this ordinance or its application to any person
or under any circumstances is adjudged invalid, such adjudication shall not affect the
validity of the ordinance as a whoJe or of any portion not adjudged invalid.
SECTION 4: Effective Date. This ordinance shall be in full force and effect
from and after its passage, approvaJ and publication as required by Jaw.

A RESOLUTION
REGARDING THE RELEASE OF CLOSED SESSION MINUTES
WHEREAS, the Mayor and Board of Trustees of the Village of Mount Prospect have,
from time to time, met in Closed Session for purposes authorized by the Illinois Open
Meetings Act; and
WHEREAS, as required by the Act, the Village Board has kept written minutes of all
such Closed Sessions; and
WHEREAS, pursuant to the requirements of Public Act 85-1355, the Mayor and
Board of Trustees have met in Closed Session to review the Minutes of all Closed
Sessions; and
WHEREAS, the Mayor and Board of Trustees have determined that a need for
confidentiality still exists as to the Closed Session Minutes for the meetings as set
forth on "Schedule A" attached hereto; and
WHEREAS, the Mayor and Board of Trustees have further determined that the
Minutes of Closed Sessions, as noted on "Schedule A" attached hereto, no longer
require confidential treatment and should be made available for public inspection.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY,
ILLINOIS:
SECTION ONE: That the Mayor and Board of Trustees of the Village of Mount
Prospect, do hereby authorize the release of the Closed Session Minutes as
indicated on "Schedule A" attached hereto.
SECTION TWO: That the Village Clerk is hereby authorized and directed to make
said Minutes available for inspection and copying in accordance with the standard
procedures of the Village Clerk's Office.

TRAIN STATION RETAIL TENANT
SUBJECT:
The Community Development Department has been actively pursuing a replacement tenant to provide
retail services at the train station since Java Express vacated the coffee shop space late last year.
Staff sent a Request for Proposals to numerous local and regional operators requesting that they
provide a scope of services to operate a retail facility at this location. Staff has reviewed the completed
proposals and met with potential tenants to discuss their operations. After thoroughly reviewing the
proposals, staff recommends the Village enter into a lease with JJAA T Enterprises to operate Tuccio's
Trackside at the train station.
Tuccio's Trackside would be run by the owners of Tuccio's Restaurant that is located at 106 W.
Northwest Highway in the Clock Tower Plaza. Tuccio's Restaurant has proven to be a great culinary
addition to the downtown and has been well received by the community. Tuccio's is proposing to
expand upon the traditional coffee shop services that have been offered in the train station for the past
few decades. They are proposing to offer warm and cold breakfast items and beverages as well as
pre-packaged lunches to go during the morning hours. Commuters will also have the opportunity to
pre-order dinner entrees that will be ready when they arrive back at the train station in the evening.
Commuters will be able to order from Tuccio's Restaurant's full menu that is available at their main
facility.
They also intend to modify the existing space by redecorating the interior, adding new equipment. and
installing new signage and lighting. Tuccio's Trackside would pay $600 a month rent and be
responsible for their pro-rated share of utilities and maintenance costs at the Metra station. The lease
provides for five-year extensions if mutually acceptable to both parties.
Please forward this memorandum and attachments to the Village Board for their review and
consideration at their February 1 th meeting. Staff and Tuccio's Restaurant representatives will be
present to answer any questions related to this matter.

Dear Bill:
Since opening in September 2003, Tuccio's Fresh Italian Kitchen has enjoyed a
wonderful response from the local community and the support continues to grow. Not
only is the community utilizing our dining room regularly, but our full service catering
services are in high demand. Our restaurant offers a wide selection of choices from
salads, sand\\>lches, pizza and family recipe pasta dishes. We are told that we are "the
buzz of the community". We are happy and proud to have participated in local events
such as the i\fid-Summer Downtown Block Party, hosting the Chamber of Commerce
After Hours event and entering into the Winter Holiday Parade. We are dedicated to
being a strong Mt. Prospect community member and look forward to participating in
more events throughout the coming year.
The available opportunity at the Mt. Prospect train station is of great interest to us.
Given the experience of operating a food service unit at Union Station through a previous
employer, we are confident that we can put our skills to work successfully in Mount.
Prospect. Tuccio's would offer a unique food service experience to the commuters. In
the morning we can send them off with a variety of warm or cold breakfast items and
beverages. Additionally, lunch items to go will be offered for their convenience. On the
return trip in the evening, we will offer the full Tuccio's restaurant menu through our
Trackside Delivery program. This program encourages commuters to call in their orders
before leaving their downtown offices. Upon arrival in Mount Prospect, we will have
their hot meal waiting at the station. Additionally, for those who may not have planned
ahead, we will offer some selections ITom the restaurant menu that can be purchased
directly ITom the train station facility such as salads, sandwiches and par-baked pizzas to
bake at home.
We look forward to continued gro\V1h within the business community and v.ith the people

Rent
$ 600.00 per month for the existing space.
A five -year lease with a five year option to renew.
6 month rent abatement to cover build-out time and expenses, additional
equipment purchases, grand opening promotions.
Existing equipment and fixture would stay in place.
Plans for Renovation:
The existing space would be modified to reflect the atmosphere of our
restaurant. The color scheme reflects a warm and inviting pallet. Commuters
would be offered a place to sit inside at counter along the East and South
walls or in the patio area outside.
Lighting would be enhanced to brighten the space and music would be offered
to encourage a relaxed atmosphere.
Counter would need to be replaced or reconfigured to accommodate a
Cappuccino and espresso machine.

Scope of Services:
For the morning commute a variety of hot and cold food items and beverages
(cappuccino and espresso) would be offered. Box lunches would be available
to go. Newspaper racks would be available for daily local and national paper
purchases. The evening operation would offer to-go items £Tom our restaurant
menu and pick up service will be offered for orders phoned into our main
restaurant before the train's arrival.
IV.
Hours of Operation:
Tuccio's Trackside will be open Monday through Friday in the mornings from
5:30am until 9:00am and will reopen in the afternoon at 4:00pm until 7:00pm.

Number of Employees:
The location will be staffed with two employees per shift with additional
support ITom the main restaurant as needed. Anthony Messina a retired
Mount Prospect resident has been identified as the lead employee for this
location.

A RESOLUTION AUTHORIZING EXECUTION OF A LEASE BETWEEN
THE VILLAGE OF MOUNT PROSPECT AND JJA T ENTERPRISES
(TUCCIO'S TRACKS IDE RESTAURANT)
WHEREAS, the Village of Mount Prospect leases the Union Pacific Train Station in Mount Prospect;
and
WHEREAS, the Village of Mount Prospect is desirous of entering into a five (5) year lease
agreement with JJAA T Enterprises (d/b/a Tuccio's Trackside) at the train station mentioned herein;
and.
WHEREAS, such agreement will provide retail commuter services in the train station that will benefit
the citizens of Mount Prospect; and
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES OF THE
VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the Mayor and Board of Trustees of the Village of Mount Prospect do hereby
authorize execution of a Lease Agreement between JJA T Enterprises and the Village of Mount
Prospect for the purpose of permitting a restaurant, Tuccio's Trackside, to be located within the

required right-of-way. The attached Plat of Dedication completes the required right-of-way dedication (resulting
in the required right-of-way width) for Busse Road in front of the Subject Property. The plat has been prepared
according to Village codes and approved by Staff.

A RESOLUTION APPROVING A PLAT OF DEDICATION
FOR PROPERTY LOCATED AT 115 SOUTH BUSSE ROAD
WHEREAS, the Petitioner, the Village of Mount Prospect, has requested approval of a Plat of
Dedication for property located at 115 South Busse Road; and
WHEREAS, the Plat of Dedication is required to establish public right-of-way for the purposes of
transportation and public utility facilities in compliance with the Mount Prospect Village Code.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEÈS OF THE
VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The dedication of right-of-way is hereby granted for the property at 115 South

The Applicant recently constructed new single-family residences at 303 & 305 Douglas A venue (the "Subject
Property"). The attached Plat of Easement provides the Village of Mount Prospect access to the emergency shut-
off for the water service valves (B-box). Typically, water service valves are located in the public right-of-way
and an easement to access the emergency shut-off is not required. In this case, the Subject Property has a
substandard right-of-way width and the B-boxes were located on private property.

RESOLUTION NO.
A RESOLUTION APPROVING A PLAT OF EASEMENT FOR PROPERTY
AT 303 AND 305 DOUGLAS AVENUE
WHEREAS, the Village of Mount Prospect must have access to all water service valves within the
Village; and
WHEREAS, the water service valves at 303 Douglas and 305 Douglas Avenue are located on private
property outside of the public right-of-way; and
WHEREAS, in order to access the water service valves on private property, the Village must obtain an
easement.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES OF THE
VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The Board of Trustees of the Village of Mount Prospect do hereby authorize the
Mayor to sign and the Clerk to attest his signature on the Plat of Easement for 303 Douglas Avenue
and 305 Douglas A venue, a copy 0 f which is attached hereto and hereby made a part hereof a s
