A RESOLUTION AUTHORIZING EXECUTION OF AN ADDENDUM
TO AN AGREEMENT BETWEEN THE VILLAGE OF MOUNT PROSPECT,
THE CITY OF DES PLAINES, AND THE STATE OF ILLINOIS
FOR THE IMPROVEMENT OF CENTRAL ROAD BETWEEN
RAND AND WOLF ROADS ORIGINALLY ADOPTED BY
RESOLUTION NO. 1-88
WHEREAS, the corporate authorities of the Village of Mount Prospect
did determine that it would be in the best interests of the Village
to participate with the State of Illinois and the City of Des
Plaines in the improvement of Central Road between Rand and Wolf
Roads through passage and approval of Resolution No. 1-88; and
WHEREAS, it has been further determined that it would be in the
best interest of all concerned to execute the Addendum to the
Agreement being the subject of Resolution No. 1-88.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the Mayor is hereby authorized to sign and the
Clerk is authorized directed to attest her signature on the
Addendum to the Agreement between the Village of Mount Prospect and
the Illinois Department of Transportation, being the subject of
Resolution No. 1-88.
SECTION TWO: That this Resolution shall be in full force and
effect from and after its passage and approval in the manner
provided by law.

above referenced highway.

To provide for all utility adjustments, and to regulate the use of the
right-of-way of this improvement by utilities, public and private, in
accordance with the current Utility Accommodation Policy For Local
Agency Highway and Street systems.

improvement and engineering supervision during construction of the
proposed improvement, including acceptance sampling and testing of the

materials in accordance with the specificationsg Project Procedurec..
Guide and methods prescribed by the STATE;

entire completed improvement on central Road between Rand Road ,cud Wolf

Road after the completion of the 'improvement in a manner satisfactory to
the STATE and the FHWA.
(3) To pass an ordinance Providing for the transfer from the State Highway
System to the LAI s Municipal Street System of entral Road (FAU 1300)
between Rand Road and Wolf Road* A location snap showing this location
and a copy of said ordinance are attached hereto as "Exhibit All and
"Exhibit VIP respectively.
(4) To pay 100% of the energy costs for the lighting within the limits of

luminaries, cables, conduits, junction boxes, splicing kits, lamps,

(2) To reimburse MOUNT PROSPECT AND DESPLAINF25 for the Federal share of
construction engineering on the basis of periodic billings, provided
each bill includes evidence of payment by MOUNT PROSPECT AND

That this agreement shall be null and void in the event that the HWA does
not approve the proposed 'improvement for Federal -Aid Participation and in
the event the contract covering the construction work contemplated herein

is not awarded within three years of the date of execution of this

(2) That the authority to make changes in the State Highway System is granted
the STATE by Section 2-101 of the Illinois Highway Code, and the authority
to make changes in the Municipal Street System is granted the LA by
Section 7-101 of the Illinois Highway Code.
(3) That the jurisdictional transfer hereinbefore described shall take place
upon completion of the physical t,-,:-onstructlion of this improvement and final
inspection therof by the STATE."t

It is the polieCY Of the U.S. Department of Transportation that minority

color, national origin, or sex in the selection and retention of
contractor or subcontractor, including procurement of materials and leases

AN ADDENDUM TO THE JOINT VILLAGE -CITY -STATE AGREEMENT
FOR PROJECT M-6003(149) IN THE
VILLAGE OF MOUNT PROSPECT AND l-.'.'*ITY OF DESPLAINES,

2, THE VILLAGE OF MOUNT PROSPE"W'T AND CITY OF DEESPLAINES AqKfij
(1) To provide for all utility adjustments, and to regulate the use of the
right-of-way of this improvement by utilities, public and private, in
accordance with the current Utility Accommodation Policy For Local
Agency Highway and Street Systems,
(2) To comply with all applicabln.. 'E'xecutive Orders and Federal Highways
Acts pursuant to the Equal Employment Opportunity and
Non-discrimination Regulations required by the U.S. Department of
Transportation.
(3) To preserve and produce upon request of responsible STATE or FHWA
officials all records for this project lr'""or the purpose of an audit for
a period of three years of the FHWA payment of the final voucher.
(4) The failure of MOUNT PROSPECT AND DESPLAINES to comply with Federal
requirements may result in the loss (partial or total) of Federal
participation as determined by the FHWA.
(5) That upon receipt of the ["ontractor's first and subsequent progressive
bills for this improvement they will pay to the State, an amount equa-IL
to each of their shares of the construction cost, divided by the
estimated total cost, multiplied by the actual progress payment
(appropriatc-31y adjusted for non -participating costs) made to the
contractor until the entire obligation incurred under this agreement
has been paid,

To provide for surveys and the preparation of plans for the proposed
improvement and engineering supervision during construction of the
proposed improvement, including acceptance sampling and testing of the
materials in accordance with the specificat*ons, Project Procedures
Guide and methods prescribed by the STATE;
(2) To accept Jurisdiction and to maintain or cause to be maintained the
entire completed improvement on Central Road between Rand Road AogWolf
Road after the completion of the improvement in a manner satisfactory to
the STATE and the FHWA.
(3) To pass an ordinance prbvib ing for the transfer from the State Highway
System to the LA's Municipal Street System of Central Road (FAU 1300)
between Rand Road and Wolf Road. A location reap showing this location
and a copy of said ordinance are attached hereto as "Exhibit A" and
"Exhibit B11, respectively.
(4) To pay 100% of the energy ccsts for the lighting within the limits of

customarily tested by the State, and to provide contract construction

(2) To reimburse MOUNT PROSPECT AND DESPLAINES for the Federal share of
construction engineering on the basis of periodic billings, provided
each bill includes evidence of payment by MOUNT PROSPECT AND
DIF-SPLAINES ,
IT IS MUTUALLY AGREED:
That this agreement shall be null and void in the event that the rFHWA does
not approve the proposed improvement for Federal -Aid Participation and in
the event the contract covering the construction work contemplated herein
is not awarded within three years of the date of execution of this
(2) That the authority to make changes in the State Highway System is granted
the STATE by Section 2-101 of the Illinois Highway Code, and the authority
to make changes in the Municipal Street System is granted the LA by
Section 7-101 of the Illinois Highway Code.
(3) That the jurisdictional transfer hereinbefore described shall take place
upon completion of the physical construction of this improvement and final
inspection therof by the STATE.
(4) This agreement shall be binding upon the parties, their succe.qscrs and
assigns .
(5) It is the policy of the U.S. Department of Transportation that minority
business enterprises, as defined in 49 CFR Part 23, shall have the maximum
opportunity to participate in the performance of contracts financed in
whole or in part with Federal funds under this agreement. Consequently,
the MBE requirements of 49 CFR Part 23 apply to this agreement,
The STATE, MOUNT PROSPECT AND DESPLAINES agree to ensure that minority
business enterprises, as defined in 49 CFR Part 23, have the maximum
opportunity to participate in the performance of this agreement, In this

and resonable steps, in accordance with 49 CFR Part 23, to ensure that

"Policy" in every contract, including procurement of materi als and leases
of equipment. Failure to carry out the requirements set f orth above shal
constitute a breach of this agreement and may result in termi nat 'ion of th
agreement or such remedy as deemed appropriate.

WHEREAS, the State of Illinois, acting by and through its
Department of Transportation . is desirous of improving Central Road
between Rand Road and Wolf Road; and
WHEREAS, the improvement of Central Road between Rand Road and Wolf
Road 'i's a co-operative project between the State of Illinois, City
of Des Plaines and the Village of Mount Prospect; and
WHEREAS, said project is being undertaken to facilitate the free
flow of traffic and ensure the safety of the motoring public; and
WHEREAS, in conjunction with the improvement of that portion of
Central Road, as specified,, the Village of Mount Prospect has
agreed to accept jurisdiction of said right-of-ways
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECTr COOK COUNTY, ILLINOIS:
