AN ORDINANCE &~NDING ORDIANCE NO. 2625
WHEREAS, by Ordinance No. 2625, passed and approved
n May 4, 1976, the President and Board of Trustees of the
illage of Mount Prospect authorized the issuance of a special
se permit subject to specified conditions for a parcel of
roperty which is legally described as follows:
Lots One (1), Two (2), Three(3), Four (4),
Five (5), and Six (6) in Block Twenty-One
(21) in Prospect Manor, being a Subdivision
of part of the South Three Quarters (3/4)
of the West Half (1/2) of the West Half
(1/2) of Section 34, Township 42 North, Range
11, East of the Third Principal Meridian, in
Cook County, Illinois.
hereinfater referred to as the "Subject Property"); and
WHEREAS, Section One A of said Ordiance No. 2625
ets forth
the condition on th~ special permit that a

6) foot stockade fence be constructed on the Subject Property
n the location specified in said Section One A; and
WHEREAS, residents of the Village of Mount Prospect
ave requested that a portion of said fence located on the
ubject Property be removed to improve traffic visibility; and-
WHEREAS, pursuant to proper public notice puþlished
In the Mount Prospect Herald on July 10 , 1979, a public
ea~ing was held before the Zoning Board of Appeals of the
illage of Mount Prospect on July 26, 1979, in ZBA-38~SU-79,
t the request of the Village of Mount Prospect to consider
hether Section One A of Ordinance No. 2625 should be amended
0 permit the removal of a portion of the fence located on
he Subject Property; and
WHEREAS, the Zoning Board of Appeals has recommended
0 the President and Board of Trustees of the Village of Hount
rospect that Section One A of Ordinance No. 2625 be amended

to permit the removal of a portion of the fence located on
the Subject Property and to require that a six (6) foot
stockade fence continue to be iocated in the location shown
on Exhibit A which is attached hereto and incorporated
herein by this reference; and
WHEREAS, the President and Board of Trustees of
the Village of Mount Prospect have determined that it would be
in the best interests of the residents of the Village of Mount
Prospect for Section One A of Ordinance No. 2625 be amended to
permit the removal of a portion of the existing fence located
on the Subject Property.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT
AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK
COUNTY, ILLINOIS AS FOLLOWS:
Section One:
Seétion One A of Ordinance 2625 passed
and approved by the President and Board of Trustees of the
Village of Mount Prospect on May 4, 1976, be, and the same is
hereby, amended by deleting the language.
" and further, the owner shall replace the
existing fence along Henry Street with a six
foot (6')high stockade fence to run from a
point eight feet (8') east of the east line
of Forest Avenue to a point sixteen feet (16')
west of the west line of Fairview Avenue upon
the subject property along and adjacent to the
south line of Henry Street; "
and inserting the following language in its place, "and further
owner shall maintain a
six
(6) foot stockade fence upon the
Subject Property along and adjacent to Henry Street in the
location shown on Exhibit A attached hereto and incorporated
herein by this reference," and deleting the word "hereof" as
it appears in the second line of said Section One A and
substituting therefore the language "of Ordinance No. 2625,"
0 that said Section One A of said Ordinance No. 2625 shall
ereafter be and read as follows:

Section One A:
The existing gas station structure located upon
the Subject Property on the ~ate of ordinance No. 2625 shall
be razed and demolished by the owner; and further, owner
shall maintain a six
(6) foot stockade fence upon the
Subject Property along and adjacent to Henry Street in the
location shown on Exhibit A attached hereto and incorporated
herein by this reference.
Section Two:
This Ordinance shall be in full
force and effect from and after its passage, approval and
publication in the manner provided by law.
