ORDINANCE NO. 6084 AN ORDINANCE GRANTING A VARIATION (REAR YARD SETBACK) FOR PROPERTY LOCATED AT 100 NORTH PINE STREET, MOUNT PROSPECT, ILLINOIS WHEREAS, Randy Murphy (Petitioner), has filed a petition for a Variation to allow an eight -foot (8') rear yard setback for a patio for property located at 100 North Pine Street (Property) and legally described as: Lot 10 in Block 11 in Hillcrest, being a Subdivision of the Northeast % of the Southwest' /4 (except the North 2 -7 -7 -8 Acres thereof) of Section 34, Township 42 North Range 11, East of The Third Principal Meridian, and the North 23.5 Acres of the Southeast % of the Southwest % (except the West 295.1 feet of the South 295.1 feet lying North of the South 543 feet of the East' /2 of the Southwest % of said Section 34) in Cook County, Illinois; Third Principal Meridian, in Cook County, Illinois. Property Index Number 03 -34- 321 - 017 -0000; and WHEREAS, the "Petitioner" seeks a Variation to decrease the required rear yard setback from fifteen feet (15') to eight feet (8') to allow for a patio along the west rear property line as shown on the Petitioner's exhibit attached as Exhibit "A "; and WHEREAS, a Public Hearing was held on the request for a Variation being the subject of PZ -10 -13 before the Planning and Zoning Commission of the Village of Mount Prospect on the 25 day of July, 2013, pursuant to proper legal notice having been published in the Mount Prospect Journal & Topics on the 10 day of July, 2013; and WHEREAS, the Planning and Zoning Commission has submitted its findings and recommendations to the President and Board of Trustees in support of the request being the subject of PZ- 07 -13; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have given consideration to the request herein and have determined that the request meets the standards of the Village and that the granting of the Variation to reduce the side yard setback from fifteen feet (15') to eight feet (8') to allow for the patio along the west rear yard property line would be in the best interest of the Village. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS ACTING IN THE EXERCISE OF THEIR HOME RULE POWERS: SECTION ONE The recitals set forth hereinabove are incorporated as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect do hereby grant approval of a Variation to reduce the rear yard setback from fifteen feet (15') to eight feet (8') to allow an eight foot (8') rear side yard setback for a patio along the west lot line for the property located at 100 North Pine Street subject to the following conditions: 1) The patio may not extend south of the primary structure's southern foundation lines. 2) The patio may not extend west past the garage's eastern foundation line. SECTION FOUR This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
