HomeMy WebLinkAboutOrd 2973 01/02/1980 2/6/79 ORDINANCE NO. 2973 AN ORDINANCE GRANTING SPECIFIED VARIATIONS FOR PROPERTY AT 1507 WEST PALM DRIVE WHEREAS, Jerzy and Joanna Gacek (who shall be referred to collec- tively as "Petitioners"), are the owners of a parcel of property located at 1507 West Palm Drive in the Village of Mount Prospect, County of Cook, State of Illinois (hereinafter referred to as the "Subject Property"); and WHEREAS, the Subject Property is legally described as follows: Lot 1 in Block 5 in Elk Ridge Villa Unit No. 1, being a subdivision in the West 1/2 of the West 1/2 of Section 14, Township 41 North, Range 11 East o~'the Third Principal Meridian, in Cook County, Illinois; WHEREAS, the Subject Property is located in the R-1 Single Family Residence District under the provisions of the zoning Ordinance oK the Village of Mount Prospect (hereinafter referred to as the "zoning Ordinance"); and WHEREAS, Petitioners have heretofore filed an application seeking a variation from the provisions of Section 21.1101C of Chapter 21 of the Municipal Code of the Village of Mount Prospect (the "Buil( ing Code") to permit the construction of a swimming pool in the side yard of the Subject Property; and WHEREAS, a public hearing was held on the Petitioners' request fo~ the aforesaid variations, which request is known as ZBA-57-V-79, before the Zoning Board of Appeals of the Village of Mount Prospe¢ on October 25, 1979, pursuant to proper public notice published the Mount Prospect Herald on October 9, 1979; and WHEREAS, the Zoning Board of Appeals has recommended to the Build- ing Committee of the Board of Trustees of the Village of Mount Prospect that Petitioners' request for the aforesaid variation, ZBA-57-V-79, be granted; and WHEREAS, the President and Board of Trustees have considered the Petitioners' request and reviewed the recommendation of the Vil- llage of Mount Prospect zoning Board of Appeals in ZBA-57-V-79; an( WHEREAS, the President and Board of Trustees of the Village of ~ount Prospect have determined that with respect to the Peti- tioners' requested variation, that Petitioners have satisfied the standards for the grant of variations set forth in Section 14.605 Df Article VI of the zoning ordinance and find that it would be the best interest of the Village of Mount Prospect to grant P~ti- tioner the requested variation. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, Cook County, Illinois as follows: 2 - SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of' Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of ~the Village of Mount Prospect hereby grant Petitioners a variation from the provisions of Section 21.1101C of Chapter 21 of the Municipal Cod of the Village of Mount Prospect (the "Building Code"), to permit the construction of a swimming pool in the side yard of the follo% ing described property: Lot 1 in Block 5 in Elk'Ridge Villa Unit NO. 1, being a subdivision in the West 1/2 of the West 1/2 of Section 14, Township 41 North, Range 11 East of' the Third Principal ~ Meridian, in Cook County, I%linois . (heretofore and hereinafter referred to'as the "Subject Property"] in the location shown on Exhibit A attached hereto and incorporat~ herein by this reference. SECTION THREE: Except for the variations granted herein, all oth~ applicable Village of Mount Prospect ordinances shall remain in full force and effect as to the Subject Property. SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval, and publication in the mann~ provided by law.
