AN ORDINANCE AMENDING CRYSTAL
TOWERS PLANNED DEVELOPMENT
HEREAS, Petitioner, Clifford Josefik (hereinafter referred to as
Petitioner"), is the developer of a planned unit development with-
n the Village of Mount Prospect which is commonly called "Crystal
'owers" and which located at 1717, 1727, 1747 and 1777 Crystal
.ane in the Village of Mount Prospect (hereinafter referred to as
~he "Subject Property"); and
'HEREAS, Petitioner has sold a portion of the Subject Property as
ondominiums and owns a portion of the Subject Property which
'etitioner is developing; and
~EREAS, the Subject Property is legally described as follows:
"Parcel "A", Lot "A" in Tally Ho Apartments, a subdivision
part of the North East Quarter of the North East Quarter of
Section 22, Township 41 North, Range !!, East of the Third
Principal Meridian, in Cook County, Illinois
also
Parcel "B" Out Lot "B" of Tally Ho Apartments, a subdivision
of Part of the North East Quarter of the North East Quarter
of Section 22, Township 41 North, Range 11, East of the Third
Principal Meridian, in Cook County, Illinois;

HEREAS, planned development approval for the Subject Property was
ranted by Ordinance No. 2346 passed and approved by the President
nd Board of Trustees of the Village of Mount Prospect on April 4,
972; and
HEREAS, Ordinance No. 2346 required the develoPment of the Subjecl
roperty in accordance with a site plan attached to said Ordinance
nd also provided for the provision of specified amenities in con-
ection with such development; and
HEREAS, Petitioner has requested the following amendments to the
lanned development previously approved by the Village:
1. To amend the configuration of the retention pond pre-
viously Proposed;
2. To seek approval for the configuration of the retention
pond as built on the Subject Property;

To amend the location of specified outdoor parking spaces
To seek approval for the location and number of outdoor
parking spaces existing and proposed;
TO eliminate the deceleration lane previously proposed to
be.constrUcted at or near the Busse Road entrance to the
Subject Property;
. To amend the location of specified portions of the fire
lanes for the Subject Property;
7. To seek approval for the location of the fire lanes con-
structed on the Subject Property.
WHEREAS, a public hearing on Petitioner's requested amendments,
ZBA 70-A-79, was held before the Village of Mount Prospect Zoning
Board of Appeals on November 15, 1979 pursuant to public notice
duly published in the Mount Prospect Herald on October 31, 1979;
and
WHEREAS, Petitioner has represented to the Village that the
Illinois Department of Transportation refused to approve the
deceleration lane previously proposed to be constructed at the
Busse Road entrance to the Subject Property; and
WHEREAS, the President and Board of Trustees of the Village of
Mount Prospect have reviewed the aforesaid amendments requested
Petitioner and the recommendations of the Zoning Board of Appeals;
and
WHEREAS, the President and Board of Trustees of the Village have
determined that it is in the best interest of the Village to
approve the aforesaid amendments requested by Petitioner subject
the conditions that the owners of condominium units located on th~
Subject Property agree to such amendments.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS
AS FOLLOWS:
SECTION ONE: Subject to the conditions set forth hereinafter in
Section Two, Ordinance No. 2346 of the Village of Mount
Prospect be, and the same is hereby, amended to allow Peti-
tioner to construct a retention pond, off-street parking spaces
and fire lanes in the locations shown on the site plan attached
hereto as Exhibit A and incorporated herein by this reference on
a parcel of real estate legally described as follows:
"Parcel "A", Lot' "A" in Tally Ho Apartments, a subdivision
part of the North East Quarter of the North East Quarter of
Section 22, Township 41 North, Range il, East of the Third
Prin.cipal Meridian, in Cook County, Illinois
also
Parcel "B" Out Lot "B" of Tally Ho Apartments, a
of Part of the North East Quarter of the North East Quarte~
of Section 22, Township 41 North, Range 11, East of the
Third Principal Meridian, in Cook County, Illinois;
(hereinafter referred to as the "Subject Property") and to per-
mit Petitioner to eliminate the'deceleration lane previously
proposed to be constructed at or near the Busse Road entrance
to the Subject Property.
ECTION TWO: The amendments to ordinance No. 2346 approved
Section One of this Ordinance are approved
;ECTION THREE: The provisions of this Ordinance are not in-
~ended to abrogate, annul or otherwise interfere with any
~ovenant or other private agreement or legal relationship.
~ECTION FOUR: This Ordinance shall be in full force and effect
!rom and after its passage, approval and publication in the
~anner provided by law and the Village's receipt of the Reso-
ution as provided in Section Two hereinabove.
