ORDINANCE NO. 2985
AN ORDINANCE GRANTING SPECIFIED VARIATIONS
FOR PROPERTY AT 611 NOAH TERRACE
WHEREAS, Loras, Inc. (who shall be referred to as "Petitioner")
is the owner of a parcel of property located at 611 Noah Terrsce
in the Village of Mount Prospect, County of Cook, State of
Illinois (hereinafter referred to as the "Subject Property");
and
WHEREAS, the Subject Property is legally described as. follows:
Lot 61 in St. Cecilia Subdivision, being a Resubdivision
of Lot 2 and part of Lots 3 and 6 in Meier Brothers Sub-
division, being a Subdivision of parts of Sections 10 and
15, Township 41 North. Range 11, East of the Third Princi-
pal Meridian, in Cook County, Illinois, according to the
plat thereof registered in the Office of the Registrar of
Titles of Cook County, ~llinois, on December 26, 1978, as
Document Number 3067889:
WHEREAS, the Subject Property is located in the R-1 Single
Family Residence District u~]der the provisions of the Zoning
Ordinance of the Village of Mount Prospect (hereinafter referred
to as the "Zoning Ordinance"); and
WHEREAS, Petitioner has heretofore filed an application seeking
the following variations from the provisions of the Zoning Ordi-
nance:
A variation from'Section 14.1102D2 of Article XI of
the Zoning Ordinance to permit the exterior portion of
a fireplace shown cn Exhibit A attached hereto and
incorporated herein by this reference, on the south
side of the single family dwelling located on the Sub-
ject Property to p~otrude an additional 1.44 feet into
the required side yard so that the distance between the
side lot line and the exterior of sa~d fireplace shall
be 3.79 feet.
A .14 foot variation from Section 14.1102B2 of the
zoning Ordinance to permit a side yard of 6.58 feet on
the south side of the single family dwelling located on
the Subject Property along the entire length of the
exterior soqth wall of such single family dwelling exce~
that portion of such south Wall where the fireplace shot
on Exhibit A hereto is located.
WHEREAS, a public hearing ;.~as held on the Petitioner's request fc
the aforesaid variations, ~..'hich request is known as ZBA-7t-V-79,
before the Zoning Board of Appeals of the Village of Mount
Prospect on December 27, 1979, pursuant to proper public notice
published in the Mount Prospect Herald on December 12, 1979; and
WHEREAS, the zoning Board Of Appeals has reco~nended to the Buil~
ing Committee of the Board of Trustees of the Village of Mount
Prospect that Petitioner's request.for the aforesaid variations,
ZBA-71'V-79, be granted; a~d
HEREAS, the President and Board of Trustees have considered the
Petitioner's request and reviewed the recommendation of the Vil-
lage of Mount Prospect zOning Board of Appeals in ZBA-71-V-79; an
~HEREAS, the President and Board of Trustees of the Village of
Mount Prospect have determined that with respect to the Peti-
tioner's requested variations, that Petitioner has satisfied the
standards for the grant of variations set forth in Section 14.605
of Article VI of the Zoning Ordinance and find that it would be
in the best interest of the Village of Mount Prospect to grant
Petitioner the requested variations.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS
as follows:
SECTION ONE: The recitals set forth hereinabove are incorporated
herein as findings of fact by the President and Board of Trustees
of the Village of MoUnt Prospect.
SECTION TWO: The President and Board of Trustees of the Village
iof Mount Prospect hereby grant the following variations:
A variation from Section 14.1102D2 of Article XI of
the Zoning Ordinance to permit the exterior portion of
a fireplace shown on Exhibit A attached hereto and
incorporated herein by this reference, on the south
side of the single family dwelling located on the Sub-
ject Property to protrude an additional 1.44 feet into
the required side yard so that the distance between the
side lot line and the exterior of said fireplace shall
be 3.79 feet.
A .14 foot variation from Section 14.1102B2 of the
zoning Ordinance tc permit a side yard of 6.58 feet on
the south side of the single family dwelling located on
the Subject Properts~ along the entire length of the
exterior south wall of such single family dwelling
except that portion of such south wall where the fire-
place shown on Exhibit A hereto is located.

SECTION THREE: Except for ~he variations granted herein, all
other applicable Village of [~ount Prospect ordinances shall
remain in full forCe and effect as to the Subject Property.
ECTION FOUR: This Ordina~ce shall be in full force and effect
from and after its passagef approval, and publication in the man-
ner provided by law.
