The Plat of Easement was a condition of approval for the Aetna development project that will consist of two commercial buildings on the subject property. The Plat of Easement dedicates an easement to the Village of Mount Prospect for water main purposes. Staff has reviewed the plat and found it to be prepared according to all Village codes and requirements. Wagner Date: April 30, 2013 Re: Ordinance amending Article XVII, Alarm Systems, of Chapter 23 ______________________________________________________________________ The attached ordinance amends Article XVII, Alarm Systems. The more significant revisions include the following: 1. The definition of fire alarm system in Section 23.1701 is revised to exclude fire alarms, which are regulated in the Fire Prevention Code. 2. Sections 23.1702, 23.1703, and 23.1705 clarify that the Village or finance department, not the police department, regulate licensing. 3. Section 23.1703 clarifies the information necessary for applications. 4. Section 23.1706, which required the display of an alarm system license, is deleted. 5. Section 23.1714(D) is amended to allow regular mail delivery, instead of certified mail. 6. Section 23.1716(E) is amended to clarify that a suspension or revocation is stayed during the period for which judicial review may be sought. 7. The licensing fees are now $10 annually and $20 if purchased after February 1. Those fees have been revised to $25 and $40, respectively, effective January 1, 2014. Hill, Jr. 302390_1 ORDINANCE NO. _____ AN ORDINANCE AMENDING CHAPTER 23 OF THE VILLAGE CODE OF THE VILLAGE OF MOUNT PROSPECT, ILLINOIS, REGARDING ALARM SYSTEMS BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, ACTING IN THE EXERCISE OF ITS HOME RULE POWERS: SECTION 1: Article XVII, Alarm Systems, of Chapter 23 of the Mount Prospect Village Code shall be amended as follows: 1706: renumbered numerically. B. entirety and the following inserted in its place: ALARM SYSTEM: Any security device installed for the purpose of alerting others to any unauthorized entry on the premises or the commission of an unlawful act. Such a device does not include an alarm system to the extent regulated in the Fire Prevention Code, Chapter 24 of this Code. C 23.1702: LICENSE REQUIRED: It shall be unlawful for any person, firm or corporation to install or maintain an alarm system designed or intended to be used to signal an unauthorized entry on the premises, the commission of an unlawful act or any other emergency at the premises where such alarm system is located without first having obtained a license therefor from the Village. D. the following: 23.1703: APPLICATION FOR LICENSE: A. The application for license, as required herein, or renewal thereof shall be filed with the Village finance department, and shall be accompanied by the license fee, as set forth in section 23.1704 of this article: B. The application for license and renewal of license shall be made on forms provided by the Village finance department and shall contain the following information: 3 14-2-+¦3 1. Name and address of the applicant. 2. The name and address of the premises where the alarm system is located. 3. The names, addresses and telephone numbers of at least one (1) and up to three (3) persons responsible for the premises where the alarm system is located and who should be contacted to deactivate the alarm system. E. Section 23. 1L replacing the phrase 23.1705: ISSUANCE OF ALARM SYSTEM LICENSE AND INSPECTION: The Village shall issue a license for an alarm system, except for an unauthorized automatic telephone alarm, within fifteen (15) days after a completed application for license accompanied by the annual license fee, is filed. Prior to the issuance of such alarm system license, the Village may inspect or cause to be inspected the alarm system for which a license has been requested. Section 23.1712, renumbered 23.1711, Automatic amended by ntence and in the second sentence, to be and read as follows: 23.1712: AUTOMATIC TELEPHONE ALARM PROHIBITED: No person, firm or corporation shall install or cause to be installed, or maintain any automatic telephone alarm in the Village. Such automatic telephone alarms shall be considered a nuisance and are prohibited. Nothing in this section shall apply to automatic telephone alarms for handicapped persons authorized by the chief of police of the Village, or his/her designee. H. Subsection D of Section 23.1714, renumbered 23.1713, D. Within five (5) days after the chief of police receives a request for reconsideration from the licensee, the chief of police, or his/her designee, shall determine whether or not the alarm was false and shall notify the licensee of his/her decision in writing by personal delivery or U.S. regular mail. I. deleted in its entirety and replaced with the following: E. Revocation or suspension of an alarm system shall not be effective during the pendency of an appeal before the President and Board of Trustees of the Village and the period for which judicial review may be sought. SECTION 2:: Chapter 23, Offenses and Miscellaneous Regulations, ofAppendix A, Division IIFees, Rates and Taxes, of the Village Code shall be amended as follows: Ë 2 14-2-+¦3 A. Delete the license fee and late fee for Section 23.1704: license Fee (Alarm Systems), and replace with the following: Section 23.1704: License Fee (Alarm Systems) Annual License Fee: $10 ($25.00 effective January 1, 2014) License Fee (renewal) after February 1: $20.00 ($40.00 effective January 1, 2014) B. JANONIS FROM: DEPUTY DIRECTOR OF PUBLIC WORKS DATE: APRIL 30, 2013 SUBJECT: SURPLUS PUBLIC WORKS' PROPERTY TO BE SOLD In the last year the Village has accumulated surplus personal property that is no longer used or needed. The surplus property includes furniture that was replaced during the Police Investigations Division office remodel, vehicles and equipment that have been replaced with new purchases, scrap metal, and mobile phone supplies that became obsolete when the Village switched mobile phone carriers. Attached is a detailed list of the items to be declared surplus (Exhibit A). Also attached is an ordinance that authorizes the staff to sell these surplus items. Staff proposes to sell the surplus items utilizing a variety of methods. The scrap metal will be taken to Lake County Scrap, which is currently offering the best individual unit pricing. The furniture from Police Investigations Division, forestry equipment, and mobile phone accessories will be sold at the Public Works' Open House Garage Sale. The department has experienced great success selling similar items at previous open houses. Items that fail to sell at the open house will be auctioned using the Internet based auction site GovDeals.com. In addition, the Village has a number of vehicles to be sold, which will also be auctioned using GovDeals.com. The Village has used GovDeals extensively over the past two years selling 28 items for $84,463. Our sale prices have resulted in a 10 -20% premium over recent live auction sales history. The auction site can utilized at any time and allows the Village a cost effective alternative to sell items nationwide. The total administrative fee for utilizing this service is 7.5% of the final sales price, with the buyer paying the service fee. With your concurrence, I would like to present this ordinance to the Mayor and Board of Trustees for their consideration at the May 7, 2013 Village Board Meeting. I concur.
