Cond~bonal Use and Var~ahons to allow the construchon of 820 E RAND a fast food restaurant w~th a drive-through fac~hty ROAD TACO BELL/KFC Wdham Cooney explained that the Zomng Board of Appeals prewously approved th~s ~ '; ' request in October, 1999, s~nce that hme the s~te plan was revised to ~ncrease the number of drive-through stacking spaces from 7 to 13 He stated that the pebtloner and owners of nearby properties, have worked together to dewse an acceptable cross-access plan for the subject property and Thunderbird Lanes and Menards properties The ,~ ~ , Vanabons would allow the petitioner, Marion Klatka, appealed to the Wllage Board for approval of the LANE construction of a 720 square foot, three-car detached garage, and to ~ncrease the maximum permitted s~ze for his garage The Zoning Board of Appeals prewously demed the request by a vote of 4-1, pnmardy because the petitioner faded to prowde ewdence of a hardship Mr Klatka presented photographs of ne~ghbonng properties that have larger garages, and made reference to a garage at 716 N Prospect Manor, which was approved for 720 feet Board members and Mr Klatka d~scussed opbons for a smalier garage, possibly 660 sq ft, which the pebboner ~nd~cated was acceptable to h~m Following a lengthy discussion, Trustee W~lks, seconded by Trustee Skowron, moved to concur w~th the recommendation of the Zomng Board to deny the pebboner's request for a Conditional Use and Variation, and to retain jurisdiction of th~s case, allowing staff to work w~th the per,boner for an alternate solution to h~s request, and present such garages presented by Mr Klatka, asked h~m to prowde addresses for those homes at the next meebng Trustee Hoefert asked the Board to consider the formabon of an ad hoc committee to rewew cases of this nature s~nce requests for larger garages are being presented more frequently than ~n past years Trustee Skowron also asked Mr Cooney to rewew, and report to the Board, the number of outsize garage requests and permits granted for the last five years Th~s case wdl be presented for further rewew at the March 7 meeting ZBA 36-99 ZBA 36-99, 1108 S Robert Drive 1108 S The petitioner, Mr Stanley Weglarz, presented an appeal to Vdlage Board to allow a ROBERT DRIVE Vanat~on for a second story add~bon and front porch to encroach four feet (4') into the required front setback The Zoning Board of Appeals prewously demed the request by a vote of 5-0. w~th that Board's dec,sion being final Mr. Weglarz explained that h~s famdy needs the extra hwng space because of the s~ze of the famdy, and the proposed bedroom that ~s creating the encroachment problem wdl be too small for comfortable hwng He and Mrs Weglarz further explained that budding more to the back of the house ~s not an option Page 3 -February 15, 2000 Trustee Skowron and other Board members explained that their reluctance to grant ~ ~ , approval of this request was based primarily on the fact that by allowing the add,ben to encroach four feet (4') ~nto the front setback, the precedence would be set for future requests of th~s nature Follow~ng a lengthy d~scuss~on, Trustee Skowron, seconded by Trustee Wdks, moved to results for the dehvery and ~nstallat~on of shade trees on V~llage parkways (Itemized bid results are attached,~ BID RESULTS Sandy Clark, Forestry/Grounds Superintendent explained that staff usually prefers a SHADE TREES combined bid whtch covers the furnishing, dehvery and mstallabon of trees, however FURNISHING because of a current tree shortage, ~t was dec~ded that they would accept both the purchase of 40 self-contained breathing apparatus umts, ~n an amount not to exceed $68,000 Trustee Hoefert, seconded by Trustee Skowron, moved to concur w~th the recommendation of staff to award a
