(Seal) ORDINANCE NO. 6056 AN ORDINANCE AMENDING ORDINANCE NO. 5481, GRANTING VARIATIONS AND A CONDITIONAL USE PERMIT FOR A PLANNED UNIT DEVELOPMENT FOR PROPERTY LOCATED AT 1 —17 SOUTH EMERSON STREET (FOUNDERS ROW), TO APPROVE AN EXTENSION OF THE EFFECTIVE DATE OF THE CONDITIONAL USE PERMIT FOR THE FOUNDERS ROW PLANNED UNIT DEVELOPMENT WHEREAS, the President and Board of Trustees of the Village of Mount Prospect, Illinois did adopt Ordinance No. 5481, entitled "An Ordinance Granting Variations and a Conditional Use Permit in the Nature of a Planned Unit Development for Property Located at 1 -17 South Emerson Street (Founders Row)" at their regular meeting on March 1, 2005; and WHEREAS, the Petitioner, Compass Real Estate Services LLC, is the owner of certain of the property within the Planned Unit Development, which was granted by Ordinance No. 5481, known as Founders Row ( "Founders Row Planned Unit Development "); and WHEREAS, pursuant to Section 14.504(F) of the Village of Mount Prospect Zoning Ordinance, the Founders Row Planned Unit Development is subject to revocation as construction has exceeded five (5) years; and WHEREAS, the Petitioner plans to complete the Founders Row Planned Unit Development and is requesting to extend the effective date of the conditional use permit for that Planned Unit Development, so as to construct the second building and related improvements in accordance with the original Planned Unit Development plans; and WHEREAS, the President and Board of Trustees find that it is in the best interests of the Village to grant the Petitioner's request to extend the effective date of the conditional use permit for the Founders Row Planned Unit Development. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS ACTING IN THE EXERCISE OF THEIR HOME RULE POWERS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: Ordinance No. 5481 is hereby amended to extend the effective date of the conditional use permit for the Founders Row Planned Unit Development to December 31, 2014, such that construction shall start on or before that date. SECTION THREE This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
