Theme: "Early Years Are Learning Years"
Sub Theme: "Embracing Diversity"
WHEREAS, the Mt. Prospect Child Care Center Inc. and other local organizations,
in conjunction with the National Association for the Education of Young Children,
are celebrating the Week of the Young Child, April 15 -19; and
WHEREAS, these organizations are working to improve early learning
opportunities, including early literacy programs, that can provide a foundation of
learning for children in Mount Prospect; and
WHEREAS, teachers and others who make a difference in the lives of young
children in the Village of Mount Prospect deserve thanks and recognition; and
WHEREAS, public policies that support early learning for all young children are
crucial to young children's futures;
NOW, THEREFORE, I, Irvana K. Wilks, Mayor of the Village of Mount Prospect,
do hereby proclaim April 15 -19, 2013 as the
"WEEK OF THE YOUNG CHILD"
in the Village of Mount Prospect and I urge all individuals to recognize and support
the needs of young children in ours and neighboring communities.

"ARBOR DAY"
April 26, 2013
WHEREAS, in 1872J Sterling Morton proposed to the Nebraska Board of Agriculture that a
special day be set aside for the planting of trees; and
WHEREAS, this holiday, called Arbor Day, was first observed with the planting of more than
a million trees in Nebraska; and
WHEREAS, Arbor Day is now observed throughout the nation and the world; and
WHEREAS, trees can cut heating and cooling costs, clean the air, provide habitat for
wildlife, beautify our community, and produce life - giving oxygen; and
WHEREAS, trees are a renewable resource giving us paper, food, wood for our homes and
fuel for our fires.
NOW, THEREFORE, I, Irvana K Wilks, Mayor of the Village of Mount Prospect, do hereby
proclaim Friday, April 26, 2013, as
"ARBOR DAY"
in the Village of Mount Prospect and I urge all citizens to observe Arbor Day by attending the
ceremonial tree planting at Lions Park Elementary School, on Friday, April 26, 2013, at
10:30 a.m.

34 SOUTH MAIN STREET LLC d /b /a BB BBQ GRILL
On Monday, April 1, the Village Manager met with applicant Kimberly Oztekin regarding
her request for a change in ownership for the existing Class "F -3" Liquor License now in
place for the Blues Bar. The Class "F -3" License provides for the service of alcohol in
conjunction with a restaurant/lounge operation. Ms. Oztekin would purchase the
goodwill of the business and operate it under the ownership of BB BBQ Grill, in the
same location with a new address.
Ms. Oztekin indicates there will be no changes made to the existing restaurant or menu.
Hours of operation will also remain the same. There has never been a Liquor Code
violation recorded for this establishment. Ms. Oztekin is Basset trained and presented a
certificate evidencing that fact.
The Village Manager discussed at length with Ms. Ozrekin the Village's particular
sensitivity to the sale of alcohol to minors as well as over service to intoxicated persons.
The Manager also discussed the Village Fight Ordinance requirements. Ms. Oztekin
indicated she understood the requirements of the Village and would ensure that all
those employed at the establishment were aware of same.
The required application is complete and on file along with the payment of appropriate
fees and other documentation. The applicant's fingerprints and background check are
also on file. If the Village Board considers this request favorably, adoption of an
Ordinance recognizing a change in ownership for the existing Class "F3" License would
be appropriate. ,

AN ORDINANCE AMENDING CHAPTER 13 OF THE
VILLAGE CODE OF MOUNT PROSPECT
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT
PROSPECT, COOK COUNTY, ILLINOIS ACTING IN THE EXERCISE OF THEIR HOME RULE
POWERS:
SECTION ONE: That in accordance with Subsection A of Section 13.108 of Chapter 13 of the Village
Code of Mount Prospect, as amended, the Corporate Authorities shall determine the number of Liquor
Licenses available in each Classification and shall establish a list specifying the number of Liquor
Licenses authorized. Said list is hereby amended increasing the number of Class "F -3" Liquor

Change to Classification with Conditions
Class S -6 allows the Local Liquor Control Commissioner and the Village Board as corporate
authorities to place conditions on a licensee. As explained below, Balzano Liquors has violated
both Village of Mount Prospect and the State of Illinois' liquor code. The Liquor Commissioner
asks that the Class S -6 with Conditions be used to place Balzano's package liquors on
probation. The probationary period will coincide with the annual Mount Prospect Liquor License
renewal dates of May 1, 2013 until April 30, 2014. Should the Licensee sell to a person under
the age of 21, or have any other liquor code violations, the licensee is subject to additional
suspensions, fines and possible revocation of the license.
Background
In Mount Prospect, all liquor licenses (68 currently) must be renewed each year by the end of
April. As Liquor Commissioner I have the authority to renew the licenses with my signature if
the renewal applications and fees are properly submitted. As you know, I do not have the
authority on my own to create, delete or change the license classifications. All of those are
submitted to the Village Trustees to be voted on at a Village Board Meeting.
The sale or delivery of alcoholic beverages to persons under the age of 21 years is a violation
on Section 13.405(A)(1), of the Village Code of Mount Prospect and Section 6- 16(a)(i) of the
Illinois Liquor Control Act, 235 ILCS5 /6- 16(a)(i).
Factual Circumstances
On July 11, 2011, an employee at Balzano Liquors sold alcoholic beverages to a person under
the age of 21 years. Identification was not requested by the Licensee's employee with respect
to this sale /delivery to this minor.
At that time, the Licensee Akshay Patel was found guilty. I ordered suspension of sales for one
(1) day and a payment of $1500. The licensee contacted the Village Manager's Administrative
Assistant Doreen Jarosz to ask if he could avoid the one -day suspension because of many
factors and because it was his first offence. I then reconsidered and ordered a fine of $2500

plus costs of $100 to be paid. In addition I placed Balzano on a one -year probation period with
the understanding that the license was in jeopardy if there were other sales to minors. It also
was made clear that once a licensee is caught, our police and the state liquor commission
continue to conduct stings of that location.
On October 12, 2012, at about 8:15 p.m., an employee at Balzano's again sold an alcoholic
beverage to a person under the age of 21 year without asking for identification. The police
report read almost verbatim to the previous violation. They technically finished probation in
July, but the repeated violation was serious. Our attorney and I wrote Orders that suspended
sales for 14 days starting November 16 until November 28, 2012 and fined them $1600. Mr.
Patel appealed the Orders, asking for a hearing.
On November 8, 2012 the local liquor control Commissioner conducted a hearing regarding the
Licensee's October 12, 2012 sale of alcohol to a minor. The Licensee was represented by an
attorney. As a result of the hearing, the Commissioner entered a Final Order, suspending the
license for fourteen (14) days and imposing a fine of $1500 and costs. The Licensee appealed
the Final Order to the Illinois Liquor Control Commission, which stayed its enforcement. The
Licensee subsequently withdrew his appeal, such that the stay has been withdrawn.
Therefore, Balzano's license will be suspended for fourteen (14) days beginning April 7, 2013
and ending April 20, 2013; and pay a fine of $1500 plus costs.
Given the frequency of Balzano's violations, our Village Attorney and I felt the use of the Class
S -6 would allow the package liquor store to remain open. However, it also would encourage
them to have additional training for employees.
