HomeMy WebLinkAboutOrd 3029 08/05/1980 ORDINANCE NO. 3029 AN ORDINANCE AME~ING THE ZONING ORDINANCE A/~D G~P3kNTING sPECi~i~D 9ARiATIONs F~R PROPERTY AT THE WEST END OF MIDWAY DRIVE WEST OF ELFS{URST ROAD WHEREAS, Charles Vavrus (who shall be referred to as "Petitioner" is the contract pUrchaser of a parcel of property consisting of 3.8 acres at the west end of Midway Drive west of Elmhurst Road in the Village of Mount ProSpect, County of Cook, State of Illinois (hereinafter referred to as the "Subject Property"); and WHEREAS, the subject Property is legally described as follows: Lot 1 (Excepting therefrom that part of said Lot 2 lying East of a line 212.0 feet, as measured along the North line thereof, East of and parallel with the West line of said Lot 2 ~nd lying North of the North line of Midway Drive and said'North line of Midway Drive extended West to said last described parallel line), in Northway Investment Subdivision of the North 480 feet of the East 931.35 feet (as measured parallel to the North and East lines thereof) of the Southeast 1/4 of the Southeast 1/4 of Section 23, Township 41 North, Range 11, East of the Third Principal Meridian, ALSO That part of Lot 2, aforesaid, described as follows: Beginning at the Northwest corner of heretofore dedicated Midway Drive; thence West along an extension of the North line of said heretofore dedicated Midwav Drive, 85.95 feet; thence Northeast, East, and Southeast along a curved line convexed to the North and having a radius of 54.0 feet, an arc distance of 99.41 feet to the place of beginning, all in Cook County, Illinois. WHEREAS, the Subject Property is located in the B-3 Business Retail and Service District under the provisions of the Zoning Ordinance of the Village of Mount Prospect (hereinafter referred to as the "Zoning Ordinance"); and WHEREAS, Petitioner has heretofore filed an application seeking the following amendment to and variations from the provisions of the Zoning Ordinance: An amendment to Article XX, Section 14.2001 to permit a health clubin the B-3 District. A variation from Article XX, Section 14.2005. B. 3. to permit one truck loading space instead of the three required. A variation from Article XXVI, Section 14.2602. B. 35. to permit off street parking spaces of nine (9) feet by twenty (20) feet instead of the required ten (10) feet by twenty (20) feet. WHEREAS, a public hearing was held on the Petitioner's request for the aforesaid amendment and variations, which request is known as ZBA-24-A-80 and ZBA-25-V-80, before the Zoning Board of Appeals of the Village of Mount Prospect on May 22, 1980, pursuant to proper public notice published in the Mount Prospect Herald on May 7, 1980; and WHEREAS, the Zoning Board of Appeals has recommended to the Building Committee of the Board of Trustees of the Village of Mount Prospect that Petitioner's request for the aforesaid amendment, ZBA-24-A-80, be granted and that the Petitioner's request for the aforesaid variations, ZBA-25-V-80 be granted as co Article XX, Section 14.2005. B. 3. and be denied as to Article XXVI, Section 14.2602. B. 35; and WHEREAS, the President and B~ard of Trustees have considered the Petitioner's request and reviewed the recommendation of the Village of Mount Prospect Zoning Board of Appeals in ZBA-24-A-80 and ZBA-25-V-80; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have determined that with respect to the Petitioner's requested variations, that Petitioner has satisfied the standards for the grant of variations set forth in Section 14.605 of Article VI of the Zoning Ordinance and find that it would be in the best interest of the Village of Mount Prospect to grant Petitioner the requested amendment and variations. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS as follows: SECTION ONE: The recitals set forth hereinabove are incor- porated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The Zoning Ordinance of the Village of Mount Prospect is hereby amended as follows: Article XX, Section 14.2001 of the Zoning Ordinance is hereby amended by adding thereto a new subsection R to read as follows: o R. Recreation centers. Article XXVI, Section 14.~§02.-~.~is hereby by renumbering existing subsectiOns 41 57 aS'~'~Ough 58 and by inserting a section 41 to read as follows: 41. SECTION TH/REE: The President and Board of Trustees of the Village of Mount Prospect hereby grant the following variation for the Subject Property: A variation from Article XX, Section 14.2005. B. 3. of the Zoning Ordinance to permit one truck lbading space instead of the three required. A variation from Article XXVI, Section 14.2602. B. 35. of the Zoning Ordinance to permit off street parking spaces of nine (9) feet by twenty (20) feet instead of the required ten (10) feet by twenty (20) feet. SECTION FOUR: Except for the variations granted herein, all other applicable Village of Mount Prospect ordinances shall remain in full force and effect as to the Subject Property. SECTION FIVE: This Ordinance shall be in full force and effect from and after its passage, approval· and publication in the manner provided by law. Passed this 5th day of August , 1980.
