FOR PROPERTy KT~9~8~EAST'~N~KOAD
WHEREAS, Ernest J. Capuana and ShirleyA. Capuana (Wh0~Shall
be referred to collectively as Petitioners ) are the owners
;of a parcel of property !ocated at 908 East Central Road in
the Village of Mount Prospect, CoUnty 0f COok, State of IilinOi
(hereinaf~e~ referred {6' a~s' the "SUbject Propert "); and
WHEREAS, the Subject prOper~y is legallY deS~:ribed as follows:
Lot 5, in'bl0ck °ne (1)' in'F~ank ~ra*fine.s Third
Addition, a subdivision in the soUthwest Quarter
(1/4) of Section 35, Township 42 North, Range 11
East of the third principal meridian, according
to plat thereof registered in the Office of the
Registrar of Titles of Cook County, Illinois, on
December 23, 1957 as doCUment number 1774921;
wHER~AS~ the subject ProPerty is iOcated in the R-1 Single ~
Family Residence District under the provisions of the Zoning
OrdinanCe of the Village 'of MoUnt ~rospect (hereinafter referre(
to as the "zoning Ordinance''); and
WHEREAS, Petitioners have here~of0re filed an application seekiI
Variations from Sections 14.1102B2 and i4.2602B51K ~o Permit
a driveway On the subject Property in the location shown on
Exhibit A attached hereto and incorporated herein by this
reference; and
WHEREAS, a public ~hearing Was held on thePeti~ioners, request
for the aforesaid variations, which request is known as
ZBA-18-V-80, before the Zoning Board of Appeals of the Village ¢
Mount Prospect on May 22, I980, Pursuant'tO proper public notice
publiShed in the Mount Prospect Herald on May 7, 1980; and
WHEREAS, the Zoning Board of APpeals has recommended to the
Building Committee of the Board of Trustees of the Village of
Mount Prospect that Petitioners' request for the aforesaid
variations,, ZBA-18-V-80, .be granted; and
WHEREAS, the President and Board of Trustees have considered the
etioners'request and reviewed the
recommendations
of
the
i zage of Mount Prospect Zoning Board of Appeals in ZBA-18-V-80
and
WHEREAS, the President and Board of Trustees of the Village of
Mount Prospect have determined that with respect to the Peti-
tioners' requested variations, that Petitioners have satisfied
the standards for the grant of variations set forth in Section
14.605 of Article VI of the Zoning Ordinance and find that it
would be in the best interest of the Village of Mount Prospect
to allow Petitioners to construct a driveway with the dimensions
and in the location shown on Exhibit B hereto on the Subject
Property subject to the condition that Petitioners landscape

the area between such driveway and the side lot line.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS

SECTION ONE: The recitals set forth hereinabove are incorporate4
herein as findings of fact by the President and Board of Trustees
of the Village of Mount Prospect.
SECTION TWO: Subject to the conditions set forth hereinafter in 1
Section Three, the President and Board of Trustees of the Villag~
of Mount Prospect hereby grant Petitioners variations from i
Sections 14.1102B2 and 14.2602B51K to permit a driveway with the i
dimensions and in the location shown on Exhibit B attached heretq
and incorporated herein by this reference to be located on the
following legally described parcel of property:
Lot 5, in block one (1) in Frank Serafine's Third
Addition, a subdivision in the Southwest Quarter
(1/4) of Section 35, Township 42 North, Range 11
East of the third principal meridian, according
to plat thereof registered in the Office of the
Registrar of Titles of Cook County, Illinois, on
December 23, 1957 as document number 1774921
(heretofore and hereinafter referred to as the "Subject propertY"D .

'SECTION THREE: The variations granted herein are subject to the
,Petitioners' compliance with the site plan attached hereto as
:!Exhibi t B and the condition that Petitioners landscape the
\iarea identified on Exhibi t Band located between such drivevlaY i
lIand the side lot line of the Subject Property in a manner approve~
I! by the Direc tor of Communi ty Development.

iiSECTION FOUR: The variations granted herein shall be subject to
nrevocation if Petitioners fail to comply with the conditions on
,itheir grant set forth in Section Three of this Ordinance.

PSECTION FIVE: Except for the variations granted herein, all
ilapplicable Village of Mount Prospect ordinances shall remain
llfull force and effect as to the Subject Property.
