JANONIS DATE: FEBRUARY 7, 2013 SUBJECT: AMC THEATRE RANDHURST CHANGE IN ORDINANCE I received a call from American Multi- Cinema, AMC Randhurst theatre, seeking a cup size modification to the Class S -4 liquor classification. Attached is the written letter I requested from AMC asking for an amendment to the Ordinance. I also asked our Village Attorney to draft an Ordinance amending section 13:204.1 of Chapter 13 for the Village Board to review. Prospect IL Dear Mayor Wilks, We understand that Michael Janonis and Everett Hill have briefed you on the recent meeting with Irene Bahr and myself about the conditions for the operation of the AMC theatre. After two years of operation with no negative incidents, we are asking that the conditions for the service of alcoholic beverages be reconsidered by the Village. During the meeting with Michael Janonis, Everette Hill and Timothy Janowick, Deputy Chief, and the Police Chief who was also present for a part of the meeting, on October 16, 2012, I outlined the request to modify the conditions for its sales and service of alcoholic beverages which had been previously agreed to by and between the Village and AMC. As a follow up to the meeting we were asked to put AMC's proposal in a letter for the Village's consideration. The change we are requesting is that we be allowed to modify the cup sizes used for serving alcoholic beverages. We would like to change the cup sizes for mixed drinks from 8 oz., to 12 oz. AMC's mixed drinks are prepared according to the standard recipes for such beverages. A 12 oz. cup is the standard size allowing for ice and the mixer as well as the standard portion of spirits. Reducing the container to an 8 oz. size throws the taste and mix of the drink off because while the amount of alcohol remains the same, the amount of mixer (such as juice, seltzer, or other mixer etc.) as well as the amount of ice that may be placed in the container is reduced. This effectively makes the mixed drinks stronger than AMC normally produces using the standard 12 oz. cup. We will not add any additional spirits to our recipes with the increased cup size. For beer, AMC is requesting a change from the 16 oz. size cup to a 20 oz. cup which, again, is a standard size for beer throughout AMC Theatres. Wine servings would remain the same. As you are aware, we stay in regular contact with the Police Department and welcome any dialogue at any time. If you could please give us approval for this change, we would greatly appreciate it. AN ORDINANCE AMENDING CHAPTER 13 ENTITLED "ALCOHOLIC LIQUOR" OF THE VILLAGE CODE OF MOUNT PROSPECT, ILLINOIS BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION 1: Subparagraph (C)(5)(e) of Section 13.204.1 entitled "Descriptions and Restrictions" of Chapter 13 entitled "Alcoholic Liquor" of the Mount Prospect Village Code shall be amended by deleting subparagraph (e) in its entirety and inserting in lieu thereof the following new subparagraph (e) to be and read as follows; e. Beer may be sold only in individual containers holding twenty (20) ounces or less. All other alcoholic beverages may be sold only in individual containers holding twelve (12) ounces or less. This limitation shall be absolute and shall apply irrespective of the actual alcoholic content of the beverage. SECTION 2: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law. Beer may be sold only in individual containers holding sixteen (16) ounces or less. All other alcoholic beverages may be sold only in individual containers holding eight (8) ounces or less. This limitation shall be absolute and shall apply irrespective of the actual alcohol content of the beverage.
