ORDINANCE NO. 3035
AN ORDINANCE AMENDING SECTION 14.2602B41 OF
CHAPTER 14 OF THE VILLAGE OF MOUNT PROSPECT
MUNICIPAL CODE
WHEREAS, the ~illage of Mount Prospect (hereinafter referred
to as the "Petitioner") has filed an application seeking an
amendment to Sectioh 14.2602B41 of Chapter 14 of the Village
of Mount Prospect Municipal Code (hereinafter referred to as
the !'Zoning Ordinance") to reduce the minimum lot size of a
regional shopping center from fifty acres to twenty acres;
and
WHEREAS, a public hearing was held on Petitioner's request,
known as Case Number ZBA32~A-80, before the Zoning Board of
Appeals of the Village of MOunt Prospect on June 26, 1980
and continued from time to time thereafter until the adjourn-
ment of the public heari'ng on July 29, 1980; and
WHEREAS, said public hearing was held pursuant to proper
public notice thereof published in the Mount Prospect Herald
on June 10, 1980; and
WHEREAS, the Zoning Board of Appeals recommended that
Petitioner's request ZBA32-A-80, be granted; and
WHEREAS, the President and Board of Trustees of the Village
of Mount Prospect find that it would be in the best interest
of the Village to grant the amendment requested.
NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD
OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY,
ILLINOIS AS FOLLOWS:
SECTION ONE: The recitals set forth hereinabove are incorpor-
ated herei~ as findings of fact by the President and Board of
Trustees of the Village of Mount Prospect.
SECTION TWO: Section 14.2602B41 of Chapter 14 of the Municipal
Code of the Village of Mount Prospect be, and the same is hereby
amended by deleting therefrom the word and number "fifty (50)'~
and inserting in its place, the word and number "twenty (20),"
so that said Section 14.2602B41 shall hereafter be and read as
follows:
Section 14.2602B41 Regional Shopping Center: A business
development containing ten (10) or more indoor retail
stores connected by party walls developed under one
ownership, with an integrated building arrangement,
having an aggregate floor area of more than one hundred
thousand (100,000) square feet and located on a lot at
least twenty (20) acres in size, which development with
its off-street accessory parking facilities shall be
considered as a single unit. The term "Regional Shopping
Center" shall not be confused with the term "Shopping Cent~

SECTION THREE: This Ordinance shall be in full force and
effect from and after its passage, approval and publication
in the manner provided by law.
