ORDINANCE NO. 3055
AN ORDINANCE GRANTING SPECIFIED VARIATIONS
FOR PROPERTY AT 111 NORTH LANCASTER STREET
WHEREAS, James M. Nedza and Marilyn A. Nedza (~ho shall be
referred to as "Petitioner") are the owners of a parcel of pro
perty located at 111 North Lancaster Street in the Village of
Mount Prospect, County of Cook, State of Illinois (
referred to as the "Subject Property"); and
WHEREAS, the Subject Property is legally described as follows:
Lots 1, 2 and 3 in Block 4 in Centralwood, being
a Subdivision of the following described land:
beginning at the Southeast corner of the West
1/2 of the Southeast 1/4 of Section 33, Township
42 North, Range 11 East of the Third Principal'
Meidian, thence West along South line of said
Section 33, a distahce of 14.82 chains (978.12
feet), thence North along a line parallel to the
East line of the West Half (1/2) of the South-
east Quarter (1/4) of said Section 33 to the '
Southerly line of the right-of-way of the'
Chicago and Northwestern Railway Company; thence
Southeasterly along the said right-of-way line
to the East line of the West Half (1/2) of the
Southeast Quarter (1/4) of said Section 33;
thence South along the last mentioned line to
the place of beginning, in Cook County, Illi-
nois;
and
· WHEREAS, the Subject Property is located in the R-3 Apartment
Residence District under the provisions of the Zoning
of the Village of Mount Prospect (hereinafter referred to as
the "Zoning Ordinance"); and
WHEREAS, Petitioner has heretofore filed an appliCation
the following variations from the provisions of the Zoning
Ordinance:
A Variation from Section 14.1401.B.4 of Article
XIV of the Zoning Ordinance to permit the con-
~truction of a 4-car garage on the Subject
Property.
A twelve (12) foot variation from'Section
14.1402.D.3 of Article XIV of the Zoning
Ordinance to permit the construction of said
garage eight (8) feet from the exterior side lc
line adjacent to the public alley instead of
required twenty (20) feet.
A variation from Section 14.1405 of Article XI~
of the Zoning ordinance to allow six (6)

spaces for the four dwelling units on the Sub-
ject Property instead of the required eight (8)
parking spaces.
WHEREAS, a public hearing was held on the Petitioner's request
for the aforesaid variations, which request is known as
ZBA-23-V-80, before the Zoning Board of Appeals of the Village
of Mount Prospect on May 22, 1980, pursuant to proper public
notice published in the Mount Prospect Herald on May 7, 1980;
and
WHEREAS, the Zoning Board of Appeals has recommended to the
Building Committee of the Board of Trustees of the Village of
Mount Prospect that Petitioner's request for the aforesaid
variations, ZBA-23-V-80, be granted; and
WHEREAS, the President and Board of Trustees have considered
the Petitioner's request and reviewed the recommendation of the
Village of Mount Prospect Zoning Board of Appeals in ZBA-23-V-8(
and
WHEREAS, the President and Board of Trustees of the Village of
Mount Prospect have determined that with respect to the Peti-
tioner's requested variations, that Petitioner has satisfied
the standards for the grant of variations set forth in Section
14.605 of Article VI of the Zoning Ordinance and find that it
would be in the best interest of the Village of Mount Prospect
to grant Petitioner the requested variations. :
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE. VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLI-
NOIS as follows:
SECTION ONE: The recitals set forth hereinabove are incorporat~
herein as findings of fact by the President and Board of Truste~
of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Villag~
of Mount Prospect hereby grant the following variations:
A variation from Section 1~.1401.B.4 of
Article XIV of the Zoning Ordinance to
permit the construction of a 4-car garage;
A twelve (12) foot variation from Section
14.1402.D.3 of Article XIV of the Zoning
Ordinance to pe£mit the construction of
said garage eight (8) feet from the exterior
side lot line adjacent to the public alley
instead of the required twenty (20) feet;
A variation from Section 14.1~05 of Article
XIV of the Zoning Ordinance to allow six
(6) parking spaces for four dwelling units
instead of the required eight (8) parking
spaces;
for a parcel of real estate legally described as follows:
Lots 1, 2 and 3 in Block 4 in Centralwood, being
.a Subdivision of the following described land:
beginning at the Southeast corner of the West

42 North, Range 11 East of the Third Principal
Meridian, thence West along South line of said

east Quarter (1/4) of said Section 33 to the.
Southerly line of the right-of-way of the Chicago
and Northwestern Railway Company; thence South-
easterly along the said right-of-way line to the
East line of the West Half (1/2) of the Southeast
Quarter (1/4) of said Section 33; thence South
along the last mentioned line to the place of
beginning, in Cook County, Illinois.
SECTION THREE: Except for the variations granted herein, ail
other applicable Village of Mount Prospect ordinances shall
remain in full force and effect as to the Subject Property.
SECTION FOUR: This Ordinance shall be in full force and
from and after its passage, approval, and publication in the
manner provided by law.
