HomeMy WebLinkAboutOrd 3041 09/02/1980 RDINANCE NO. 3041 AN O?dDINANCE GRANTING SPECFIED VARIATIONS FOR PROPERTY AT 17 N. EMERSON STREET WHEREAS, Larry and Judy Galowitsch (who shall be referred to as "Peti- tioner'') are the owners of a parcel of property located at 17 N. Emerson Street in the Village of Mount Prospect, County of Cook, State of Illinois (hereinafter referred to as the "Subject Property"); and WHEREAS, the Subject Property is legally described as follows: Lot 92 and the North half of Lot 93 in Laudermilk Villa a Subdivision of the South East quarter of Section 34, Town- ship 42 North, Range 11, East of the Third Principal Meridian, Cook County,.. Illinois; gHEREAS, the Subject Property is located in the R-1 Single Family Residence District under the provisions of the Zoning Ordinance of the Village of Mount Prospect (hereinafter referred to as the "Zoning Ordinance"); and WHEREAS, Petitioner has heretofore filed an application seeking the following variations from the provisions of the Zoning Ordinance and ~uilding Code: A 4.35 foot variation from Section 14.1!02.B~of Article XI of the Zoning Ordinance to permit a sideyard of 3 feet on the south side of the single family dwelling unit located on the Subject Property instead of the required 7.35 feet. A 7 foot variation from S~ction R-210.SL1. of Chapter 21 of the Buiiding Code (Ordinance 2885) to permit the construction of a detached garage on the Subject Property set back 68 feet from the front lot line instead of the required 75 feet. ~EREAS, a public hearing was held on the Petitioner's request for the ~foresaid variations, which request is known as ZBA-26-V-80 before the :oning Board of Appeals of the Village of Mount Prospect on June 26, .980, pursuant to proper public notice published in the Mount Prospect Ierald on June 5, 1980; and H~REAS, the Zoning Board of Appeals has' recommended to the Building iommittee of the Board of Trustees of the Village of Mount Prospect that tietitioner's request for the aforesaid variations, ZBA-26-V-80, be i tranted; and EREAS, the President and Board of Trustees have considered the ~etitioner's request and reviewed the recommendation of the Village of ~ount ProsPect ZOning Board of Appeals in ZBA-26-V-80; and ~1~LrIEREAS' t~e president and Board of Trustees of the Village ?f Mount ~rospect have determined that with respect to the Petitioner s requested ~,ariations, that Petitioner has. satisfied the standards for the grant of ~ariations set forth in section 14.605 of Article VI of the Zoning ~J~dinanCe and find that it woUld be in the best interest of the Village If Mount prospect to grant Petitioner the requested variations. 2 - NOW, THEREFORE, BE IT ORDAINED BY THE P'RESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS as follows: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SEC'TION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant the following variations: A4.35 foot variation from Section 14.1102.B. of Article XI of the Zoning Ordinance to permit a sideyard of 3 feet on the south side of the szngle family dwelling unit located on the Subject Property instead of the required 7.35 feet; A 7 foot variation from Section R-210.5L1. of Chapter 21 of the Building Code (Ordinance 2885) to permit the construction of a detached garage on the Subject Property set back 68 feet from the front lot line instead of the required 75 feet; for a parcel of real estate legally described as follows: Lot 92 and the North half of Lot 93 in Laudermilk Villa a Subdivision of the South East quarte~ of. Section 34, To%mship 42 North, Range 11, East of the Third Principal Meridian, Cook County, Illinois. SECTION THREE: Except for the variations granted herein, all other appli- cable Village of Mount Prospect ordinances shall remain in full force and effect as to the Subject Property. SECTION FOUR: This ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law. Passed this 2nd. day of September , 1980.
