SUBJECT: PZ -26 -121 PLAT OF SUBDIVISION 110 MARCELLA ROAD
The Petitioner, Patrick C. Dunn, is seeking approval of a Plat of Subdivision for the property located at
10 Marcella Road. The Plat of Subdivision would create two lots of record and grant the required
easements along the property lines. Public utility and drainage easements measuring five feet (5') wide
along the side and ten feet (10') wide along rear property lines would be dedicated.
Staff reviewed the plat and found that the plat was prepared in accordance with the Village Code. The
subdivision of the property will not create any zoning nonconformities.
The Planning and Zoning Commission conducted a public hearing to review the request on Thursday,
January 24, 2013, and by a vote of 6 -0, recommended approval of the Plat of Subdivision for the
property located at 10 Marcella Road. Details of the proceedings and items discussed during the
Planning and Zoning Commission hearing are included in the attached minutes.
Please forward this memorandum and attachments to the Village Board for their review and
consideration at their February 5, 2013 meeting. Staff will be present to answer any questions related
to this matter.

Chairman Rogers called the meeting to order at 7:31 p.m. Chairman Rogers asked if everyone had a chance to
review the December 13, 2012 minutes. Ms. Hinaber commented there was one correction that needed to be
made to the second page of the minutes relating to J JF McCarthy Construction's request. Mr. Andrade confirmed
the case was PZ-13-12. Mr. Donnelly made a motion, seconded by Mr. Youngquist to approve the minutes of the
December 13, 2012 Planning & Zoning Commission meeting with that correction; the minutes were approved 5-0
with Ms. Otteman abstaining. Chairman Rogers introduced Case PZ-26-12, 10 Marcella Road at 7:38 p.m.
Ms. Andrade said the Petitioner for PZ-26-12 was seeking approval of a Plat of Subdivision for the property
located at 10 Marcella Road.
Ms. Andrade stated the Subject Property is located on the west side of Marcella Road just north of Central Road.
The property is zoned RI Single Family Residence. The Subject Property contains a single family home with
related improvements that consist of detached garage in the rear, an existing asphalt driveway, and sidewalks.
Ms. Andrade said the Petitioner recently purchased the Subject Property and is seeking to subdivide the property
into two (2) lots of record,
Ms. Andrade stated the Plat of Subdivision would also consist of the required easements along the property lines.
Public utility and drainage easements measuring five (5) feet wide along the side and ten (10) feet wide along rear
property lines would be dedicated.

Ms. Andrade said Staff reviewed the plat and found that the plat was prepared in accordance with the Village
Code. The subdivision of the property would not create any zoning nonconformities and the proposed lots would
meet the required lot width and size. Based on Staff's review of the Plat of Subdivision, Staff recommended that
the Planning & Zoning Commission recommend approval of the motion listed in the Staff Report. The Village
Board's decision is final for this case.
Chairman Rogers asked if there were any questions for staff. After hearing none, Chairman Rogers swore in Judy
Dunn, 15 N. Marcella Road, Mount Prospect, IL 60056. Mrs. Dunn explained that they would like to eventually
build a smaller home. The plan would be to sell their existing house and build on the vacant lot.
Chairman Rogers asked if there were any questions for the Petitioner and if there was anyone else in the audience
to address this case. Hearing none, he closed the public portion of the case at 7:36 p.m. and brought the
discussion back to the board.
Ms. Hinaber made a motion, seconded by Mr. Donnelly to approve: A Plat of Subdivision, titled "Dunn
Subdivision 11" benefiting the property at 10 Marcella Road, Case No. PZ-26-12.

The motion was approved 6-0. The Village Board's decision is final for this case.
Chairman Rogers asked if there were any citizens in the audience to be heard on this or any other case. After
hearing none, Mr. Floros made a motion, seconded by Mr. Youngquist to adjourn at 7:38 p.m. The motion was
approved by a voice vote and the meeting was adjourned.

A RESOLUTION APPROVING A PLAT OF SUBDIVISION,
TITLED "DUNN SUBDIVISION II,"
FOR PROPERTY LOCATED AT
10 MARCELLA ROAD, MOUNT PROSPECT, ILLINOIS
WHEREAS, Patrick C. Dunn (Petitioner) has requested approval of a Plat of Subdivision for the
purpose of creating two (2) lots of record and granting the required easements along the property
lines, as legally described in Exhibit "A "; and
WHEREAS, the plat creates two (2) lots of record and dedicates five feet (5) wide public utility and
drainage easements along the side property lines and ten feet (10') wide public utility and drainage
easements along the rear property lines of the two (2) lots of record; and
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, ACTING IN THE EXERCISE
OF THEIR HOME RULE POWERS:
SECTION ONE That the Plat of Subdivision creating two (2) lots of record and granting the
required public utility and drainage easements along property lines for property located at 10
Marcella Road, attached as Exhibit "A," is hereby approved for appropriate execution and
recording. Such Plat and its legal description are incorporated into and made part of this resolution.

Re: Ordinance amending Article XV, Solicitation on Streets and
Highways, of Chapter 23, pursuant to Public Act 97 -692
The attached ordinance amends Article XV, Solicitation on Streets and Highways, of
Chapter 23 of the Village Code to address the requirements of Public Act 97 -692,
effective 6/15/12, which preempts home rule and requires that municipalities allow
certain public safety employees to solicit for charitable organizations on municipal
property, including public roadways. In addition to application and other requirements,
the Act permits reasonable restrictions based upon articulable safety concerns. The
ordinance creates such restrictions by limiting soliciting in public roadways to the
intersections previously designated by the Village Board in Section 23.1501 and
requiring high visibility vests.

AN ORDINANCE AMENDING CHAPTER 23 OF THE VILLAGE CODE
OF THE VILLAGE OF MOUNT PROSPECT, ILLINOIS,
REGARDING THE SOLICITATION OF CHARITABLE CONTRIBUTIONS
BY PUBLIC SAFETY EMPLOYEES
WHEREAS, Section 11 -1006 of the Illinois Vehicle Code (the "Code "), 625 ILCS 5/11 -1006
( "Section 11- 1006 "), prohibits a person from standing on a highway for the purpose of soliciting
rides, employment or business from the occupant of any vehicle, and from soliciting
contributions from the occupant of any vehicle, except within a municipality which expressly
permits the soliciting of contributions by charitable organizations through a municipal ordinance;
and
WHEREAS, the Village of Mount Prospect (the "Village ") adopted Article XV, Solicitation on
Streets and Highways, of Chapter 23, Offenses and Miscellaneous Regulations, of the Mount
Prospect Village Code ( "Article XV "), pursuant to Section 11 -1006 and its home rule powers, to
permit the soliciting of contributions on streets and highways by charitable organizations; and
WHEREAS, the Illinois legislature thereafter adopted Public Act 97 -0692, effective June 15,
2012, which requires that municipalities, including home rule municipalities, permit charitable
organizations to solicit for charitable purposes, including solicitation on public roadways, when
conducted by a local agency's law enforcement personnel, firefighters and employees, who are
employed to protect the public safety, in accordance with the requirements of that Act, which
requirements are less restrictive than those set forth in Article XV; and
WHEREAS, the President and Members of the Village Board find that the safety of solicitors
and motorists requires that such solicitation on public roadways be conducted while wearing a
highly reflective vest and at certain signalized intersections due to the hazards associated with
soliciting vehicles, especially at locations not controlled by traffic control signals, and therefore
have determined that Article XV of the Village Code shall be amended to permit such solicitation
activity within the Village subject to those requirements.
NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, PURSUANT TO ITS
HOME RULE POWERS:
SECTION 1: A new Section 23.1505, "Solicitation by Public Safety Employees ", shall be
inserted in Article XV, Solicitation on Streets and Highways, of Chapter 23, Offenses and
Miscellaneous Regulations, of the Village Code, the remaining Section to be renumbered
numerically, to be and read as follows:
Section 23.1505, "Solicitation by Public Safety Employees"
A. Definitions for purpose of this Section.
"Charitable organization" means an organization or institution organized and
operated to benefit an indefinite number of the public, as defined in Section 2 of the
Charitable Games Act, 230 ILCS 30/2.
2. "Local agency" means a municipality, county, special district, fire district, joint powers
of authority, or other political subdivision of the state of Illinois.
3. "Public safety employees" means the law enforcement personnel, firefighters and
other persons employed by a local agency to protect the public safety.

B. Eligible Organization.
Notwithstanding any other requirement in this Article, an organization may solicit on
municipal property within the Village, including on public streets and highways, if the
following requirements are met.
1. The organization must be a charitable organization soliciting for a charitable purpose.
2. The persons conducting the solicitation must only be public safety employees, and
the Village of Mount Prospect must be within the service area of the local agency
employing those public safety employees.
3. The organization must be able to furnish a certificate of liability insurance, as
required in Subsection 23.1502(F) of this Article.
4. Solicitation in any street or highway must be conducted while wearing a high visibility
vest and only at the intersections described in Section 23.1501 of this Article.
5. A completed application has been submitted and a permit has been issued.
C. Application.
1. A written application, verified under oath, shall include the following information:
a. Name, address and telephone number of the applicant and organization for
which the permit is sought,
b. A statement that the organization is a charitable organization, as defined in
Subsection 12.1505(A), and the identity of the indefinite number of the public
benefited by the charitable organization,
c. A statement describing the charitable purpose for the solicitation,
d. A statement that the solicitation will only be conducted by public safety
employees, identifying the local agency employing the public safety employees
and confirming that the Village of Mount Prospect is within the service area of the
local agency,
e. The days and times of solicitation,
f. The location(s) of solicitation,
g. The manner and condition of solicitation, and
Proof of liability insurance policy, as required in Subsection 23.1502(F) of this
Article.
D. Permit Required,
1. An organization, eligible to conduct solicitation activities under this Section, shall
submit an application for a permit with the village clerk at least 10 business days
before the solicitation.

2. The village clerk shall review the application for compliance with the eligibility and
application requirements of this Section and approve or deny the permit within five
(5) business days after its filing.
3. Reasonable restrictions may be included on the permit at the request of the chief of
police if based upon articulated public safety concerns.
SECTION 2: Appendix A, Division 1, "Bonds, Salaries, Insurance and Miscellaneous ", of the
Village Code, shall be amended by deleting the phrase "Section 23.1505" and replacing it with
the phrase "Section 23.1506 ", to be and read as follows:

Present a recommendation that the annual budget be amended for fiscal year begin
January 1, 2012 and ending December 31, 2012.

BACKGROUND:
Ordinance 5891, adopted December 20, 2011, established the annual budget for the
year ending December 31, 2012. Ordinance 6001 adopted on April 3, 2012 provided for
amendment #1 of the 2012 budget. Ordinance 6036 adopted on November 6, 2012
provided for amendment #2 of the 2012 budget. Ordinance 6047 adopted on December
18, 2012 provided for amendment #3 of the 2012 budget.
DISCUSSION:
Each year the Village prepares two or more budget amendments impacting revenues
and /or expenses to the current year's budget. The first of these amendments is
typically prepared in Spring and amends the budget for carry-over items from the prior
year's budget. Accounts adjusted in the first amendment are typically for capital
projects started in the previous year but not completed. Subsequent amendments
brought forward for consideration adjust the budget for material variations in
expenditures that are the result of extraordinary or unanticipated charges that occur
during the year. These amendments are a necessary housekeeping process to
comply with the Budget Officer Act.
A proposed ordinance amending the 2012 annual budget is attached for the Board's
consideration. In total, this amendment increases the total village budget for revenues
by $7.2 million and for expenditures by just $131,600, or 0.14 %.
Adjustments, increases and decreases, to the budget impacting revenues are made up
of adjustments to various taxes, grants, internal service and investment income
accounts. Of the $7.2 million increase in revenue accounts, $3.9 million is attributed to
higher than expected investment income earnings in the village's two public safety
pensions. Earnings in excess of actuarial assumptions work to decrease the unfunded

liability of the pension funds and increase their funded ratio. There was also $2.5
million in installment note proceeds that were issued during 2012 not originally
anticipated. The note proceeds will be used to cover costs related to various flood
control projects. The balance of adjustments to revenues are spread out are spread out
among ten (10) other Village Funds.
Adjustments to the budget impacting expenditures are made up of adjustments to
commodities & supplies, contractual service and capital equipment accounts. One
significant increase was for the purchase of water through the Joint Action Water
Agency. The increase to this account of $350,000 was necessitated by the increase in
the cost of water supplied by the City of Chicago. There was also a significant decrease
in two capital accounts intended for the purchase of police and fire radios. Initially, the
radios were to be purchased outright. Due to exceptional financing rates the radios
were purchased using proceeds from a low interest short -term note to be repaid over 7
years. The decrease in capital accounts related to the purchase of radios totaled
$860,000. The balance of adjustments to expenses are spread out are spread out
among eight (8) other Village Funds.
RECOMMENDATION:
It is recommended the Village Board adopt the proposed budget amendment #4 for the
2012 annual budget.

WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have passed
and approved Ordinance No. 2342 which sets the finances of the Village under the "Budget
Officer System "; and
WHEREAS, pursuant to the aforesaid Ordinance and the Statutes of the State of Illinois an annual
budget for the fiscal year commencing January 1, 2012 and ending December 31, 2012 was
adopted through the passage of Ordinance No. 5891 approved by the Corporate Authorities of the
Village of Mount Prospect on December 20, 2011; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have passed
and approved Ordinance No. 6001 on April 3, 2012, amending the annual budget for the fiscal
year commencing January 1, 2012 and ending December 31, 2012; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have passed
and approved Ordinance No. 6036 on November 6, 2012, amending the annual budget for the
fiscal year commencing January 1, 2012 and ending December 31, 2012; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have passed
and approved Ordinance No. 6047 on December 18, 2012, amending the annual budget for the
fiscal year commencing January 1, 2012 and ending December 31, 2012; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have further
reviewed certain additions and changes to the aforesaid budget for the fiscal year beginning
January 1, 2012 and ending December 31, 2012; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect believe the
changes, as specified on the attached January 1, 2012 through December 31, 2012 Budget
Amendment No. 4 to be in the best interest of the Village of Mount Prospect; and
WHEREAS, the Village has now revised the revenue projections or has reserves in each of the
Funds in which the budget is being increased adequate in amount to cover the budget changes
reflected in Budget Amendment No. 4, attached hereto.
NOW THEREFORE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS ACTING IN THE
EXERCISE OF THEIR HOME RULE POWERS:

SUBJECT: KENSINGTON ROAD JURISDICTIONAL TRANSFER
BACKGROUND
In conjunction with the Kensington Road Improvements and the recent Local Agency
Agreement that the Village has entered into with the Illinois Department of
Transportation (IDOT), the Village is required to pass an ordinance providing for the
jurisdictional transfer of Kensington Road, from Forest Avenue to Route 83, from IDOT
to the Village of Mount Prospect. This jurisdictional transfer will become effective 7 days
after the completion of the improvements and final inspection and acceptance of the
work by IDOT. Following the jurisdictional transfer, this section of Kensington Road will
be added to the Village's municipal street system and the Village will have maintenance
requirements for the completed improvements.
DISCUSSION
This is similar to jurisdictional transfers that the Village and IDOT have entered into for
previous projects involving Central Road and Wolf Road. The project bid opening was
Friday, January 18, 2013. It is anticipated that following contract award the construction
will start this spring and be completed this year.
RECOMMENDATION
It is my recommendation that the Village Board pass an ordinance accepting jurisdictional
transfer of Kensington Road from the Village limits at the west Right -of -Way line of
Forest Avenue to the west curb line of Route 83 upon acceptance of the improvements
by IDOT and that this be placed on the agenda for the February 5, 2013 Village Board
Meeting.

RESOLUTION NO. 49 -12
A RESOLUTION AUTHORIZING THE VILLAGE OF MOUNT PROSPECT
TO EXECUTE INTERGOVERNMENTAL AGREEMENTS WITH
THE ILLINOIS DEPARTMENT OF TRANSPORTATION (IDOT)
FOR KENSINGTON ROAD IMPROVEMENTS
WHEREAS, the Village of Mount Prospect (the "Village ") is a home rule unit of government
pursuant to the Illinois Constitution of 1970; and
WHEREAS, Article VII, Section 10 of the Illinois Constitution of 1970 and the Intergovernmental
Cooperative Act, 5 ILCS 220/1 et seq., authorize public agencies to contract or otherwise
associate among themselves to obtain or share services, and to exercise, combine or transfer
any power or function, in any manner not prohibited by law; and
WHEREAS, the Village and the Illinois Department of Transportation ( "IDOT ") are "public
agencies" as defined in the Intergovernmental Cooperative Act, 5 ILCS 220/1 et seq.; and
WHEREAS, the Village is seeking to have improvements made to Kensington Road, between
Prospect High School and Route 83, which improvements include, among other things, complete
pavement reconstruction, right turn lanes at Route 12 and Route 83, widening to a three (3) lane
cross section, and storm sewer, sidewalk and street light improvements (the "Kensington Road
Improvement Project "); and
WHEREAS, the Northwest Council of Mayors has approved federal funding for the design
engineering, construction engineering, and construction of the Kensington Road Improvement
Project; and
WHEREAS, IDOT has agreed to participate in the Kensington Road Improvement Project by
providing State of Illinois funding in exchange for the Village's agreement to accept jurisdiction of
Kensington Road from Forest Avenue to Illinois Route 83; and
WHEREAS, IDOT's participation further requires the Village to enter into the following
intergovernmental agreements with IDOT: 1) Construction Engineering Services Agreement for
Federal Participation and 2) Local Agency Agreement for Federal Participation; and
WHEREAS, the State of Illinois will transfer maintenance and jurisdiction of the roadway to the
Village upon completion of the Kensington Road Improvements; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect has deemed
that the best interests of the Village will be served by entering into the Intergovernmental
Agreements.
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, PURSUANT TO ITS
HOME RULE POWERS AND AUTHORITY SET FORTH IN THE ILLINOIS CONSTITUTION OF
1970 AND ILLINOIS INTERGOVERNMENTAL COOPERATION ACT (5 ILCS 220/1 ET SEQ .),

Jurisdictional Transfer (hereinafter the "Transfer Agreement ") with the Illinois Department of
Transportation ( "IDOT ") to transfer jurisdiction of Kensington Road, from Forest Avenue to
Route 83, to the Village from IDOT upon completion of certain improvements to Kensington
Road, from Forest Avenue to Route 83, known as Job No. C -91- 875 -09 (hereinafter, the
"Improvement "), a copy of which Agreement is attached hereto as Exhibit A and incorporated
herein by reference; and
WHEREAS, pursuant to the Transfer Agreement, the Village of Mount Prospect agreed to
assume jurisdiction and maintenance of Kensington Road from Forest Avenue to Route 83
seven (7) days after final inspection and acceptance of the Improvement by IDOT; and
WHEREAS, it is in the best interests of the Village of Mount Prospect to assume said jurisdiction
pursuant to the Agreement .
NOW, THEREFORE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, ACTING IN THE
EXERCISE OF ITS HOME RULE POWERS:
SECTION ONE That the Village of Mount Prospect shall assume jurisdiction and maintenance
of Kensington Road, from Forest Avenue to Route 83, seven (7) days after the final inspection
and acceptance of the completed Improvement by IDOT, known as Job No. C -91- 875 -09.
SECTION TWO That upon the Village of Mount Prospect's assumption of jurisdiction and
maintenance as described in Section One, Kensington Road from Forest Avenue to Route 83,
shall be added to the Village's Municipal Street System.
SECTION THREE The Village Clerk is hereby directed to forward a copy of this ordinance to
the State of Illinois through its District Engineer's Office at 201 West Center Court, Schaumburg,
Illinois 60193.
SECTION FOUR This Ordinance shall be in full force and effect from and after its passage in
the manner provided by law.

WHEREAS, the authority to enter into this contract is granted the STATE by Section 4 -409 of the Illinois Highway Code and

transfer of the above location and shall attach hereto and make a part hereof a copy of a location map as Addendum No. 1
and a copy of the ordinance as Addendum No. 2, and

WHEREAS, the authority to make changes to the County Highway System is granted to the County by Section 5 -105 of the
Illinois Highway Code.
NOW THEREFORE IT IS AGREED that the County Board of said County will pass a resolution providing for the transfer of
the above location and shall attach hereto and make a part hereof a copy of a location map as Addendum No, 1 and a copy
of the resolution as Addendum No. 2, and

WHEREAS, the authority to make changes to the Township /Road District System is granted to the Highway Commissioner
under Section 6 -201.3 of the Illinois Highway Code and said Highway Commissioner shall attach hereto and make a part
hereof a copy of a location map as Addendum No. 1, and
