JANONIS, VILLAGE MANAGER FROM: DIRECTOR OF COMMUNITY DEVELOPMENT DATE: JANUARY 15, 2013 SUBJECT: POTENTIAL TEXT AMENDMENTS — PREVIEW The Department of Community Development is in the process of drafting text amendments to the Zoning Code and Sign Code. Revisions include the following topics, which are anticipated to be brought to the Board in the spring of 2013. • Use table — An update would include businesses found in the Village but not currently included in the table. Uses that are outdated or redundant would be removed. • Accessory Structures — Updates to Section 14.306 would include regulations regarding the location of residential generators and pergolas. Restrictions to the location, size, and design of donation boxes are also proposed. • Fences — Regulations regarding the location and type of fencing permitted in exterior side yards would be updated. Also included are clarifications regarding the measurement of fence height as well as related definitions. • Parking Requirements — Updates addressing parking requirements for the re -use of existing buildings within the downtown zoning districts of B5 and 135C would be proposed. Modifications may include a reduction in the number of required on -site parking spaces for certain types of re- use, either by instituting a credit system based upon building square footage or by permitting the inclusion of on- street parking when determining the number of required parking spaces. • Amateur Radio — The proposed amendments would ensure compliance with the recently adopted state legislation limiting local municipalities from restricting antennas or antenna support structures that are used for amateur radio ( "ham" radio) communications. • Illumination Standards — Amendments to the illumination standards would correct discrepancies between the current parking lot lighting regulations and the general site lighting regulations. Updates would also ensure the code is up to date with modern lighting standards. • Definitions — Additional terms would be added and existing terms modified within the definition section of the Zoning Code. Automobile Fueling Station, Beauty Shop, Massage Therapy and Pergola would have definitions. Canopy and Sight Triangle would have modifications to existing definitions to help clarify existing zoning regulations. • Landscaping — A general clean -up of existing language would be completed to provide more accurate application of the current regulations. An update to the plant list would also be included reflect desired plant species as recommended by the Village Forester. Page 2 January 15, 2013 Sign Code Regulations — Amendments would include a definition of Sight Triangle that is consistent with the Zoning Code, and a Sidewalk Sign definition. Details regarding landscaping required at the base of signs would be drafted and including an appeal process would be outlined for those seeking relief for signage. The proposed amendments are tentatively scheduled for Planning & Zoning Commission review in April or May of this year, and will be presented to the Village Board concurrent with planned amendments to the Building and Property Maintenance Codes. Please forward this memorandum to the Village Board for their review and consideration at their January 22, 2013 meeting.
