ORDINANCE NO. 3066
AN ORDINANCE GRANTING SPECIFIED VARIATIONS FOR ~
PROPERTY AT MT. PROSPECT PLAZA, RAND & CENTRAL ROADS
, Maisel & Associates of Michigan (who' shall be referred
as "Petitioner") is the lessee of a parcel of property known
Mt. Prospect Plaza, Rand & Central Roads, in the Village of
Prospect, County of Cook, State of Illinois (hereinafter
to as the "Subject Property"); and
the Subject Property is legally described as follows:
SHOPPING CENTER PROPERTY
Parcel 1: That part of the south 1322.31
feet (measured along East line of said tract) of
the E 1/2 of the SW 1/4 of Section 35, Township
42 North, Range 11, East of the Third Principal
Meridian, lying NE'ly of center of Rand Road
(except that part of the South 50 feet thereof
lying NE'ly of the NE'ly line of said Rand Road
taken for highway purposes), and (except the
East 40 feet thereof lying North of the SOuth 50
feet thereof, dedicated for public Street per
plat of dedication recorded February 19, 1969,
per Doc. No. 20761400).
Also:
Parcel 2:' The SW 1/4 of the SW 1/4 section
35, aforesaid: (exCepting from said tract that
part thereof lying W'ly of Rand Roa~), all in
Cook County, Illinois

That part of Lot 1 in Plaza Subdivision in
the Southwest 1/4 of Section 35, Township 42
North, Range 11 East of the Third Principal
Meridian recorded July 16, 1979, as Document No.
3104778 described as follows: Commencing at the
Southeast corner of Lot 1; thence North 0 degrees
000 minutes 00 seconds West 750.66 feet along
the East line of said Lot 1; thence North 90
degrees 00 minutes 00 seconds West 230.47 feet
to the point of beginning of the tract herein
described; thence North 63 degrees 19 minutes 07
seconds West 385.00 feet; thence North 26 degrees
40 minutes 53 seconds East 255.00 feet; thence
South 63 degrees 19 minutes 07 seconds East
385.00 feet; thence South 26 degrees 40 minutes
53 seconds West 255.00 feet to the hereinabove
designated point of beginning, in Cook County,
Illinois;
and
WHEREAS, the Subject Propert~ is located in the B-3 Business
Retail and Service District under the provisions of the Zoning
rdinance of the Village of Mount Prospect (hereinafter referred
~o as the "Zoning Ordinance"); and
~HEREAS, Petitioner has heretofore filed an application seeking
zhe following variation' from the provisions of the Zoning
)rdinance:
A variation from Section 14.2602.B.35 of Article
XXVI of the Zoning Ordinance to permit off-street
parking spaces next to the K-Mart building on
the Subject Property to be twenty (20) feet x
nine (9) feet instead of the required twenty
(20) feet x ten (10) feet;

~HEREAS, a public hearing was held on the Petitioner's request
for the aforesaid variation, which request is known as ZB;
before the Zoning Board of Appeals of the Village of Mount
Prospect on September 25, 1980, pursuant to proper public
notice published in the Mount Prospect Herald on September 8,
1980; and
~HEREAS, the Zoning Board of Appeals has recommended to the
Building Committee of the Board of Trustees of the Village of
~ount ProsPect that Petitioner's request for the aforesaid
variation, ZBA-46-V-80, be granted; and
WHEREAS, the President and Board of Trustees have considered
the Petitioner's request and reviewed the recommendation of the
Village of Mount Prospect Zoning Board of Appeals~ in ZBA-46-V-80
and
WHEREAS~ the President and Board of ~rustees of the Village of
Mount Prospect have determined that with respect to the Peti-
tioner's · requested variation, that Petitioner has satisfied the
standards for the grant of variation set forth in Section
14.605 of Article VI of the Zoning Ordinance and find that it
would be in the best interest of the Village of Mount Prospect
to grant Petitioner the requested variation.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOLrNT PROSPECT, COOK COUNTY, ILLINOIS
as follows:
SECTION ONE: The recitals set forth hereinabove are incorpor-
ated herein as findings of fact by the President and Board of
Trustees of the Village of Mount ProsPect.
SECTION TWO: The President and Board of Trustees of the Village
iof Mount Prospect hereby grant the following variation:
A variation from Section 14.2602.B.35 of Article
X/~VI of the Zoning Ordinance to permit off-street
parking spaces next to the K-Mart building, in
the area indicated on Exhibit A attached hereto,
to be twenty (20) feet x nine (9) feet instead
of the required twenty (20) feet x ten (10) feet,
for a parcel of real estate legally described as follows:

Southeast'corner of Lot 1; thence NOrth 0 degrees
000 minutes 00 seconds West 750.66 feet along
the East line of said Lot 1; thence North 90
degrees 00 minutes 00 seconds west 230.47 feet
to the point of beginning of the tract herein
described; thence North 63 degrees 19 minutes 07
seconds West 3.85.00 feet; thence North 26 degrees
40 minutes 53 seconds East 255~00 feet; thence
South 63 degrees 19 minutes 07 seconds East
385.00 feet; thence South 26 degree~.%0 minutes

SECTION THREE: Except for the variation granted herein, all
other applicable Village of Mount Prospect ordinances shall'
remain in full force and effect as to the Subject Property..
SECTION FOUR: This Ordinance shall be in full force and effect
from and after its passage, approval, and pubiiCation in the
manner proVided by law.
