ORDINANCE NO. 3090
AN ORDINANCE AMENDING MAP 9-N OF THE ZONING
ORDINANCE OF THE VILLAGE OF MOUNT PROSPECT
WHEREAS, Carl Magnini and Anfionette Magnini (who shall be referred to as
"Petitioner") are the owners of a parcel of property located at 705 East Rand Road
in the Village of Mount Prospect, Cook County, Illinois, (hereinafter referred
to as the "Subject Property"); and
WHEREAS, the Subject Property is legally described as follows:
Part of the northwest 1/4 of the southwest 1/4
of Section 35, Township 42 North, Range 11
east of the third principal meridian,
described as follows: Commencing in the west
line of said northwest 1/4 of the southwest
1/4, at a point 421 feet north of the south-
west corner of said northwest 1/4 of the
southwest 1/4; thence east parallel with the
south line of said northwest 1/4 of the south-
west 1/4, for a distance of 188.19 feet, to an
intersection with the center line of Rand
Road; thence northerly along said center line,
for a distance of of 378.33 feet to an inter-
section with the west line of said northwest
1/4 of the southwest 1/4; thence south, for a
distance of 327.21 feet, to place of begin-
ning, in Cook County, Illinois.
WHEREAS, the Subject Property is located in the R-1 Single Family Residence
District under the provisions of the Zoning Ordinance of the Village of
Mount Prospect (hereinafter referred to as the "Zoning Ordinance"): and
WHEREAS, the former owner of the Subject Property has heretofore filed an
application seeking rezordng of the subject property to B-4 Business -Retail
and Service District under Case No. ZBA 23-Z-79; and
WHEREAS, the Building Committee of the Board of Trustees of the Village of
Mount Prospect did recommend the Subject Property be re-zoned from
R-1 Single Family Residence District to B-3 Business - Retail and Service
District; and
WHEREAS ~ public hearing was held on the request for the aforesaid rezoning
under Case No. ZBA 23-Z-79, before the Zoning Board of Appeals of the
Village of Mount Prospect on May 30, 1979, and continued to July 6, 1979,
and August 8, 1979, pursuant to proper public notice published in the
Mount Prospect Herald on May 4, 1979; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect
have considered the recommendation of the Building Committee of the Village of
Mount Prospect and have determined that the best interests of the Village of
Mount Prospect will be attained by the adoption of the following Ordinance

regarding the Subject Property.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The recitals set forth hereinabove are incorporated herein as
findings of fact by the President and Board of Trustees of the Village of
Mount Prospect.
SECTION TWO: That Map 9-N of the Zoning Ordinance of the Village of
Mount Prospect, as amended, be and the same is hereby further amended by
reclassifying from R-1 Single Family Residence District to B-3 Business -
Retail and Service District, the following described property:
Part of the northwest 1/4 of the southwest 1/4
of Section 35, Township 42 North, Range 11
east of the third principal meridian,
described as follows: Commencing in the west

ning, in Cook County, Illinois.
SECTION THREE: The amendment set forth in SECTION TWO hereinabove
is granted subject to the condition that the Owner of the Subject Property shall
dedicate to the Village of Mount Prospect a sixteen foot (16') right-of-way
along Louis Street as indicated on Exhibit A attached hereto.
SECTION FOUR: This Ordinance shall be in full force and effect from and
after its passage, approval and pUblication in the manner provided by law.
