AN ORDINANCE GRANTING SPECIFIED VARIATIONS FOR
PROPERTY LOCATED AT 705 EAST RAND ROAD
Carl Magnini and Antionette Magnini (who shall be referred to as
"Petitioner") are the owners of a parcel of property located at 705 East Rand Road
the Village of Mount Prospect, Cook County, Illinois, (hereinafter referred
as the "Subject Property"); and
the Subject Property is legally described as follows:
Part of the northwest 1/4 of the southwest 1/4
of Section 35, Township 42 North, Range 11
east of the third principal meridian,
described as follows: Commencing in the west
line of said northwest 1/4 of the southwest
1/4, at a point 421 feet north of the south-
west corner of said northwest 1/4 of the
southwest 1/4; thence east parallel with the
south line of said northwest 1/4 of the south-
west 1/4, for a distance of 188.19 feet, to an
intersection with the center line of Rand
Road; thence northerly along said center line,
for a distance of of 378.33 feet to an inter-
section with the west line of said northwest
1/4 of the southwest 1/4; thence south, for a
distance of 327.21 feet, to place of begin-
ning, in Cook County, Illinois.
, the Zoning Board of Appeals of the Village of Mount Prospect did
public hearings for Case No~. ZBA 52-V-80 on November 20, 1980 and
'anuary 22, 1981, pursuant to proper legal notices published in the Mount Prospect
[erald on November 4, 1980 and January 5, 1981; and
Petitioner heretofore filed an application seeking the following
from the provisions of the Zoning Ordinance of the Village of
{ount Prospect:
A sixteen foot (16') variation from Section i4.2002.B. 2 of'
Article XX of the Zoning Ordinance to permit a four foot (4')
side yard on the west side of the Subject Property instead
of the required twenty foot (20') side yard.
A seven foot (7') variation from Section 14.2002.B.2 of
Article XX of the Zoning Ordinance to permit a three foot (3')
side yard on that portion of the south side of the Subject
Property, as shown on Exhibit A attached hereto, instead
of the required ten foot (10') side yard.
A variation from Section 14. 2602 .B. 24 of Article XXVI of
the Zoning Ordinance to provide a truck loading space
ten feet (10') by twenty-five feet (25') instead of the
required ten feet (10') by fifty feet (50') and that the
truck loading space be located to the west side of the
parking lot adjacent to Louis Street, as shown on the
site plan attached hereto as Exhibit "A".
A variation from Section 14.2602.B. 52 of Article XXArI
of the Zoning Ordinance to allow provisions for off-
street parking within sixteen feet (16') of the required
twenty feet (20') of the exterior side yard and within
seven feet (7') of the required ten feet (I0') of the

interior side yard.
A variation from Section 14. 2602.B. 35 of Article XXVI of
the Zoning Ordinance to allow off-street parking spaces
on the Subject Property to measure twenty feet (20') by
nine feet (9') instead of the required twenty feet (20') by
ten feet (10').
A variation from Section 14.101.F of Article I of the
Zoning Ordinance to permit occupancy of the Subject
Property by four uses instead of the permitted single
use.
~:HEREAS, the President and Board of Trustees of the Village of },fount Prospect
~ave determined that the standards set forth in Section 14. 605 of Article VI of
:he Zoning Ordinance have been met and that it would be in the best interest
)f the Village of Mount Prospect to grant the variations requested herein.
gOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEE~
THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The recitals set forth hereinabove are incorporated herein as
!indings of fact by the President and Board of Trustees of the Village of
%~Iount Prospect.
SECTION TV~O: The property being the subject of Case No. ZBA 52-V-80
)eing legally described as follows:

eCUrrently zoned B-3 under the Zoning Ordinance of the Village of
ount Prospect, and subject to the conditions set forth in SECTION THREE
reinafter, the President and Board of Trustees of the Village of Mount Prospect
reby grant the following variations:
A sixteen foot (16') variation from Section 14.2002 .B .2 of
Article XX of the Zoning Ordinance to permit a four foot (4')
side yard on the west side of the Subject Property instead

of the required twenty foot (20') side yard.
2. A seven foot (7') variation from Section 14.2002.B.2 of
Article XX of the Zoning Ordinance to permit a three foot
side yard on that portion of the south side of the Subject
Property, as shown on Exhibit A attached hereto, instead
of the required ten foot (10') side yard.
3. A variation from Section 14. 2602.B. 24 of Article XXVI of
the Zoning Ordinance to provide a truck loading space
ten feet (10') by t~Tenty-five feet (25') instead of the
required ten feet (10') by fifty feet (50') and that the
truck loading space be located to the west side of the
parking lot adjacent to Louis Street, as shown on the
site plan attached hereto as Exhibit "A".
4. A variation from Section 14. 2602.B.52 of Article XX-VI
of the Zoning Ordinance to allow provisions for off-
street parking within sixteen feet (16') of the required
twenty feet (20') of the exterior side yard and within
seven feet (7') of the required ten feet (10') of the
interior side yard.
5. A variation from Section 14.2602.B. 35 of Article XX-VI of
the Zoning Ordinance to allow off-street parking spaces
on the Subject Property to measure twenty feet (20') by
nine feet (9') instead of the required twenty feet (20')
ten feet (10').
A variation from Section 14.101.F of Article I of the
Zoning Ordinance to permit occupancy of the Subject
Property by four uses instead of the permitted single
use.
SECTION THREE: The variations set forth in SECTION TWO hereinah.ove
are granted subject to the condition that there shall be no driveway access
permitted from the Subject Property to Louis Street.
SECTION FOUR: No certificate of occupancy shall be issued for tke
Subject Property until the owner has caused a plat of subdivision
indicating the dedication of a sixteen foot (16') right-of-way along
Louis Street to be recorded with the Cook County Recorder of Deeds cr
registered with the Cook County Registrar, whichever the case may ~e.
SECTION FIVE: Except for the variations granted herein, all other
applicable Village of l%~_ount Prospect ordinances shall remain in h:]] ferce

and effect as to the Subject Property.
SECTION SIX: This Ordinance shall be in full force and effect from and
after its passage, approval and publication in the manner provided by law.
