AN ORDINANCE AMENDING ORDINANCE NO. 2789
WHEREAS, Robert E. Boles (who shall be referred to as "Petitioner") is the
beneficiary of a trust which holds title to a parcel of property located at
101 E. Rand Road in the Village of l~_ount Prospect, Cook County, Illinois
(hereinafter referred to as the "Subject Property"); and
]VHERAS, the Subject Property is legally described as follows:
Lot One (1) in N.J. Funks Subdivision of the
South 150 feet of the North 511.60 feet of
that part of the Northwest 1/4 of the North-
west 1/4, lying West of the center line of
Rand Road in Section 34, Township 42 North,
Range 11, East of the Third Principal
Meridian, in Cook County, Illinois.
WIIEREAS, the Subject Property is located in the B-3 (Business - Retail and
Service District) under the provisions of the Zoning Ordinance of the Village
of Mount Prospect (hereinafter referred to as the "Zoning Ordinance"); and
B,q-IEREAS, Petitioner has heretofore filed an application seeking an amendment
to Special Use Ordinance No. 2789 in order to permit sales of gasoline without
the sale of other merchandise on the Subject Property; and
W}iEREAS, a public hearing was held on the Petitioner's request for the
aforesaid amendment, which request is known as ZBA 1-A-81, before the
Zoning Board of Appeals of the Village of Mount Prospect on January 22, 1981,
pursuant to proper public notice published in the Mount Prospect Herald on
January 5, 1981; and
WHEREAS, the Zoning Board of Appeals has recommended to the Building
Committee of the Village of ~,~ount Prospect that Petitioner's request for the
aforesaid amendment be granted; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect
have considered the Petitioner's request and reviewed the recommendation of
the Zoning Board of Appeals in ZBA 1-A-81; and
IYHEREAS, the President and Board of Trustees of the Village of ~ount Prospect
have determined that it would be in the best interest of the Village of
l~ount Prospect to grant the request herein.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUST
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The recitals set forth hereinabove are incorporated herein as
findings of fact by the President and Board of Trustees of the Village of
Mount Prospect.
SECTION TWO: That Special Use Ordinance No. 2789 be and the same is
hereby amended by deleting therefrom paragraph C of SECTION ONE.
SECTION THREE: This Ordinance shall be in full force and effect from and

after its passage, approval and publication in the manner provided by law.

SUBJECT: ZBA-1-A-81 and ZBA-2-V-81, 101 East Rand Road (Hap 16-N)
Robert Boles, Petitioner
DATE: April 3, 1981
At the Village Board's direction, I met with Hr. Boles to
discuss refinement of screening elements for his property at
101 East Rand Road. A revised sketch indicates the screening
as proposed to be provided by Mr. Boles consisting of the
following:
1. Sod in the public parkways
e
Extension of 5 foot sidewalk with depressed curbs for
handicapped access in the public parkways.
Installation of three street trees to be planted by the
Village, funds to be provided by Mr. Boles.
Closing off the Southeastern most driveway and extending
public parkway improvements including sod, sidewalk and
street tree.
Off-street parking %o be located adjacent to the building
approximately 50 feet back from the property line in
perpendicular spaces of 9'x20'.
Site improvements to include a small area of blacktop to
permit full access to the automotive garage facility at
the West end of %he property and also general site cleanup
for the balance of the property.
The State of Illinois must first approve the landscaping proposed
and it is my understanding that Mr. Boles has gotten their
approval based on this plan submitted to the Village.
