AN ORDINANCE GRANTING SPECIFIED VARIATIONS FOR
PROPERTY AT 101 EAST RANI) ROAD
WHEREAS, Robert E. Boles (hereinafter referred to as "Petitioner") is the
beneficiary of a trust which holds title to a parcel of property located at
101 East Rand Road in the Village of A~ount Prospect, Cook County, Illinois
(hereinafter referred to as "Subject Property"); and
¥,q{EREAS, the Subject Property is legally described as follows:
Lot One (1) in N.J. Funks Subdivision of the
South 150 feet of the North 511.60 feet of
that part of the Northwest 1/4 of the North-
west 1/4, lying West of the center line of
Rand Road in Section 34, Township 42 North,
Range 11, East of the Third Principal
Meridian, in Cook County, Illinois.
%~-HEREAS, the Subject Property is located in the B-3 Business - Retail 8_nd
Service District under the provisions of the Zoning Ordinance of the Village of
Mount Prospect (hereinafter referred to as "Zoning Ordinance"); and
WHEREAS, Petitioner has hereto filed an application seeking the following
varations from the provisions of the Zoning Ordinance:
A variation from section 14.101.F of Article I of the
Zoning Ordinance to allow three main uses on the Subject
Property instead of the permitted single use.
A variation from Section 14.202.B .1 of Article XX of
the Zoning Ordinance to permit a south side yard of from
0.97 feet to 1.11 feet instead of the required three foot
side yard.
IYHEREAS, a public hearing was held on the Petitioner's request for the
aforesaid variations, which request is known as ZBA 2-V-81, before the
Zoning Board of Appeals of the Village of l{ount Prospect on January 22, 1981,
pursuant to proper public notice published in the Mount Prospect Herald on
January 5, 1981; and
WHEREAS, the Zoning Board of Appeals has recommended to the Building
Committee of the Board of Trustees of the Village of l'~ount Prospect that
the Petitioner's request for the aforesaid variations under ZBA 2-V-81
be granted; and
YJHEREAS, the President and Board of Trustees have considered the
Petitioner's request and reviewed the recommendation of the Zoning Board
- of Appeals in ZBA 2-V-81; and
I%/4EREAS, the President and Board of Trustees of the Village of
Mount Prospect have determined that with respect to the Petitioner's requested

variations, the Petitioner has satisfied the standards for the grant of variations
set forth in Section 14. 605 of Article VI of the Zoning Ordinance and find thai
it would be in the best interest of the Village of B'?ount Prospect to grant'
Petitioner the requested variations.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUS3
DF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The recitals set forth hereinabove are incorporated herein as
findings of fa'et by the President and Poard of Trustees of the Village of
~ount Prospect.
SECTION TWO: Subject to the conditions set forth in SECTION THREE
herein, the President and Board of Trustees of the Village of ]~ount Prospect
~ereby grant the following variations:
1. A variation from Section 14.101.F of Article I of the
Zoning Ordinance to allow three main uses on the Subject
Property instead of the permitted single use.
2. A variation from Section 14. 202.P.1 of Article XX of
the Zoning Ordinance to permit a south side yard of from
0.97 feet to 1.11 feet instead of the required three foot
side yard.
iECTION THREE: The variations set forth in SECTION TWO above are
ubject to the following conditions:
Landscaping and pavement shall conform to the site plan
attached hereto as Exhibit A. In addition, the owner of
the Subject Property shall provide and maintain such
screening as is directed by the Department of Community
Development of the Village of l'Iount Prospect.
No vehicle which is not in an operable condition shall
be parked or otherwise left on the Subject Property
unless it is fully enclosed within the structure situated
on the Subject Property.

ECTION FOUR: Except for the variations granted herein, all other

effect as to the Subject ProperW.
