RDINANCE NO. 3128 AN ORDINANCE GRANTING SPECIFIED VARIATIONS FOR PROPERTY AT 2'18 S©UTH LOUIS 'STREET WHEREAS, STANLEY FEDKO (hereinafter referred to as the "Petitione is the owner of a certain parcel of residentially improved proper located at 218 South Louis Street in the Village of Mount Propsec~ Cook County, Illinois (hereinafter referred to as the "Subject Property"); and WHEREAS, the Subject Property is legally described as follows: Lot 9 in Block 19 all in Busse's Eastern Addition to Mount Prospect in the East one-half (1/2) of Section 12, Township 41 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois; and WHEREAS, the Subject Property is located in the R-1 District - Single Family Residence District under the provisions of Chapter 14 of the Municmpal Code of the Village of Mount Prospect (hereinafter referred to as the "Zoning Ordinance"); and WHEREAS, Petitioner has hereto filed an application seeking the following variations from the provisions of the Zoning Ordinance: 1. A variation from Section 14.1102 of Article XI of the Zoning ordinance to allow an exception to the Lot and Bulk Regulations regarding permissible obstruction within front yard areas of an R-1 District to allow for the parking of one motor vehicle in the front yard area. 2. A variation from Section 14.2602 of Article XXVI of the Zoning Ordinance permit as a permitted obstruction within the definition of a "yard" driveways providing an off-street parking area as well as ingress and egress to a lot. Incorporated within this request ifs Petitioner's plan to expand his existing driveway to a maximum width of 20 feet to provide an additional parking area to the side of the entrance into and out of Petitioner's single car garage; and WHEREAS, public hearing was held on Petitioner's request for the aforesaid variations, which request is known as ZBA 6-V-81, befor the Zoning Board of Appeals of the Village of Mount Prospect on May 28, 1981 and again on June 25, 1981 pursuant to due and proper notice published in the Mount Prospect' ~'e'ra'ld; and WHEREAS, the Zoning Board of Appeals has recommended to the Board of Trustees of the Village of Mount Prospect that the Petitioner's request for the aforesaid variations under ZBA 6-V-8 be granted subject to Petitioner's first submitting Plans %o the Village regarding the design of Petitioner's driveway expansi, and the retaining wall running along the Northerly boundary thereof, and Petitioner's obtaining the written approval of Mrs. Helen Medal, the adjoining neighbor to the North of Petition, property, concerning said driveway expansion and retaining wall design by no later than two (2) weeks following submission of said Plans; and HEREAS, Petitioner's proposed driveway expansion is set forth and designated on the Plat which is attached hereto, labeled "Exhibit A" and herein adopted by reference; and WHEREAS, the President and Board of Trustees have considered the Petitioner's request and reviewed the recommendation of the Zoning Board of Appeals in ZBA 6-V-81; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have determined that Petitioner's variation requests satisfy the standards for the granting thereof as set forth in Section 14.605 of Article VI of the Zoning Ordinance and further find that it would be in the best interests of the Village of Mount Prospect to grant Petitioner the requested variations, subject to the condition of prior approval of Petitioner's plans and design for driveway expansion and retainin wall. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: Subject to the conditions hereinafter set forth, the President and Board of Trustees of the Village of Mount Prospect hereby grant Petitioner variations from the Lot and Bul~ Regula- tions and yard obstructions ~f the Zoning Ordinance in Single Family Residence Districts to allow Petitioner to expand his driveway on his single family residence property to maximum width of 20 feet and to use a portion of said driveway for the purpose of parking one motor vehicle in the front yard driveway area. i SECTION THREE: The variations set forth in Section Two above fare subject to the following conditions: 1. Petitioner's driveway Expansion ~lans and design, including the required retaining wall on the North driveway line, shall be first submitted to the Village and approved in writing by Mrs. Helen Medal of 216 South Louis Street, within two (2) weeks of such submission as a prerequisite to any driveway ex- pansion. 2. The driveway expansion shall ConfOrm to the area designat on the Plat attached hereto as "Exhibit A". 3. No vehicle which is not in an operable condition shall be parked, stored, or otherwise left on the Subject Property unless it is fully enclosed within the garage situated on the Subject property. 4. Said variations are granted herein to allow Petitioner to maintain and park a second passenger vehicle on the driveway area in the front yard of the Subject ~roperty. In the event that Petitioner, or his assigns or successors in title or interes to the Subject Property shall own and maintain only one motor vehicle, then said vehicle shall be parked in the garage situated on the Subject Property. SECTION FOUR: The variations granted herein relate to property legally described as Lot 9 in Block 19 all in Busse's Eastern Addition to Mount Prospect in the East half (1/2) of Section 12, TownShip 41, North, Range 11, East of the Third Principal Meridi~ in Cook County, Illinois and commonly known as 218 South Louis Street, Mount Prospect, Illinois. ECTION FIVE: Except for the variations granted herein, all other applicable Regulations and Provisions of the Zoning Ordinance of the Village of Mount Prospect shall remain in full force and effect as to the Subject Property. SECTION SIX: This Ordinance shall be in full force and effect from and after its passage, approval and publication in the provided by law. PASSED this 4 th day of August , 1981.
