AN ORDINANCE AMENDING ZONING MAP NO. 8-S
WITH RESPECT TO THE ZONING OF A CERTAIN
PUBLIC PARKING LOT IN THE P-2 OFF-STREET
PARKING DISTRICT, IN THE VILLAGE OF MOUNT
PROSPECT, ILLINOIS
%~tEREAS, Kenneth H. Fritz, the Director of Community
Development of this Village, has made application, on behalf of
this Village, to rezone certain property located at the Southeast
corner of East Prospect Avenue and South Maple Street in the Village
of Mount Prospect, Illinois (hereinafter referred to as the "Subject
Property") and currently used as a public parking lot, from its
present zoning classification in the B-3 and P-1 Districts to the
P-2 Off-Street Parking District as provided in Article XXIV of
Chapter 14 of the Village Code of Mount Prospect, Illinois; and
WHEREAS, the Subject Property is legally described as' follows:
Corporate Subdivision No. IO-A of the Village of Mount
Prospect, Cook County, Illinois, being a resubdivision of
Lot "A" in Boesche's Resubdivi~ion of that part of the
Northwest 1/4 of Section 12, Township 41 North, Range 11
East of the Third Principal Meridian, described as follows:
Commencing at the Southeast corner of the Northwest 1/4
of said Section 12, running thence Westerly along the
South line of said Northwest 1/4, 754.84 feet; thence
North parallel with the East line of said Northwest 1/4,
a distance of 638.78 feet to the point of beginning of
the tract of land being described herein; thence
continuing North along said parallel line a distance
of 318.45 feet t6 the Southerly line of the right-of-way
of the Wisconsin Division of the Chicago and Northwestern
Railway; thence Southeasterly along said Southerly line
of right-of-way, a distance of 175.25; thence South
parallel with the East line of said Northwest 1/4, a
distance of 232.89 feet; thence Westerly parallel with
the South line of said Northwest 1/4, 150.0 feet to the
point of beginning (excepting therefrom the Westerly 33.0
feet and also excepting the Northeasterly 66.0 feet
thereof), together with Lot i in J. A. Weber's Addition
to Mount Prospect, being a Subdivision of part of the
East 1/2 of the Northwest 1/4 of Section 12, Township 41
North, Range 11 East of the Third Principal Meridian,
in Cook County, Illinois
together with
Lot "A" in Corporate Subdivision Number 10, Village of
Mount Prospect, Cook County, Illinois, being a subdivision
of Lots 2, 3, 4, 5, 6, 7, 8 and 9 in J. A. Weber's Addition
to Mount Prospect, being a Subdivision of part of the
East 1/2 of the Northwest 1/4 of Section 12, Township 41
No.rth, Range 11 East of the Third Principal Meridian, in
Cook County, Illinois.
~.~HEREAS, the use of the Subject Property in its existing
zoning classifications constitutes a non-conforming use, and the
requested rezoning to a P-2 Off-Street Parking District for the
sole use of the property as a paved off-street parking lot for
for-fee storage of moving passenger vehicles will place the property
under zoning classification wherein its parking lot use will
become a permitted use; and
WHEREAS, a public hearing was held on the said rezoning
apPlication (designated as case No. ZBA 14-A-81) before the Zoning
Board of Appeals of this Village on August 27, 1981 pursuant to
proper publication of due notice thereof in the Mount Prospect
Herald on August 3, 1981; and
WHEREAS, the Zoning Board of Appeals has recommended to the
Building Committee of the Board of Trustees of the Village that
the requested rezoning be granted; and
WHEREAS, the President and Board of Trustees have considered
the requested rezoning application and have reviewed the recommendation
of the Zoning Board of Appeals pertaining thereto and have determined
that the best interest of the Village of Mount Prolspect will be
obtained by the adoption of the necessary Ordinance to accomplish
said rezoning.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
'TRUSTEES FOR THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The recitals set forth hereinabove are incorporated
herein as findings of fact by the President and Board of Trustees
of the Village of Mount Prospect.
SECTION TWO: Zoning Map No. 8-S pertaining to Chapter 14
entitled "Zoning" of the Village Code of Mount Prospect, Illinois,
as amended, is hereby further amended by reclassifying from B-3
Business Retail and Service District and P-1 Off-Street Parking
District to P-2 Off-Street Parking District the following described

Cook County, Illinois..
SECTION THREE: This Ordinance shall be full force and effect
from and after its passage, approval and publication in pamphlet
form in the manner provided by law.
