AN ORDINANCE AUTHORIZING A SPECIAL USE PERMIT
FOR A DAY CARE HOME AT 1904 CHOLO LANE
WHEREAS, GAY HEWGLY WRIGHT (hereinafter referred to as "Petition
has requested a special use permit to operate a day care home at
a single family dwelling at 1904 Cholo Lane, Mount Prospect,
Illinois (hereinafter referred to as the "Subject Property"); an
WHEREAS, the Subject Property is located in the R-1 Single
Family Residence District and i~ legally described as follows:
Lot Thirty Seven (37) in Rcsnbdivision of Lots t to 129,
inclusive (except I.ot 87) in Forest Manor Unit No. 4,
being a Subdivision in the South West Quarter (1/4) and
the South East Quarter (1/4) of Section 25, Township 42
North, Range 11, East of the Third Principal Meridian,
according to Plat of said Resubdivision registered in
the Office of the Registrar of Titles of Cook County,
Illinois, on September 14, 1962, as Document No. 2055506,
in Cook County, Illinois; and
WHEREAS, Section 14.1101 C of thc Zt~ning Ordinance of the
Village Code of Mount Prospect provides that a day care home
is a special use in the R-1 Single Family Residence District; an
WHEREAS, a public hearing was held on Petitioners request for
a special use permit to operate a day care home on the Subject
Property, which request is known as ZBA 19-SU-81, before the
Zoning Board of Appeals of the Village of Mount Prospect on
September 24, 1981, pursuant to proper legal notice published
in the Mount Prospect Herald on April 6, 1981; and
WHEREAS, th~ Zoning Board of Appeals has recommended to the
President and Board of Trustees of the Village of Mount Prospect
that Petitioners request for the aforesaid special use permit,
ZBA 19-SU-81, be granted; and
WHEREAS, the President and Board of Trustees of the Village of
Mount Prospect have determined that with respect to the
Petitioners request for a speciaI use permit to operate a day
care home on the Subject Property, that Petitioner has satisfied
the standards for the grant of a special use permit set forth
in Section 14.704 of Article VII of the Zoning Ordinance of
the Village of Mount Prospect and find that it would be in the
best interest of the Vii]age of Mount Prospect to grant
Petitioners said special nsc permit provided Petitioners operate
such day care home in accordance with any requirements of the
State of Illinois for such day care homes and further provided
that Petitioner is licensed to operate such day care home by
the State of Illinois.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS
SECTION ONE: The recitals s~t forth hereinabove ave incorporate
as though fully set forth.
SECTION TWO: The President and Board of Trustees of the Village
of Mount Prospect hereby authorize the issuance of a special use
permit to Petitioners t'o operate a day care home on the Subject
Property subject to Potit~mcrs compliance with thc following
conditions:
1. Petitioner must bo li{'t, nsetl by the State of Illinois

to operate a day care home on the Subject
Property.
Petitioner shall operate such day care home
in accordance with any requirements imposed
by the State of Illinois for such day care homes.
Petitioner shall operate such day care home in
accordance with all applicable Village of
Mount Prospect Ordinances.
SECTION THREE: The special us~, permit authorized herein
shall be automatically revokc, d at such time as the Subject
Property is no longer used as a day care home.
SECTION FOUR: The special use permit authorized herein shall
be subject to revocation if Petitioner fails to operate the
aforesaid day care home in accordance with the conditions
hereinabove set forth in Section Two of this Ordinance No.
SECTION FIVE: The special use permit authorized herein shall
not be deemed to run with the land and shall be issued to
Petitioner only for as long as Petitioner occupys the premises
of the Subject Property and operates a day care home thereon in
accordance with the provisions of this Ordinance No.
SECTION SIX: This Ordinance shall be in full force and effect
from and after its passage, approval and publication in the
manner provided by law.
