RDINANCE NO. 3178
AN ORDINANCE TO AMEND ARTICLE VII ENTITLED
"FENCES" OF CHAPTER 21 OF THE VILLAGE CODE
OF MOUNT PROSPECT, ILLINOIS
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: Article VII entitled "Fences" of Chapter 21 of the
Village Code of Mount Prospect, Illinois, 1981 is hereby amended as
follows:
A. By amending subsection A. of Section 21.701 entitled
"Height and Location" to read:
"A. Fences not more than five feet (5') in height will
be permitted in the Village as follows:
1. Along the interior or rear lot lines and en-
tirely behind the front building line.
Any fence located along a public right-of-way
shall be set back a minimum of one (1) foot
from the right-of-way line.

On corner lots, any fence shall be placed en-
tirely behind the rear building line along the
side street."
B. By amending subsection C. of Section 21.701 entitled
"Height and Location" to read:
In Residential Districts, as defined by Chapter 14
entitled "Zoning" of this Code, fences not more
than six feet (6') in height will be permitted in
the Village as follows:
If placed no nearer to property lines
than a building is permitted under the ZOning
regulations of the said Chapter 14, and pro-
vided that a twenty five foot (25') set back
is maintained from the rear lot line; or
If placed along the rear lot line when such
rear line abuts an arterial road as defined by
the Comprehensive Plan of the Village of Mount
Prospect, and provided that a one foot (1')
set back is maintained from the road.right-of-
way line."
C. By adding a new Section 21.705 to be entitled
"Variations" and to read:
"Sec. 21.705 Variations. The Zoning Board of Appeals
shall hear and decide all requests for variations from
the height and location set back regulations contained
in this Article, provided that no variation shall
exceed the maximum heights permitted herein by more
than 20 percent and no variation shall reduce
the minimum location set back r~quirements permitted
herein by more than 20 percent. Variation
requests shall be processed in accordance with the
provisions of ~rticle VI entitled "Variations" of
Chapter 14 of this Code."
SECTION TWO: This Ordinance shall be in full force and effect
from and after its passage, approval and publication in pamphlet
form in accordance with law.
