At the April 5 Village Board meeting, a three year contract beginning August 1, 1994
was awarded to Arc Disposal for refuse pick-up within the Village of Mount Prospect.
During the discussion leading up to the award of the contract, two issues were
briefly discussed but left unresolved. The first was whether the Village should
consider extending the three-year contract an additional two years under terms and
conditions negotiated between Arc Disposal and Village staff. The second issue
centered on the appropriate level of internal control which the Village exercises over
Arc to verify sticker counts in a manner which is not overly burdensome to residents
(multiple stickers). Since the April 5 meeting, staff has continued to review both
items internally and in discussions with representatives with Arc Disposal.
The attached material provides: (1) Background identifying various options the
Village has with regard to extending the contract for an additional two years and (2)
Describes an appropriate internal control scenario that will reasonably ensure Arc's
compliance with contract terms while not being overly burdensome to resident users.
Appropriate staff will be in attendance to facilitate discussion.
V. BOCA PROPERTY MAINTENANCE CODE
At the January 25 Committee of the Whole meeting, Village Board members
considered a staff recommendation that the Village adopt the BOCA Property
Maintenance Code in place of the existing "local" Property Maintenance Code the
Village has utilized for well over a decade. The initial recommendation was borne
out of an increasing level of frustration being experienced by our Housing Inspectors
in their efforts to maintain and upgrade the Village's housing stock. In particular, it
was becoming evident that the existing local Property Maintenance Code was not
strong enough to gain compliance from several recalcitrant landlords and property
managers. The BOCA Property Maintenance Code, as a nationally recognized
model Code, takes away numerous loopholes which are currently allowing landlords
and property managers to neglect their properties.
Village Board members referred the staff recommendation to the Visions Housing
Sub-Committee for initial review and comments. Since January, the Housing Sub-
Committee has met on three occasions to discuss the Code and related items. Each
of the three meetings was well attended by residents, landlords, property managers,
elected officials and staff. Discussion was vigorous and at all times positive. It was
clear that the common goal of all involved was to improve the quality of the Village's
housing stock.
The proposed adoption of the BOCA Property Maintenance Code is now ready for
final review by the Mayor and Board of Trustees. The package of information you
have received includes the existing Code, the BOCA Code with commentary, staff
recommended Amendments and Minutes from the three Housing Sub-Committee
meetings. There was general agreement that the new Code would be an effective
tool in protecting the Village's housing stock. A few minor issues as outlined in the
Minutes need to be resolved prior to consideration for final adoption.
Village staff will be available to answer questions. Members of the Visions Housing
Sub-Committee have been invited to attend Tuesday evening's meeting.
VI. SINGLE-FAMILY CONVERSION ORDINANCE
During the Village Board's consideration and adoption of the new Zoning Ordinance
last year, Trustee Paul Hoefert raised a concern regarding the seeming prevalent
existence of single-family homes which had been converted into multiple dwelling
units. Issues were raised regarding the legality of such conversions as well as the
impact on surrounding properties. Based upon preliminary discussion, staff was
directed to prepare a draft Ordinance which would seek to eliminate true second-
living quarters that are held out for rental purposes. Board members specifically
indicated a desire to exclude from said prohibition less formal "in-law" type living
arrangements.
Attached is a proposed draft of the requested Ordinance along with a cover
memorandum from Planning Director William Cooney. Appropriate staff along with
Village Attorney Everette Hill will be in attendance to facilitate discussion.
VII. FUTURE COMMITTEE OF THE WHOLE AGENDA ITEMS
A growing list of potential Committee of the Whole discussion items has been
proposed over the last several months by Board members or staff. Board members
have indicated a desire to: (1) Determine the necessity of discussing a particular
item; (2)Rank the items in order of importance so that each can be scheduled
appropriately and (3) Articulate the scope and nature of the desired discussion for
each item so that staff may be better able to prepare material and conduct
necessary research.
The attached memorandum lists some of those items. It is anticipated that the
Board will review each of the items and discuss within the context of the three
factors listed above. With appropriate direction, staff can prepare each item for
discussion at a future Committee of the Whole meeting.
