AN ORDINANCE A~!ENDING THE ZONING MAP NO. 15-N
WITH RESPECT TO ZONING OF CERTAIN PROPERTY
IN THE R-1 SINGLE FAMILY RESIDENCE DISTRICT
IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS
WHEREAS, the Community Development Department of the
Village of Mount Prospect has made application to rezone
certain property owned by Raymond H. and Florence J. Huntzicker
of 1105 Cora Street, Des Plaines, Illinois, and-located at
33 West Kensington Road in the Village of Mount Prospect,
Illinois (hereinafter referred to as the "subject property")
from its present zoning classification in the B-3 Business,
Retail and Service District to the R-1 Single Family Residence
District, as provided in Article VIII of Chapter 14 of the
Village Code of Mount Prospect, Illinois; and
WHEREAS, the subject property is legally described as
follows:
Lot 1 in Huntzicker Subdivision, being a sub-
division in the Northwest Quarter of the North-
west Quarter and of the Northeast Quarter of
the Northwest Quarter of Section 34, Township
42 North, Range 11 East of the Third Principal
Meridian, in Cook County, Illinois.
and
WHEREAS, prior to 1973, the subject property was zoned
in the R-1 Single Family Residence District, and in 1972
the owners thereof subdivided the subject property and the
lot adjacent thereto on the south (Lot 2) and thereafter ob-
tained a rezoning of the subject property from the R-1
Single Family Residence District to the B-3 Business, Retail
and Service District, for the purpose of establishing an
electronics service and sales store thereon; and
WHEREAS, at the time of said rezoning the subject prop-
erty was separated from the Single Family Residence Develop-
ment to the south by a Commonwealth Edison substation structure
and tower located on the adjacent Lot 2 of said Subdivision,
which substation served as a buffer between the residence
uses to the south and the subject property which was therefore
considered to be an appropriate site for the location of an
electronics service and sales store; and
WHEREAS, subsequent to said rezoning of the subject
property, the same has remained vacant and the proposed
electronics sales and service store was never constructed
thereon; and
WHEREAS, the use of the adjacent'property (Lot 2) to the
south of the subject property as an electrical substation and
tower, has been terminated and the substation structure has
been removed; and
WHEREAS, in April, 1981, a revised Comprehensive Plan for
the Village of Mount Prospect was adopted which designated the
subject property to be more appropriately developed as a single
family residence following the elimination of the incompatible
electrical substation structure; and
WHEREAS, in order to bring the subject, property into con-
formity with the Comprehensive Plan of the Village, subject
application for rezoning the same from B-3 Business, Retail
and Service District to R-1 Single Family Residence District,
was filed; and
WHEREAS, a public hearing was held on said rezoning ap-
plication (designated as Case No. ZBA-29-Z-82) before the
Zoning Board of Appeals of the Village of Mount Prospect on
the 26th day of August, 1982, pursuant to proper publication
of due notice thereof in the Mount Prospect Herald, on
August 10, 1982; and
WHEREAS, the Zoning Board of Appeals has forwarded its
finding and recommendation to the Board of Trustees of the
Village that the requested rezoning be denied, and the President
and Board of Trustees have considered said application and
the finding and recommendation of the Zoning Board of Appeals
pertaining thereto, and have determined that the best interests
of the Village of Mount Prospect would be obtained by the
adoption of the necessary ordinance to accomplish said rezoning
in conformity with the Comprehensive Plan of the Village.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD
OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY,
ILLINOIS:
SECTION oNE: The recitals set forth hereinabove are incorporated
herein as findings of fact by the President and Board of Trustees
of the Village of Mount Prospect.
SECTION TWO: The Zoning Map No. 15-N pertaining to Chapter 14
entitled "Zoning" of the Village Code of Mount Prospect, Illinoi~
as amended, is hereby further amended by reclassifying from
the B-3 Business, Retail and Service District to the R-1 Single
Family Residence District, the following described property:
Lot 1 in Huntzicker Subdivision, being a sub-
division in the Northwest Quarter of the North-
west Quarter and of the Northeast Quarter of
the Northwest Quarter of section 34, Township
42 North, Range 11 East of the Third Principal
Meridian, in Cook County, Illinois.
SECTION THREE: This Ordinance shall be in full force and effect
from and after its passage, approval, and publication in pamphlet
form in accordance with law.
