ORDINANCE NO. 3282
AN ORDINANCE GRANTING SPECIFIED VARIATIONS
FOR PROPERTY COMMONLY KNOWN AS THE CHURCH'S
FRIED CHICKEN PROPERTY AT 1790 WEST ALGONQUIN
ROAD, IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS
WHEREAS, Church's Fried Chicken, Inc. has filed an applica-
tion with respect to certain property hereinafter described,
located at 1790 West Algonquin Road, in the Village of Mount
Prospect, Illinois, seeking a variation from the yard require-
ments of Section 14.2102.A and 14.2102.C of Article XXI, of
Chapter 14 of the Village Code of Mount Prospect, Illinois;
and
WHEREAS, the Subject Property is described as follows:
that part of Lot 2 in Edward Busse's Division of
parts of the Southeast quarter of Section 15, and
the Northeast quarter of Section 22, Township 41
North, Range 11 East, of the 3rd P~incipal Meridian,
per plat recorded Decemter 17, 1919, as Document
No. 6696216; lying West of a line which is 362.98
feet West of and parallel with the East line of
said Lot 2, and South of the North line of said
Northeast quarter of Section 22, (except that part
falling in streets and highways); all in Cook
County, Illinois;
and
WHEREAS, Petitioners seek a variation from the yard re-
quirement set forth in Section 14.2102.A and 14.2102.C of
Article XXI of Chapter 14 of the said Village Code, to allow
use of the. 30-foot transitional front yard and 20-foot rear
yard for improvements related.~to the operation of a restaurant
with drive-up window on the property; and
WHEREAS, a public hearing was held on said variation re-
quest (designated as Case No. ZBA-40-V-82) before the Zoning
Board of Appeals of the Village of Mount Prospect on the
7th day of October, 1982, pursuant to due and proper notice
thereof published in the Mount Prospect Herald on September 20,
1982; and
W~HEREAS, the Zoning Board of Appeals has recommended that
the Board of Trustees of the Village of Mount Prospect grant
the variation requests; and
WHEREAS, the President and Board of Trustees of the Village
of Mount Prospect have determined that the requested variations
satisfy the standards*set forth in Section 14.605 of Article
VI of Chapter 14 of the Village Code, and further find that
it would be in the best interests of the Village to grant to
the Applicants the requested variations.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD
OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY,
ILLINOIS:

SECTION ONE: The recitals set forth hereinabove are incorporate
herein as findings of fact by the President and Board of Trustee!
of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Village
of Mount Prospect do hereby grant to the property hereinabove
described the variations requested with respect to Section
14.2102.A and 14.2102.C in order to allow the use of the 30-
foot transitional front yard and 20-foot rear yard for purposes
of improvements related to the operation of a restaurant with
drive-up window thereon.
SECTION THREE: Except for the variations granted herein, all
other applicable Village of Mount Prospect Ordinances and
regulations shall remain in full force and effect as to the
Subject Property.
SECTION FOUR: This Ordinance shall be in full force and effect
from and after its passage, approval and publication in pamphlet
form in the manner provided by law.
