FARLEY AND BOARD OF TRUSTEES VILLAGE MANAGER MARCH 13, 2003 FI ESTA MARKET, 1902 SOUTH ELMHURST ROAD CLASS C LIQUOR LICENSE On Wednesday, March 5, 2003, the Village Manager met with Messrs. Kosta Apostolopoulos and Bill Giannopoulos, principal owners of Fiesta Market, along with their attorney to discuss their request for a Class C Liquor License. The Class C License provides for the retail sale of packaged liquors. Fiesta Market is a full-service grocery store specializing in produce and ethnic foods. The business opened in October 2002 in an existing structure previously occupied by Frank's Nursery. The principal owners indicated a desire to sell packaged liquors based on growing requests from their customers. The Village Manager reviewed at length with those present the Village's particular sensitivity to the sale of alcohol to minors as well as sales to intoxicated persons. The Village Manager informed the pnncipals that they were responsible for the actions of all employees and that it was imperative to establish an appropriate training program as well as management oversight with regard to such sales. The principals indicated they had read the Village Code and understood all of the requirements. Additionally, the Village Manager counseled the principals that the Village conducts regular sting operations involving underage adolescents and that the penalty for such Liquor Code violations could be quite severe. Given the fact that neither of the pnncipals has had prior experience with the sale of alcohol the Village Manager is recommending that at least one of the principals and the store manager complete a Liquor Servers Training Course within 30 days of the issuance of the License. The principals are amenable to such a requirement. A completed application is on file along with all required fees. The applicants have submitted to fingerprinting and background checks. If the request is considered favorably, an Ordinance creating a new Class C Liquor License would need to be adopted. MEJ/rcc ~S ORDINANCE NO. AN ORDINANCE AMENDING CHAPTER 13 OF THE VILLAGE CODE OF MOUNT PROSPECT BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT :~ROSPECT, COOK COUNTY. ILLINOIS: SECTION ONE: That in accordance with Subsection A of Section 13.108 of Chapter 13 of the Village Code of Mount Prospect, as amended, the Corporate Authorities shall determine the number of Liquor Licenses available in each Classification and shall establish a list specifying the number of Liquor Licenses authorized. Said list is hereby amended by increasing the number of Class C Liquor Licenses by One (1) Fiesta Market, t902 South Elmhurst Road. Said list is as follows: Zero (0) Class A License Two (2) Class B Licenses Nine (9) Class C Licenses One (1) Class D License One (1) Class E License One (1) Class G License Zero (0) Class H License Zero (0) Class M License Zero (0) Class MH License Qne (1} Class P License Sixteen (16) Class R Licenses Fifteen (15) Class S Licenses One (1) Class T License One (1) Class V License Six (6) Class W Licenses Zero (0) Class XX License Iwith conditions as attachea to License SECTION TWO: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law. FARLEY AND BOARD OF TRUSTEES VILLAGE MANAGER MARCH 13, 2003 FRANKIE'S, 720 EAST RAND ROAD CONTINUATION OF CLASS W LIQUOR LICENSE On Monday, March 3, 2003, the Village Manager met with Minerva Celaya, a principal owner of Frankie's Fast Food Restaurant, regarding her request to continue the existing Class W Liquor License issued to the establishment. The Cla'ss W License provides for the sale of beer and wine at dining tables. Mr. and Mrs. Celaya purchased the business in January 2003. They are currently operating the establishment without the sale of beer and wine. The menu consists of standard fast food fare. The restaurant is open seven days a week and serves a lunch and dinner menu. Mr. Celaya has worked at Photo's Hot Dogs the past eight years as a crew chief and manager. Photo's restaurant possesses a Class W Liquor License, The Village Manager reviewed with Mrs. Celaya the Village's particular sensitivity to the sale of alcohol to minors as well as over-service to intoxicated persons. The Village Manager informed the principals that they were responsible for the actions of all employees and that it was imperative to establish an appropriate training program as well as management oversight with regard to such sales. Mrs. Celaya indicated she had read the Village Code and understood all of the requirements. Additionally, the Village Manager counseled Mrs. Celaya that the Village conducts regular sting operations involving underage adolescents and that the penalty for such Liquor Code violations could be quite severe. Given Mr. Celaya's previous experience with the sale of alcohol at Photo's, no liquor server training appears to be necessary. The completed application is on file with all required fees. The principals have submitted to fingerprinting and background checks. The Celayas are also in the process of purchasing the building and accompanying property. If considered favorably, a Motion to approve a change in ownership for the existing Class W Liquor License would be in order. MEJ/rcc M~~IS
