RDINANCE NO, 3303 AN ORDINANCE GRANTING SPECIFIED VARIATIONS FOR PROPERTY COMMONLY KN©WN AS GIORDANO'S PIZZA, AT 820 EAST RAND ROAD, IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES THE 4th DAY OF January , 19~ . Published in pamphlet form by authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 4th_ day of January , 1985. ZBA 47-V-82 ORDINANCE NO. 3303 AN ORDINANCE GRANTING SPECIFIED VARIATIONS FOR PROPERTY CO~ONLY KNOWN AS GIORDANO'S PIZZA, AT 820 EAST RAND ROAD, IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, America's Best Pizza, Inc. has filed an applicatio~ with respect to certain property, hereinafter described, located at 820 East Rand Road, in the Village of Mount Prospect, Illinoi~ and commonly known as Giordano's Pizza, seeking variations from the yard requirements in the B-3 Business, Retail and Service District to correct certain existing non-conforming encroach- ments and uses within said yard areas; and WHEREAS, the Subject Property is described as follows: Lot 1 in Jojos Subdivision of Part'of the North- west 1/4 of the Southwest 1/4 of Section 35, Township 42 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois; and WHEREAS, Petitioners seek a variation from the transitional front yard and minimum rear yard requirements of Section 14.2002. and C and from the uses permitted in a yard as defined in Sectio~ 14.2602.B "Yard" of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow use of the 30-foot transitional front yard and 20-foot rear yard for the existing building encroachment and for off-street parking in the front yard, and off-street truck loading and parking in the rear yard and to further provide for an off-premises sign; and WHEREAS, a ppblic hearing was held on said variation re- quest (designated as Case No. ZBA-47-V-82) before the Zoning Board of Appeals of the Village of Mount Prospect on the 4th day of November, 1982, pursuant to due and proper notice thereof published in the Mount Prospect Herald, on October 18, 1982; and WHEREAS, the Zoning Board of Appeals has recommended that the Board of Trustees of the Village of Mount Prospect grant the variation requests; and ~qEREAS, the President and Board of Trustees of the Village of Mount Prospect have determined that the requested variations satisfy the standards set forth in Section 14.605 of Article VI of Chapter 14 of the Village Code, and further find that it would be in the best interests of the Village to grant to the Petitioners the requested variations. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporate( herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. BA 47-V-B2 2 of SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect do hereby grant to the property hereinabove described the variations requested with respect to Sections 14.2002.A and 14.2002.C of Article XX and with respect to Section 14.2602.B. "Yard" of Article XXVI of Chapter 14 of the Village Code of Mount Prospect, Illinois, for the purpose of allowing the continuation of an encroaching architectural projection of the existing building on the premises and to allow off-street parking and related maneuvering aisles in the front yard area and to allow off-street truck loading and parking in the rear yard area; said variations to be allowed for the continued use and operation of the premises for resturant purposes, subject to landscaping and site improvement design proposals being submitted and accepted in a form approved, by the Director of Community Development. SECTION THREE: Except for the variations granted herein, all other applicable Village of Mount Prospect ordinances shall remain in full force and effect as to the Subject Property. SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
