RDINANCE ~O. 3321 AN ORDINANCE GRAY,TING SPECIFIED PARKING VARIATIONS FOR PROPERTY CO~E.[ONLY K~OWN AS T}{E SAKURA RESTAUP~ANT AT 107 SOUTH ~AIN STREET, IN THE VILLAGE OF ~OUNT PROSPECT, ILLINOIS WHEREAS, Mr. and Mrs. Fumiko-Nakanishi, owners of certain restaurant premises commonly kno~n as the "Sakura Restaurant" located at 107 South ~ain Street in the Village of ~[ount Prospect, Illinois, have filed an appli- cation seeking a variation from the off-street ~arkin~ provisions of Section 14.2005.A. of Article XX of Chapter 14 of the Village Code of Mount Prospect, Illinois as hereinafter set forth; and WHEREAS, the Subject Property is described as follows: Lot Three (3) and that part of Lot Two (2) lying South of a straight line drawn from a point in the West line of said Lot 2, that is 53.04 feet South of the North West corner thereof to a point in the East line of said lot that is 51.69 feet South of the North East corner thereof, in Block Thirteen (13) in Busse & ~ille's Resub- division in ~[ount Prospect in the %lest Half of Section ~elve (12), Township forty-one (41) ~4orth, Range Eleven (11), East of the Third Principal ~eridian, in Cook County, Illinois; Commonly known as 105-115 S. [lain Street, ~4ount Prospect, Illinois ALSO That part of Lot Two (2) in Block Thirteen (13) in Busse and %lille's Resubdivision in Mount Prospect in the [~[est Half of Section Twelve (12) Township Forty-one (41) North, Range Eleven (11), East of the Third Prin- cipal Meridian, described as follows: Commencing at a point in the North line of said lot that is 105 feet East of the North West corner thereof, thence South parallel with the West line of said lot, to a point in a straight line dra~.~n from a point in the West line of said lot that is 53.04 feet South of the North West corner thereof to a point in the East line of said lot that is 51.69 feet South of the North East corner thereof; thence East along said line to the East line of said lot; thence North along the East line of said lot to the North East corner thereof; thence ~est along the North line of said lot to the place of begin- ning, in Cook County, Illinois. WHEREAS, Petitioners seek a variation from the off- street parking requirements of said Section 14.2005.A. in order to allow an expansion of their restaurant into adjacent premises without having, at the saree time, to provide nine (9) additional off-street parking spaces; and WHEREAS, a Public Hearing %~as held on Petitioner's request for the aforesaid variation (designated as Case No. ZBA-5-V-83) before the Zoning Board of Appeals of the Village of ~Qunt Prospect on the 24th day of February, 1983 pursuant to the proper notice thereof published in the Mount Prospect Herald on February 8, 19~3; and. WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendations that a variation be given to Petitioners with respect to relieving Petitioners of any requirement to provide nine (9) additional parking spaces in order to expand their restaurant usage, provided that as a condition to such variance Petitioners provide for adequate off-street loading space; provide a landscaping plan for the major entrance onto the rear of the property for review and approval by the Village; and develop a total concept of building improvement (includiD? elevations of both the Main Street frontage and the rear elevation of the building) for review and approval by the Village, to insure that such improvements will not compromise or adversely affect the architectural character of the building in question; and WHEREAS, the President and Board of Trustees of the Village have considered further the variation request and have determined that the same satisfies tke standards set forth in Section 14.605 of Article VI of the Chapter 14 of the Village Code, and further find that it ~ould be in the best interest of the Village to grant the variations hereinafter set forth upon the cornpliance by Petitioners with the conditions provided for off-street loading, land- scaping, and building improvement concept. NOW, T[{EREFORE, BE IT ORDAI.~.TED' BY THE PRESIDE~,TT AND BOARD OF TRUSTEES OF T~ VILLAG~ OF .~.[OU!-TT P~O~-~C~, COOK COUHTY, ILLINOIS: SECTION O~E: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of ~ount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect do hereby grant to the Subject Property a variation from the off-street parking requirements of Section 14.2005.A. in order to allow for the expansion of Petitioner's restaurant business within adjoining build- ing premises without providing an additional nine (9) off- street parking spaces, upon condition that Petitioners shall provide for adequate off-street loading space, will provide a landscaping plan for the ma~e~? entrance onto the rear.of the property, for review and appr~val by the Village present a properly executed plat of resu]~division for recordation, and will develop a total concept of ~uilding improvement (in- cluding elevations of both the [~ain Street frontage and the rear elevation of the building) for revie~.~ and approval of the Village to insure that the architectural character of the building in question will not be compromised. -2- SECTION THREE: Except for the variation granted herein, ~11 other applicable Village of Mount Prospect Ordinances ~nd regulations shall remain in full force and effect as to ~he Subject Property.
