HomeMy WebLinkAboutOrd 3335 05/17/1983 RDINANCE NO. 3335 AN ORDINANCE APPROVING AND AUTHORIZING A SPECIAL USE TO ALLOW THE INSTALLATION OF TWO VIDEO GAMES (AMUSEMENT DEVICES) ON CERTAIN PROPERTY IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS P~SS~D AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES THE 17th DAY OF MAY , 1983 Published in pamphlet form by authority of the corporate authorities of the village of Mount Prospect, Illinois, the 23rd day of May , 1983 RDINANCE NO. 3335~ AN ORDINANCE ~PPROVING AND AUTHORIZING A SPECIAL USE ~O ALLOW THE INSTALLATION OF TWO VIDEO GA~ES (AMUSEMENT DEVICES) ON CERTAIN PROPERTY COMMONLY A~NO~ AS THE TWIN LINKS MINIATURE GOLF PROPERTY IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS h a] e] X~ i: WHEREAS, the Twin Links, Inc., the Petitioner herein, ~ made application for a Special Use with respect to ~tain property zoned and classified in the B-3 Business tail and Service District for the purpose of installing d operating two video games (amusement devices) at an isting amusement center operated by said Petitioner, rsuant to the provisions of Section 14.2001.C of Article of Chapter 14 of the Village Code of Mount Prospect, linois; and WHEREAS, the Subject Prooerty is located at 199 WeSt nd Road, in the Village of-Mount Prospect, Illinois, commonly known as the Twin Links Miniature Golf, and legally described as follows: That part of the East half of the South West quarter of Section 27, Township 42 North, Range 11, East of the Third Prin- cipal Meridian, described as follows: Beginning at a point in the South line of said South West quarter, 758.61 feet East of the South West corner of the East half of said South West quarter; thence North on a line forming an angle of 90 degrees, 40 minutes and 40 seconds, as measured from West to North with said South line of the South West quarter, a distance of 487.35 feet; thence East on a line forming an angle of 90 degrees, 58 minutes as measured from South to East, with the last described line, a distance of 253.93 feet to the cen- ter line of Rand Road; thence North Westerly along the center line of Rand Road, 298.34 feet to a point of commencement of a curve, thence North Westerly along a curve having a radius of 15626.10 feet, and being convex to'the South West, for a distance of 102.06 feet, thence South Westerly along a radial line of said last described curve, a distance of 236.15 feet more or less to an intersection with a line 200.0 feet West of and parallel to said line forming an angle of 90 degrees, 40 minutes and 40 seconds, as measured from West to the North with the South line of said South West quarter, thence South along the last described line, a distance of 600.35 feet more or less to the South line of said South West quarter; thence East along said South line of the South Wes~ quarter, 200.0 feet to the place of beginning (except that part of said tract taken for Rand Road) in Cook County, Illinois, and a 60% undivided interest in and s pe du~ it: co~ th~ fo~ Us, Pr~ Or~ BOJ CO1 ar~ an( Ill de~ of in th~ pr~ Se~ he~ an( PAi AY] NA~ AB~ AT~. to the Lessor's interest in a Ground Lease of said real estate dated 10/1/82 between Charles L. Bartmann, Sr., Lessor, and ~vin Links, Inc., an Illinois corporation, Lessee. WHEREAS, Public Hearing was held on said Special application (designated as Case No. ZBA-7-SU-83) before Zoning Board of Appeals of the Village of Mount Pros- h on March 24, 1983, pursuant to prooer publication of notiCe thereof in the Mount Prospect Herald, on the ~h day of March , 1983; and WHEREAS, the Zoning Board of Appeals has submitted finding and recommendation to the Village in favor of Special Use request; and WHEREAS, the President and Board of Trustees have ~idered the Special Use application and have determined the Subject Property complies with the standards set 5h in Section 14.704 of Chapter 14 regarding a Special , and that the best interests of the Village of Mount ~pect will be obtained bY ~he ad0P~i°n Of the neCessary [nance to approve and authorize the said Special Use. NOw, THEREFORE, BE IT oRDAINED BY THE PRESIDENT AND KD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK NTY,.ILLINOIS: SECTION ONE: The recitals set forth hereinabove incorporated herein as findings of fact by the President Board of Trustees of the Village of MOunt Prospect, ~nois. SECTION TWO: A Special Use for the Subject Property ~ribed above, to allow the installation and operation zwo (2) video games within an existing amusement center ~he B-3 Business Retail and Service District, provided a plat of subdivision is presented to the Village in )er form for recordation, pursuant to Subsection C of ~ion 14.2001 of Article XX of said Chapter 14 is eby approved. SECTION THREE: This Ordinance shall be in full force effect from and after its passage, approval and publi- ion in pamphlet form in the manner provided by law.
