AN ORDINANCE GRANTING A VARIATION FOR
CERTAIN PROPERTY COMMONLY KNOWN AS THE
SHELL OIL COMPANY PROPERTY AT 1020 EAST
RAND ROAD, IN THE VILLAGE OF MOUNT PROS-
PECT, ILLINOIS
WHEREAS, a Shell Oil Company filed an application for
variation with respect to certain property cormnonly known
as the Shell Oil Company station at 1020 East Rand Road
in the Village of Mount Prospect, Illinois; and
WHEREAS, the Subject Property is described as
follows:
That part of the South 1653.37 feet of the
East One Half of the Southwest Quarter
(measured on the East line of said tract)
and the Southwest Quarter of the Southwest
Quarter of Section Thirty-Five, Township
Forty-Two North, Range Eleven East of the
Third Principal Meridian, (except Central
Road) in Cook County, Illinois, described
as fol-ows: Commencing at the Southeast
corner of the Southwest Quarter of said
Section Thirty-Five; thence West along the
South line of the said Southwest Quarter
for a distance of 1108.91 feet; thence
North along a line which makes an angle
of 90°-00' with the last described line
for a distance of 33.00 feet to an inter-
section with the North line of Central
Road for a beginning; thence West along the
North line of Central Road for a distance
of 150.00 feet; thence North along a line
which makes an angle 90~-00'' with the last
described line for a distance of 158.47
feet to an intersection with the Southerly
right of way line of Rand Road (Route 12);
thence South Easterly along said southerly
right of way of Rand Road for a distance
of 178.29 feet to a point on the West
line of Mt. Prospect Road extended North;
thence South 62.11 feet along said West
line to the point of beginning: except
for the South 17.00 feet of that part of
the South 1653.37 feet of the East Half
of the South~est Quarter (measured on the
East line of said tract) and the Southwest
Quarter of the Southwest Quarter of Section
Thirty-Five, Township Forty-Two North, Range
Eleven east of the Third Principal Meridian
(except Central Road) in Cook County, Illinois.
WHEREAS, Petitioner seeks a variation from the provisions
of Section 14o2002.B.2 providing for a twenty (20) foot
side yard to allow an encroachment of 17 feet
for the erection of 2 canopies over gasoline p~,p islands,
and a variation from Section 14.2002.C providing a minimum
rear yard of twenty (20) feet to allow for an encroachment
of approximately 18.67 feet in the rear yard area for the
construction of a storage room, both of said Sections being
in Article XX, of Chapter 14 of the Village Code of Mount
Prospect, Illinois; and
~EREAS, a g was held on the variation
request (designated ~ Ca~e N~. ~BA-31-V-83) before the
Zoning Board of Appeals ~ th~ Village of Mount Prospect
on the 28th day of July, 1983, pursuant to due and proper
notice thereof published in the Mount Prospect Herald on
the 7th day of July , 1983~ and
WHEREAS, the Zoning Board of Appeals has submitted
its findings and recommendation to the President and
Board of Trustees of the Village of Mount Prospect in favor
of granting said variation request, and the President and
Board of Trustees of said Village have given further con-
sideration to the variation request and have determined
that the same satisfies the standards set forth in Section
14.605 of Article VI of Chapter 14 of the Village Code
and further find that it would be in the best interest of
the Village to grant the requested variations.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND
BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK
COUNTY, ILLINOIS:
SECTION ONE: The recitals set forth hereinabove are
incorporated herein as findings of fact by the President and
Board of Trustees of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of
the Village of Mount Prospect do hereby grant to the
property heretofore described the variations requested
with respect to Section 14.2002oB.2 and Section 14.2002.C
of Article XX, of Chapter 14 of the Village Code of Mount
Prospect, Illinois to allow for the erection of 2 canopies
over existing pump islands within said side yar~ and the
erection of a storage addition in the rear yard area of
the-Subject Property.
SECTION THREE: Except for the variations granted here-
in all other applicable Villag~ ~f Mount Prospect Ordinances
and regulations shall remain in full force and effect as to
the Subject P~operty.
SECTION FOUR: This Ordinance shall be in full force
and effect from and after its passage, approval and publica-
tion in p~mphlet form in the manner provided by law.
