ORDINANCE NO. 3411 AN ORDINANCE TO AMEND ARTICLE V ENTITLED "DRIVING WHILE INTOXICATED, TRANSPORTING ALCOHOLIC LIQUOR AND RECKLESS DRIVING" OF CHAPTER 18 OF THE VILLAGE CODE OF MOUNT PROSPECT, ILLINOIS BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: Article V entitled "Driving Whil~ Intoxicated, Transporting Alcoholic Liquor and Reckless Driving" of Chapter 18 of the village Code of Mount Prospect, Illinois (1981) as amended is hereby further amended %o read as follows: A. By reamending and readopting in its entirety Section 18.501 entitled "Driving While Under the Influence of Alcohol, Other Drug or Combination Thereof" as set forth in Ordinance 3180 adopted January 19, 1982. B. By reamending and readopting in its entirety Section 18.501.1 entitled "Suspension of Driver's License; Implied Consent" as set forth in Ordinance 3180 adopted January 19, 1982. C. By reamending and readopting in its entirety Section 18.501.2 entitled "Chemical and Other Tests" as set forth in Ordinance 3180 adopted January 19, 1982. D. By amending Section 18.501.3 entitled "Penalties" to read as follows: "Sec. 18.501.3 Penalties.' Every person who is convicted of a violation of Section 18.501 shall be guilty Of a Class A misdemeanor as provided in Chapter 38 of the Illinois Revised Statutes, and shall be subject to a fine of up to $2,500., but not less than $500. and/or J_mprisonment for any term less than one year. In addition to such penalty herein or any other administrative action provided in this Code or by statute, for any second or subsequent conviction of violating this Section within 5 years of a previous violation thereof, such person shall be mandatorily sentenced to a minimum of 48 con- secutive hours of imprisonment or assigned to a minimum of 16 days of community service as may be determined by the Court. Such imprisonment or as- signment shall not be subject to suspension nor shall the person be eligible for probation in order to reduce the sentence or assignment." E. By adding a new Section 18.501.4 to be entitled "Revocation of Driving Privileges - Notification to Secretary of State" and to ~ead as follows: "Sec. ~8.501.4 Revocation of Driving Privileges - Notification to Secretary of State. Every person who is convicted of a violation of Section 18.501 shall have his driving privileges revoked by the Secretary of State pursuant to the provisions of Section 11-501 of the Illinois Vehicle Code. The Chief of Police shall be responsible for determining that the Secretary of State is promptly notified of all such convictions under Section 18.501." SECTION TWO: If any provisi6h Or part thereof of this Ordinance is declared by a Court of competent jurisdiction to be invalid and if no further force and effect, such invalidity shall not affect the remaining provisions of this Ordinance which shall remain in full force and effect. SECTION THREE: This Ordinance shall be in full force and effect upon its passage, approval and publication in pamphlet form in the manner provided by law.
