AN ORDINANCE GRANTING A VARIATION TO CERTAIN
PROPERTy COMMONLY KNOWN AS 412 SOUTH PINE
STREET IN THE VILLAGE OF MOUN~R0~ECT~
ILLINOIS
WHEREAS, Mrs. Shirley A. Borek has filed an application
)r a variation with respect to certain residence property
by her and commonly known as 412 South Pine Street, in
le Village of Mount Prospect, Illinois (the "Subject Property");

WHEREAS, the Subject Property is described as
)llows:
Lot 27 in Block 4 in Prospect Park Subdivision~No. 1, .
being a subdivision of the West half of the North 60
rods of the Southwest quarter of Section 12, Township
41 North, Range 11, East of the Third Principal Meridian
(except streets heretofore dedicated) in the Village of
Mount ?rosp~ct, Cook County, Illinois; and
WHEREAS, Petitioner seeks a variation from the provisions
Section 14.102.B.2 of Article I of Chapter 14 of the Village
of Mount Prospect, Illinois, which requires a five foot
tback from the side property line with respect to location
existing garage structures, in order to replace an existing
rage ~ith a new, wider and longer garage to be l~cated within
feet it inches of the side property line of the Subject
and
WHEREAS, a public hearing was held on the variation request
~signated as Case No. ZBA-18-V-84) before the Zoning Board of
~eals of the Village of Mount Prospect on the 7th day of June,
34, pursuan~ to due and proper notice thereof published in the
ant Prospect Herald on the 16th day of May, 1984; and
WHEREAS, the Zoning Board of Appeals has submitted its
f ndings and recommendation to the President and Board of Trustees
ol the Village of Mount Prospect to allow the requested variation,
ar ~ the PreSident and Board of Trustees of said Village have given
f~ ether consideration to:the request and have determined that the
sene Satisfies the standards set forth in Section 14.605 of ArtiCl~
VI of Chapter 14 of the Village Code, and further find that it
~ld be in the best interest of the Village to grant the requested
NOW, THEREFORE, BE IT ORDAINED BY THE~'PRESIDENT AND BOARD OF
T~ ISTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK coUNTY, ILLINOIS
A~ FOLLOWS:
SECTION 1: The recitals set forth hereinabove are in~
;ed herein as findings of fact by the President and
~rd of Trustees of the Village of Mount Prospect.

SECTION 2: The President and Board of Trustees of the
.lage of Mount Prospect hereby grant to the Subject Property
variation requested with respect to Section 14.102.B.2 of
~icle I of Chapter 14 of the Village Code of Mount Prospect,
inois to allow construction and expansion of a garage struc-
e within 2 feet 11 inches from the side property line of
Subject Property.

SECTION 3: Except for the variation granted herein, as shown
the site plan attached hereto, all other applicable Village of
nt Prospect ordinances and regulations shall remain in full force
effect as to the Subject Property.
SECTION 4: This Ordinance shall be in full force and effect
and after its-passage, approval and publicatzon in pamphlet
in the manner provided by law.
