AN ORDINANCE GRANTING A VARIATION FOR CERTAIN
PROPERTY COMMONLY KNOWN AS 1711 MYRTLE DRIV~
IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS
WHEREAS. Mr. and Mrs. Frank J. Mortellar6 have filed an
pplication for variations with respect to their residence property
t 1711 ~rtle Drive, in the Village of Mount Prospect. Illinois
the "Sub3ect Property"); and
WHEREAS. the Subject Property is described as follows:
Lot 18 in Colonial Heights First Edition, being a
Subdivision of part of Lots 5. 6 and 7 in Owner's Division
being a Subdivision of the Southeast Quarter (except the
West Half of the Southwest Quarter thereof) of Section 10,
Township 41 North. Range 11. East of the Third Principal
Meridian, in Cook County, Illinois: and
WHEREAS, Petitioners seek variations from the following
:ovisions of Chapter 14 of the Village Code of Mount Prospect.
.linois. to allow them to construct a replacement garage structure
~ house four automobiles, containing 988 square feet in area and
~cated within the required five foot side and rear yard set back
.ne of the Subject Property:
1. A variation from Section 14.102.B.2 providing a minimum se
back of five feet from any interior lot line.
2. A variation from Section 14.102.B.4 providing for the
maximum size of a private garage structure to be 600 squar~
feet.
3. A variation from Section 14.1101.B.3 providing only for a
two-car garage in an R-1 Single Family Residence District:

WHEREAS. a public hearing was held on the requested variations
(, esignated as Case NO. ZBA-26-V-84) before the Zoning Board of
)eals of the Village of Mount Prospect on the 28th day of June.
~4, pursuant to due and proper notice thereof published in the
]nt Prospect Herald on the 8th day of June. 1984: and
WHEREAS. at said hearing the Petitioners presented 41 letters
s ]ned by nearby residents of the Subject Property and stating that
tl }re was no objection to the proposed garage replacement, and
f: ~ther stated that no part of said structure would be used for
p(~forming auto body or repair work or for any form of home
o¢ :upation: and
WHEREAS. the Zoning Board of Appeals has submitted its findings
t( the President and Board of Trustees of the Village of Mount
Px 3spect disclosing that the requested variations did not receive a
m~ ority favorable vote, and the President and Board of Trustees of
s~ .d Village have given further consideration to the variation
rE [uests. and.have considered the fact that the proposed garage
c( ~struction is for the purpose of replacing existing structures.
ar[ have determined that such requests satisfy the standards set
fE :th in section 14.605 of Article VI of Chapter 14 of the Village
C¢ [e. provided that no auto body or repair or other home occupation
us! is made of the subject garage structure, and that it would thus
be in the best interest of the Village to grant the requested
va :iations.

NOW. THEREFORE, BE I~ ~D ~¥ T~ PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS,
FOLLOWS:

SECTION ONE: The recitals set forth hereinabove are
incorporated herein as findings of fact by the President and Board
of Trustees of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Village
of Mount Prospect hereby grant to the Subject Property the requested
variations from Sections 14.102.B.2, 14.102.B.4 and 14.1101.B.3 of
Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow
the construction of a replacement garage structure on condition that
no portion of the structure shall be used for auto body and repair
work or for any other home occupation.
SECTION THREE: Except for the variations granted herein, all
other applicable Village of Mount Prospect Ordinances and
Regulations shall remain in full force and effect as to the Subject
Property.
SECTION FOUR: This Ordinance shall be in full force and effect
from and after its passage, approval and publication in pamphlet
form in the manner provided by law.
