AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY

~REAS, Mr. Charles C. Smith has filed an application for variatio
_th respect to commercial property commonly known as
)0 West Central Road in the Village of Mount Prospect, Illinois
zhe "Subject Property"); and
{EREAS, the Subject Property is described as follows:
The West 260 feet of the East 710 feet of that part of
the East Half of the Southeast Quarter of Section 33,
Township 42 North, Range 11 East of the Third Principal
Meridian, lying South of the right-of-way of the Chicago
and Northwestern Railway in Cook County, Illinois, except
the West 201.47 feet of the East 710 feet (excep the
South 600.59 feet thereof); and
EREAS, Petitioner seeks the following variations from provisions
[ Chapter 14 of the Village Code of Mount Prospect, Illinois, to
_low a 5 foot front yard rather than a 30 foot fron yard as
~ovided in Section 14.2202.A of Article XXII, to permit a 20 foot
_de yard for the west side of the Subject Property instead of a
foot side yard as required by Section 14.2202.B of Article XXII,
permit one parking space for each 250 square feet of office spac~
d one parking space for each 1.500 square feet'of warehouse area
~stead of one parking space for each 250 square feet of gross
]ilding floor area as required by Section 14.2205.A.1 of
~ticle XXII, to permit one loading dock for the entire building
~ther than three loading docks otherwise required by Section 14.2295.1
[ Article XXII, and to allow parking to encoarch to 0 feet of the
[de property line instead of the 5 foot of the east side yard as
.quired-by Section 14.2205.F of Article XXII; and
~EREAS, a public hearing was held on the variation requests
[esignated as Case No. ZBA 20-V-84) before the Zoning Board of
)peals of the Village of Mount Prospect on the 28th day of June, 1584
]rsuant to due and proper notice thereof published in the Mount
?ospect Herald on the 16th day of May, 1984; and
{EREAS, the Petitioner subsequently withdrew his request for a
~riation in the number of loading locks, and the Zoning Board of
~peals has submitted its findings and recommendations to the
~esident and Board of Trustees of the Village of Mount Prospect to
_low the requested variation regarding parking within the required]
.de yard area and to deny the remaining variation requests, and th~
~esident and Board of Trustees of said Village have given further
>nsideration to the variation requests and have determined that
~e same satisfy the standards set forth in Section 14.605 of
rticle VI of Chapter 14 of the Village Code, and this Board furthe~
~nds that it would be in the best interests of the Village to gran-
~e requested variation to permit a 20 foot side yard rather than
30 foot side yard for the west side, and to permit parking based
)on one space per 250 square feel of office space and 1,500 square
~et of warehouse area as requested, but to deny the request for a
~ont yard set back variation and to take no action regarding the
~quest for parking within the 5 foot side yard area, but to refer
%e request for parking back to the Petitioner for his own action
~th respect to parking which should alleviate the need for such
~riation.

NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD
OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY,
ILLINOIS:
SECTION ONE: The recitals set forth hereinabove are
incorporated herein as findings of fact by the President and
Board of Trustees of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Village
of Mount Prospect hereby grant to the Subject Property the
variations requested with respect to Sections 14.2202.B and
Section 14.2205.A.1 of Article XXII of Chapter 14 of the Village
Code of Mount Prospect, Illinois, to allow a 20 foot side yard
and parking space based on one space for every 250 square feet
of gross building floor area and for each 1,500 square feet of
warehouse area, as shown on Petitioner's Exhibit 1 pertaining
to the west side yard of the existing building and a new office
warehouse at the rear of the property.
SECTION THREE: The petitioner shall install and maintain
landscaping and parking improvements in accordance with the
site plan approved by the Department of Community Development.
SECTION FOUR: Except for the variations granted herein, all
other applicable Village of Mount Prospect Ordinances and
Regulations shall remain in full force and effect a.s to the
Subject Property.
SECTION FIVE: This Ordinance shall be in full force and effect
from and after its passage, approval and publication in pamphlet
form in the manner provided by law.
