HomeMy WebLinkAboutOrd 3465 11/07/1984ORDINANCE NO. 3465 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS 406 NORTH FAIRVIEW IN THE VILLAGE OP MOUNT PROSPECT, ILLINOIS PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES THE 7th DAY OF November , 1984 Published in pamphlet form by the authority of the corporate authorities of the Village of Mount Prospect, Illinois the _~t4thday of a__November , 1984 1994V ORDINANCE NO. 346~ AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS 406 NORTH FAIRVIEW IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, Mr. Charles DiMinuco has filed an application for variation with respect to property commonly known as 406 North Fairview in the Village of Mount Prospect, Illinois (the "Subject Property"); and WHEREAS, the Subject Property is described as follows: Lot 8 in Block 5 in Prospect Manor Subdivision of part of the South Three Quarters (3/4) of the West Half (1/2) of the West Half (1/2) of Section 34, Township 42 North, Range 11, Hast of the ThJ_rd Principal Meridian. WHEREAS, Petitioner seeks a variation from provisions of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the erection of a detached garage to be located within two (2') feet from the interior side lot line instead of the required five (5') foot setback as provided in Section 14.10Z.B.2 of Article I of said Chapter: and WHEREAS, a public hearing was held on the variation requests (designated as Case No. ZBA-42-V-84) before the Zoning Board of Appeals of the Village of Mount Prospect on the 27th day of September, 1984, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 10 th day of September, 1984: and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendations to the President and Board of Trustees of the Village of Mount Prospect to allow the requested variation and the President and Board of Trustees of said Village have given further consideration to the variation request and have determined that the same satisfies the standards set forth in Section 14.605 of Article VI of Chapter 14 of the Village Code, and this Board further finds that it would be in the best interest of the Village to grant the request for variation. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, FOLLOWS: AS SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property the variation requested with respect to Section 14.102.B.2 of Chapter 14 of the illage Code of Mount Prospect, Illinois, to garage structure to be located two (2') feet of the subject property rather than five (5') lot line as otherwise required. allow erection of a new from the side lot line feet from said side SECTION THREE: Except for the variations granted herein, all other applicable Village of Mount Prospect Ordinances and Regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
