ORDINANCE NO. 3464
AN ORDINANCE GRANTING A VARIATION FOR
CERTAIN PROPERTY COMMONLY KNOWN AS CRYSTAL
COURT SHOPPING CENTER IN THE VILLAGE OF
MOUNT PROSPECT, ILLINOIS
WHEREAS, Carl Roppolo has filed an application for variation
with respect to property commonly known as Crystal Court
Shopping Center in the Village of Mount Prospect, Illinois
(the "Subject Property"); and
WHEREAS, the Subject Property is described as follows:
Lot 2 in Marco Polo's Subdivision of the East Half
(1/2) of the Northeast Quarter (1/4) of Section 22,
Township 41 North, Range 11, East of the Third
Principal Meridian, in Cook County, Illinois.
WHEREAS, Petitioner seeks the following variations from
provisions of Chapter 21 of the Village Code of Mount Prospect,
Illinois, to allow a slatted chain link fence rather than a
solid wood fence as provided for fences of 8 feet in height
in Section 21.702.D.1: said fence to be located six (6) feet
North of the South property line of the Subject Property
adjacent to the Crystal Towers Condominiums property; and
WHEREAS, a public hearing was held on the variation requests
(designated as Case No. ZBA-40-V-84) before the Zoning Board
of Appeals of the Village of Mount Prospect on the 27th day
of September, 1984, pursuant to due and proper notice thereof
published in the Mount Prospect Herald on the 10th day of
September, 1984; and
WHEREAS, the Zoning Board of Appeals has voted to allow the
variation for a fence of eight (8') feet in height as provided
in Chapter 21, and has further submitted its findings and
recommendations to the President and Board of Trustees of
the Village of Mount Prospect to allow said fence to be a
slatted chain link fence rather than a wood fence, and the
President and Board of Trustees of said Village have given
further consideration to the variation request and have
determined that the same satisfy the standards set forth in
Section 14.605 of Article VI of Chapter 14 of the Village Code,
pertaining to variations from zoning regulations, and this
Board further finds that it would be in the best interest of
the Village to grant the request for variation.
NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS
AS FOLLOWS:
SECTION ONE: The recitals set forth hereinabove are incorporate~
herein as findings of fact by the President and Board of
Trustees of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Village
of Mount Prospect hereby grant to the Subject Property the
variation requested with respect to Section 21.702.D.1 of
Chapter 21 of the Village Code of Mount Prospect, Illinois, to
allow the use of slatted chain link materials in a fence hereto-
ore approved, by the Zoning Board of Appeals, to be installed
to a height of eight (8') feet located six (6) feet North of
the South property line separating the Crystal Court Shopping
Center from the Crystal Tower Condomuni~uns.
SECTION THREE: ExCept for the variations granted herein, all
other applicable Village of Mount Prospect Ordinances and
Regulations shall remain in full force and effect as to the
Subject Property.
SECTION FOUR: This ordinance shall be in full force and effect
from and after its passage, approval and publication in pamphlet
form in the manner provided by law.
