AN ORDINANCE GRANTING A VARIATION FOR CERTAIN
PROPERTY COMMONLY KNOWN AS 1323 cOLuMBINE DRIVE
IN THE VILLAGE OF MOUNT PROSPECT~ ILLINOIS
WHEREAS, Norman and Joan Oyen have filed an application for
.ariation with respect to property commonly known as 1323 Columbin
~rive in the Village of Mount Prospect, Illinois'(the "Subject
'roperty"); and
WHEREAS, the Subject Property is described as follows:
Lot 275 in Brickman Manor Second Addition Unit No. 1
being a subdivision of part of the Northwest
one-fourth of Section 25, Township 42 North, Range 11
East of the Third Principal Meridian, in Cook County
Illinois.
WHEREAS, Petitioners seek the following variations from
· ovisions of Chapter 21 of the Village Code of Mount Prospect,
llinois, to allow them to construct an in-ground swimming pool
ithin seven (7) feet of the side property line and ten (10) feet (
he rear property line to accommodate said pool and pool equipment
n variation of Section 21.1002A. and B of Article X of said
hapter; and to further allow the location of electrical current~ ~f
arrying devices within twelve (12) feet of the pool in variation

WHEREAS, a public hearing was held on the variation requests
designated as Case No. ZBA-34-V-84) before the Zoning Board of
ppeals of the Village of Mount Prospect on the 23rd day of August,
984, pursuant to due and proper notice thereof published in the
~unt Prospect Herald on the 6th day of August, 1984; and
WHEREAS, the Zoning Board of Appeals has submitted its findings
nd recommendations to the President and Board of Trustees of the
illage of Mount Prospect to allow the requested variations, in th~
nd the President and Board of Trustees of said Village have given
urther consideration to the variation requests and have determined
3at the same satisfy the standards set forth in Section 14.605 ofI
utlcle VI of Chapter 14 of the Village Code, and this Board further
inds that it would be in the best interest of the Village to grant
he request for variations.
NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
~USTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS,
DLLOWS:
SECTION ONE: The recitals set forth hereinabove are
~corporated herein as findings of fact by the President
Trustees of the Village of Mount Prospect.

SECTION TWO: The President and Board of Trustees of the Villa~
Mount Prospect hereby grant to the Subject Property the
riations requested with respect to Sections 21.1002.A, 21.1002.B,
~d 21.!018,B of Article X Chapter 21 of the Village Code of Mount
~ospect, Illinois, to allow the construction of a swimming pool to
located up to seven (7) feet from the side lot line of said
~operty and the construction of such pool, and location of pump,

)t line of said property, and to further allow electrical power

SECTION THREE: Except for the variations granted herein, all
)ther applicable Village of Mount Prospect Ordinances and
~egulations shall remain in full force and effect as to the Subjec
'roperty.
SECTION FOUR: This Ordinance shall be in full force and effect
~rom and after its passage, approval and publication in pamphlet
~orm in the manner provided by law.
